PATENTS (AMENDMENT) ORDINANCE, 2006.

ORDINANCE XXXVIII OF 2006

AN

ORDINANCE

further to amend the Patents Ordinance, 2000

WHEREAS it is expedient further to amend the Patents Ordinance, 2000 (LXI of 2000);

AND WHEREAS the National Assembly is not in session and the President is satisfied that circumstances exist which render it necessary to take immediately action.

NOW THEREFORE, in exercise of the powers conferred by clause (1) of Article 89 of the Constitution of the Islamic Republic of Pakistan, the President is pleased to make and promulgate the following Ordinance:-

1. Short title and commencement.- (1) This Ordinance may be called the Patents (Amendment) Ordinance, 2006.

(2) It shall come into force at once.

2. Amendment of section 16, Ordinance LXI of 2000.- In the Patents Ordinance, 2000 (LXI of 2000), hereinafter referred to as the said Ordinance, in section 16,-

(a) in subsection (2), the comma and words “, but before the period of eighteen months from the date of filing of application in Pakistan” shall be omitted and shall be deemed always to have been so omitted; and

(b) subsection (6) shall be omitted.

3. Omission of section 19, Ordinance LXI of 2000.-In the said Ordinance, section 19 shall be omitted.
