Exposició de motius

El Govern, en aplicació de la disposició final primera de la Llei de marques, d'11 de maig de 1995, en la sessió del dia 2 de novembre de 1995 acordà aprovar el Reglament de creació de l'Oficina de Marques del Principat d'Andorra.

En els últims anys s'ha constatat una dependència funcional activa i creixent entre l'Oficina de Marques i els registres de comerç i societats. Per aquest motiu es creu convenient assignar l'Oficina de Marques del Principat d'Andorra al Departament d'Economia, sota una mateixa direcció.

Es per aquest fet i per raons de seguretat jurídica que es publica íntegrament el Reglament de modificació del Reglament de creació de l'Oficina de Marques del Principat d’Andorra.

A proposta del ministre d'Economia i Agricultura, el Govern, en la sessió del 5 de desembre del 2007, aprova aquest Decret amb el contingut següent: Reglament de modificació del Reglament de creació de l'Oficina de Marques del Principat d’Andorra.

Article únic

Es crea l'Oficina de Marques del Principat d'Andorra, amb les sigles OMPA, com a òrgan de l'Administració general adscrit al Departament d'Economia.

Disposició final

Aquest Reglament entrarà en vigor el mateix dia de ser publicat al Butlletí Oficial del Principat d’Andorra.*

Statement of purpose

The Government, on applying the first final provision of the Trademark Law of 11 May 1995, in its session of 2 November 1995, resolved to approve the Regulation on the Creation of the Office of Trademarks in the Principality of Andorra.

In recent years an active, growing, reporting relationship between the Office of Trademarks and the Commercial and Company Registers has been noted. For this reason, it seemed appropriate to assign the Office of Trademarks of the Principality of Andorra to the Department of the Economy, under single management.

For this reason and for reasons of legal security, the complete Regulation of amendment of the Regulation on the Creation of the Office of Trademarks in the Principality of Andorra has been published.

On the proposal of the Minister of the Economy and Agriculture, the Government, in its session of 5 December 2007, approved this Decree with the following content: Regulation of amendment of the Regulation on the Creation of the Office of Trademarks in the Principality of Andorra.

Single article

The Office of Trademarks of the Principality of Andorra is created, with the acronym OMPA, as an overall administrative body ascribed to the Department of the Economy.

Final provision

This Regulation will enter into force on the day of its publication in the Butlleti Oficial del Principat d'Andorra (Official Bulletin of the Principality of Andorra).*
