MINISTERIAL ORDER N°05/10/Minicom OF 25/08/2010 DETERMINING THE TIMEFRAME PROVIDED FOR GRANTING OF UNILATERAL LICENCE, A COMPULSORY LICENCE AND OPPOSITION TO REGISTRATION OF INTELLECTUAL PROPERTY

Article 1: Purpose of this Order This Order determines the timeframe provided for granting a unilateral licence, a compulsory licence, and an opposition to registration of an intellectual property.

Article 2: Provided timeframe The duration for unilateral licence shall be four (4) years. The duration for compulsory licence shall be twelve (12) months renewable, if deemed necessary

Article 3: Opposition against the registration of location indicators The time to file an opposition against the registration of the location indicators shall be thirty (30) days starting to run from the date the registration is made.

Article 4: Repealing provision All prior provisions contrary to this Order are hereby repealed.

Article 5: Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda. Kigali, on 25/08/2010

ARRETE MINISTERIEL N°05/10/Minicom DU 25/08/2010 FIXANT LES DELAIS PREVUS POUR L’OCTROI D’UNE LICENCE UNILATERALE, LICENCE OBLIGATOIRE ET OPPOSITION A L’ENREGISTREMENT DE LA PROPRIETE INTELLECTUELLE

Article 1: Objet du présent arrêté Le présent arrêt fixe les délais prévus pour l'octroi de l'autorisation unilatérale, l'autorisation obligatoire et l'opposition à l'enregistrement de la propriété intellectuelle.

Article 2: Délais prévus La durée de l'autorisation unilatérale est de quatre (4) ans. La durée de l'autorisation obligatoire est de douze (12) mois renouvelables, si nécessaire.

Article 3: Opposition contre l’enregistrement des signaux de localisation Le délai pour faire opposition contre l'enregistrement des signaux de localisation est de trente (30) jours qui courent à partir du jour de l'enregistrement.

Article 4: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées.

Article 5: Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda. Kigali le 25/08/2010
