Details Details Year of Version 2021 Dates Entry into force: May 13, 2016 Published: May 12, 2016 Issued: May 11, 2016 Type of Text Implementing Rules/Regulations Subject Matter Patents (Inventions) Notes This consolidated version of Decree No. 8.772 of May 11, 2016 incorporates amendments up to Decree No. 10.844 of October 25, 2021, which was published in the Official Gazette on October 26, 2021, and entered into force 180 days after its publication. The amending decree modifies Articles 22, 23, and 24 and adds Articles 20-A and 22-A to this consolidated decree. Under this consolidated version of Decree No. 8.772/2016, intellectual property rights involving genetic resources or associated traditional knowledge require declaration and registration with CGen — the National Genetic Heritage Management Committee (Art. 109), submission of proof of registration in cases where it is missing or canceled (Art. 110), compliance with benefit-sharing obligations (Arts. 103–104, 112), and observance of exemptions for traditional or indigenous breeding (Art. 108). These requirements do not apply to database consultation (Art. 107, sole paragraph).
