Details Details Year of Version 1998 Dates Entry into force: April 26, 1999 Issued: December 10, 1998 Type of Text Implementing Rules/Regulations Subject Matter Enforcement of IP and Related Laws Subject Matter Notes For provisions relating to intellectual property, see Part 49 on specialist proceedings and RSC Order 59 Rule 17 on appeal against revocation of patent & Rule 18 on appeals from the Patents Court. Notes The Civil Procedure Rules 1998 make provisions for a new code of civil procedure for civil courts and Part 49 'Specialist Proceedings' paragraph 2 (d) stipulates that these Rules apply to proceedings in 'Patents Court business (as defined by the relevant practice direction) and proceedings under—
(i)the Copyright, Designs and Patents Act 1988(1);
(ii)the Trade Marks Act 1994(2); and
(iii)the Olympic Symbol etc Protection Act 1995(3) and Olympics Association Right (Infringement Proceedings) Regulations 1995(4);'.
Rule 17 'Appeal against order for revocation of patent' to these Rules sets out the procedure for an appleal to the Court of Appel from an order for the revocation of a patent. Rule 18 'Appel from Patent Court on appeal from Comptroller' makes proivisions on the proceedings relating to an appeal from a decision of the Comptroller- General of Patents, Designs and Trade Marks.
