Bekendtgørelse om udvidelse af anvendelsesområdet for bekendtgørelse om patent på opfindelser af lægemidler og

bekendtgørelse om patent på opfindelser af næringsmidler og patent på fremgangsmåder ved tilvirkning af næringsmidler

I medfør af bestemmelsen i kapitel XI, nr. 1, stk. 2, i patentloven, jf. lovbekendtgørelse nr. 366 af 9. juni 1998 samt efter bemyndigelse i henhold til § 1 i Erhvervsministeriets bekendtgørelse nr. 416 af 27. maj 1992, fastsættes:

§ 1. Bestemmelserne i bekendtgørelse nr. 450 af 16. september 1983 om patent på opfindelser af lægemidler finder efter anmodning fra indehaveren anvendelse på ansøgninger, der er indleveret før 1. december 1983, og som fortsat var under behandling den 1. januar 1996.

Stk. 2. Ændringer i ansøgninger omfattet af stk. 1 må ikke omfatte nye forhold.

§ 2. Bestemmelserne i bekendtgørelse nr. 511 af 23. august 1988 om patent på opfindelser af næringsmidler og patent på fremgangsmåder ved tilvirkning af næringsmidler finder efter anmodning af indehaveren anvendelse på ansøgninger, der er indleveret før 1. januar 1989, og som fortsat var under behandling den 1. januar 1996.

Stk. 2. Ændringer i ansøgninger omfattet af stk. 1 må ikke omfatte nye forhold.

§ 3. Bekendtgørelsen træder i kraft den 1. oktober 1999.

Order on the Extension of the Application Area for Order on Patents for Inventions of Medicinal Products and Order on Patents for Inventions of Food Products and Patents for Processes for the Manufacture of Food Products

Pursuant to Part 11, 1(2) of the Danish Patents Act, cf. Consolidated Act No. 366 of 9 June 1998, and by order under section 1 of the Ministry of Trade and Industry Order No. 416 of 27 May 1992, it is laid down that:

1. (1) The provisions of Order No. 450 of 16 September 1983 on patents for inventions of medicinal products shall, upon the request of the proprietor, apply to applications filed before 1 December 1983 and which were still pending on 1 January 1996.

(2) Amendments in applications comprised by (1) may not include new conditions.

2. (1) The provisions of Order No. 511 of 23 August 1988 on patents for inventions of food products and patents for processes for the manufacture of food products shall, upon the request of the proprietor, apply to applications filed before 1 January 1989 and which were still pending on 1 January 1996.

(2) Amendments in applications comprised by (1) may not include new conditions.

3. This Order shall enter into force on 1 October 1999.
