The notification by Estonia to the WTO under article 63.2 of TRIPS states:
'1. The Republic of Estonia, in accordance with Article 1.3 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, will not apply the criterion of publication referred to in Article 5(1)(c) of the Rome Convention as regards the protection of producers of phonograms.
2. In accordance with Article 1.3 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, the Republic of Estonia avails itself of the possibility provided in Article 6(2) of the Rome Convention and, consequently, will protect broadcasts only if the headquarter of the broadcasting organization is situated in a WTO Member and the broadcast was transmitted from a transmitter situated in the same WTO Member.'

§ 1. Ühineda juurdelisatud teose esitaja, fonogrammitootja ja ringhäälinguorganisatsiooni kaitse rahvusvahelise konventsiooniga (edaspidikonventsioon), mis on koostatud 1961. aasta 26. oktoobril Roomas.

§ 2. Ühinemisel teha järgmised deklaratsioonid:

1) konventsiooni artikli 5 lõike 3 alusel deklareerib Eesti Vabariik, et ei kohalda avaldamiskriteeriumi;
2) konventsiooni artikli 6 lõike 2 alusel deklareerib Eesti Vabariik, et kaitseb saateid vaid siis, kui ringhäälinguorganisatsiooni peakorter asub teises osalisriigis ja saade on edastatud selles osalisriigis asuvast saatjast;
3) konventsiooni artikli 16 lõike 1 punkti a alapunkti iv alusel deklareerib Eesti Vabariik, et fonogrammi suhtes, mille tootja on teise osalisriigi kodanik, kohaldatakse nimetatud artiklis ettenähtud kaitset sel määral ja sellise tähtajaga, nagu teine osalisriik kohaldab Eesti Vabariigi kodaniku poolt esmakordselt salvestatud fonogrammile. Kui osalisriik, kelle kodanik fonogrammitootja on, ei taga kaitset niisama suurele tulusaajate ringile nagu Eesti Vabariik, ei loeta seda kaitse määrast kõrvalekaldumiseks.
