TRADE MARKS ACT (Chapter98)

TRADE MARKS (AMENDMENT)RULES, 2017

In exercise of the power conferred by section 106(3)of the Trade Marks Act, the Minister of Energy and Industry in the Office of the Prime Minister, with the approval of His Majesty the Sultan and Yang Di-Pertuan, hereby makes the following Rules -

Citation and commencement

1. These Rules may be cited as the Trade Marks (Amendment)Rules, 2017 and shall commence on the same date as the Trade Marks Act (Amendment) Order, 2017.

Amendment of rule 2 of Rl of Chapter 98

2. Rule 2 of the Trade Marks Rules, in these Rules referred to as the principal Rules, is amended, in subrule (1) , in the definition of "publish", by deleting "Gazette" and by substituting "Journal" therefor.

Amendment of rule 26

3. Rule 26 of the principal Rules, is amended, in subrule ( I ) , by deleting "Gazette" and by substituting "Journal" therefor.

Amendment of Third Schedule

4. The Third Schedule to the principal Rules are amended -

(a) in Part I -

(i) in Class 1, by deleting "photocopy" in the first line and by substituting "photography" therefor;

( i i ) in Class 4, by deleting ", wicks" and by substituting "and wicks for lighting" therefor;

(iii) in Class 5, by deleting ", veterinary and sanitary preparations; dietetic" from the first line and by substituting "and veterinary preparations; sanitary preparations for medical purposes; dietetic food and" therefor;

(iv) in Class 7, by deleting " ; incubator for eggs" and by substituting "other than hand-operated; incubators for eggs, automatic vending machines" therefor;

(v) in Class 9, by deleting the items in the second colurnrl and by substituting the following new items therefor -

"Scientific, nautical, surveying, photographic, cinematographic, optical, weighing, measuring, signalling, checking (supervision], life-saving and teaching apparatus and instruments; apparatus and instruments for conducting, switching, transforming, accumulating, regulating or controlling electricity; apparatus for recording, transmission or reproduction of sound or images; magnetic data carriers, recording discs; compact discs, DVDs and other digital recording media, mechanisms for coin-operated apparatus; cash registers, calculating machines, data processing equipment, computers; computer software; fire extinguishing apparatus.";

(vi) in Class 16, by deleting "playing cards;" from the last line;

(vii) in Class 18, by deleting "umbrellas, parasols and" and by substituting "umbrellas and parasols;" therefor;

(viii)in Class 21, by deleting "(not of precious metal or coated therewith)" from the first two lines;

(ix) in Class 24, by deleting "bed and" and by substituting "bed covers;" therefor;

(x) in Class 29, by deleting "fruit sauces" and by substituting "compotes" therefor;

(xi) in Class 32, by deleting "drinks; fruit drinks" and by substituting "beverages; fruit beverages" therefor;

(b) in Part I1 -

(i) by deleting Class 42 and by substituting the following new Class therefor -

"Class 42 Scientific and technological services and research and design relating thereto; industrial analysis and research services; design and development of computer hardware and software.";

(ii) by adding the following new Classes -

"Class 43 Services for providing food and drink; temporary accommodation.

Class 44 Medical services; veterinary services; hygienic and beauty care for human beings or animals; agriculture, horticulture and forestry services.

Class 45 Legal services; security services for the protection of property and individuals; personal and social services rendered by others to meet the needs of individuals.".
