Ministerial Order N°01/10/MINISPOC of 20/08/2010 determining the content of the application for suspension of procedures of clearing goods suspected to have been pirated

Article 1: Purpose of this Order This Order determines the content of application for submission to court requesting customs' authorities to suspend custom's procedures of goods suspected to have been pirated.

Article 2: Content of the application The application for suspension of customs‟ procedures of goods suspected to have been pirated shall indicate the following: 1. the name of applicant and where necessary, the assignee or owner of license or patent;

2. name of the inventor;

3. title of the invention;

4. type of invention;

5. date/period of publication or production of the invention;

6. name of the producer;

7. description of the invention;

8. the ISBN (only for the piece of work);

9. the reason for the application or for dispute;

10. date, address and signature of the applicant.

Article 3: Repealing provision All prior provisions contrary to this Order are hereby repealed.

Article 4: Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda. Kigali, on 20/08/2010

Arrêté Ministériel N°01/10/MINISPOC du 20/08/2010 déterminant le contenu de la demande de suspension de la procédure de dédouanement des marchandises suspectées de contrefaçon ou de piratage

Article 1: Objet du présent arrêté Le présent arrêté prescrit le contenu de la demande à adresser au tribunal pour requérir une ordonnance destinée aux autorités douanières en vue d'une suspension des procédures de dédouanement des marchandises suspectées de contrefaçon ou de piratage.

Article 2: Contenu de la demande La demande requérant la suspension des procédures de dédouanement des marchandises suspectées de contrefaçon ou de piratage doit porter des indications suivantes: 1. le nom du demandeur, si nécessaire du cessionnaire ou propriétaire de licence;

2. le nom de l'auteur de l'œuvre ;

3. titre de l'œuvre ;

4. genre de l'œuvre ;

5. période de publication ou de production de l'œuvre ;

6. nom du producteur ;

7. description de l'œuvre ;

8. l'ISBN (pour l'ouvrage uniquement);

9. l'objet de la demande ou du litige ;

10. date, adresse et signature du requérant.

Article 3: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées.

Article 4: Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda. Kigali, le 20/08/2010
