Verordnung über die Erfindungspatente (Patentverordnung, PatV)

Änderung vom 14. März 2008

Der Schweizerische Bundesrat verordnet:

I

Die Patentverordnung vom 19. Oktober 19771 wird wie folgt geändert:

Art. 116 Aufgehoben

Art. 117 Abs. 1 Einleitungssatz und 2 1 Betrifft nur den französischen Text. 2 Das Institut trägt die Angaben in der Verfahrenssprache des Europäischen Patent­ amts ein; ist diese Englisch, so trägt es die Angaben in deutscher Sprache ein, solange der Patentinhaber nicht die Eintragung in französischer Sprache verlangt.

II

Diese Änderung tritt am 1. Mai 2008 in Kraft.

Modification du 14 mars 2008

Le Conseil fédéral suisse arrête:

I

L’ordonnance du 19 octobre 1977 sur les brevets1 est modifiée comme suit:

Art. 116 Abrogé

Art. 117, al. 1 (phrase introductive) et 2 1 Dans le registre suisse des brevets européens (art. 117 de la loi) sont inscrites: 2 L’Institut inscrit les indications dans la langue de la procédure utilisée par l’Office européen des brevets; si cette langue est l’anglais, l’inscription se fait en allemand, le titulaire du brevet pouvant toutefois demander à tout moment que l’inscription soit faite en français.

II

La présente modification entre en vigueur le 1er mai 2008.

Modifica del 14 marzo 2008

Il Consiglio federale svizzero ordina:

I

L’ordinanza del 19 ottobre 19771 sui brevetti è modificata come segue:

Art. 116 Abrogato

Art. 117 cpv. 1, frase introduttiva, e 2 1 Concerne soltanto il testo francese. 2 L’Istituto registra le indicazioni nella lingua della procedura dell’Istituto europeo dei brevetti; se questa è l’inglese, registra le indicazioni in tedesco, fermo restando che il titolare del brevetto può esigere la registrazione in francese in ogni momento.

II

La presente modifica entra in vigore il 1° maggio 2008.
