Verordnung über die Erfindungspatente (Patentverordnung, PatV)

Änderung vom 1. Mai 2013

Der Schweizerische Bundesrat verordnet:

I

Die Patentverordnung vom 19. Oktober 19771 wird wie folgt geändert:

Art. 18 Abs. 1 1 Die Jahresgebühren sind für jede Anmeldung und jedes Patent ab Beginn des vierten Jahres nach der Anmeldung alljährlich im Voraus zu bezahlen.

Art. 118a Jahresgebühren Für das europäische Patent sind alljährlich im Voraus Jahresgebühren an das Institut zu zahlen, erstmals für das Patentjahr, das dem Hinweis auf die Erteilung des euro- päischen Patentes im Europäischen Patentblatt folgt, frühestens jedoch ab Beginn des vierten Jahres nach der Anmeldung.

II

Diese Änderung tritt am 1. Januar 2014 in Kraft.

Ordonnance relative aux brevets d’invention (Ordonnance sur les brevets, OBI)

Modification du 1er mai 2013

Le Conseil fédéral suisse arrête:

I

L’ordonnance du 19 octobre 1977 sur les brevets1 est modifiée comme suit:

Art. 18, al. 1 1 Pour toute demande de brevet et pour tout brevet, les annuités sont payables d’avance chaque année dès le début de la quatrième année qui suit le dépôt de la demande.

Art. 118a Annuités Le brevet européen donne lieu chaque année au paiement par avance d’annuités perçues par l’Institut; le premier paiement est dû pour l’année qui suit celle au cours de laquelle la délivrance du brevet européen a été mentionnée dans le Bulletin euro- péen des brevets, mais au plus tôt dès le début de la quatrième année qui suit le dépôt de la demande.

II

La présente modification entre en vigueur le 1er janvier 2014.

Ordinanza relativa ai brevetti d’invenzione (Ordinanza sui brevetti, OBI)

Modifica del 1° maggio 2013

Il Consiglio federale svizzero ordina:

I

L’ordinanza del 19 ottobre 19771 sui brevetti è modificata come segue:

Art. 18 cpv. 1 1 Le tasse annuali per ogni domanda di brevetto e per ogni brevetto devono essere pagate anticipatamente ciascun anno a contare dall’inizio del quarto anno dopo il deposito.

Art. 118a Tasse annuali Per il brevetto europeo una tassa annuale deve essere pagata anticipatamente all’Istituto, la prima volta per l’anno che segue quello in cui il rilascio del brevetto europeo è menzionato nel Bollettino europeo dei brevetti, ma al più presto dall’inizio del quarto anno che segue il deposito della domanda.

II

La presente modifica entra in vigore il 1° gennaio 2014.
