PLANT BREEDERS' RIGHTS (FORM OF CERTIFICATE) REGULATIONS, 1982.

 

 

I, ALAN M. DUKES, Minister for Agriculture, in exercise of the powers conferred on me by section 4 (3) of the Plant Varieties (Proprietary Rights) Act, 1980 (No. 24 of 1980) hereby make the following Regulations:

 

 

1. These Regulations may be cited as the Plant Breeders' Rights (Form of Certificate) Regulations, 1982.

 

 

2. The certificate referred to in section 4 (3) of the Plant Varieties (Proprietary Rights) Act, 1980 (No. 24 of 1980), shall be in the form set out in the Schedule to these Regulations.

EXPLANATORY NOTE.

 

 

The Regulations prescribe the form of certificate of grant of Plant Breeders' Rights.

CERTIFICATE OF GRANT OF PLANT BREEDERS' RIGHTS

WHEREAS,

 

 

 

 

 

hereinafter called the applicant, has, pursuant to the Plant Varieties (Proprietary Rights) Act, 1980 , applied for a grant of Rights in respect of the plant variety .................................. of the genus and species ..................................... which said botanical species stands for the time being specified in the Plant Varieties (Proprietary Rights) Regulations, 1981 ( S.I. No. 23 of 1981 ),

 

 

I, Controller of Plant Breeders' Rights, being satisfied that each of the conditions specified in paragraphs (a) and (b) of section 5 (1) of the said Act has been duly complied with, hereby certify that I have this day granted to the Applicant PLANT BREEDERS' RIGHTS in respect of the aforesaid plant variety to be exercised and enjoyed by him subject to and in accordance with the said Act (and to the conditions set out overleaf, which conditions have been specified by the Minister for Agriculture pursuant to and for the purposes of section 5 (2) of the said Act and are for the time being in force*) and I further certify that, subject to the provisions of the said Act, the said Plant Breeders' Rights are to be exercisable during the period of years commencing on the date of this certificate.
