Law on the Protection of Industrial Property (No. 87-18/AN-RM of March 9, 1987)*

LAWS AND TREATIES

1. The protection of industrial property shall be subject to the Agreement Relating to the Creation of an African Intellectual Property Organization, known as the Bangui Agreement, Constituting a Revision of the Agreement Relating to the Creation of an African and Malagasy Office of Industrial Property. I

2. However, applications filed between November . 24, 1958, and September 30, 1984, for patents, certifi- cates ofaddition, registration of trademarks or ofindus- trial designs shall be subject to this Law.

3. Titles of protection in respect of applications for patents or certificates of addition shall be issued on condition that the request is formulated by the owners.

Entry into force: As regards applications made in Mali before September 30. 1984: July 28, 1988: as from that date, the OAPI Bangui Agreement is applicable.

4. Applications filed for registration of trademarks shall be registered on condition that the request is formulated by the owners.

5. The following fees shall be levied:

(1) for applications for patents and certificates of addition:

- a filing fee covering the first annual payment; - a filing fee for certificates of addition; - fees for maintenance in force or annual fees; - fees for acts concerning patents; - a fee for obtaining information; - a publication fee for a patent or certificate of

addition;

(2) for applications for registration of a trademark:

- a filing fee for an application for registration; - a renewal fee; - a fee for each class of goods; - a fee for acts concerning trademarks.

6. The amount of the fees referred to in the above Section shall be laid down by regulation.

7. The fees referred to in Section 5, above, may be validly paid by representatives domiciled on the national territory within a period of six months the beginning of which shall be laid down by regulation.

Loi relative à la protection de la propriété industrielle (N° 87-181AN-RM du 9 mars 1987)*

LOIS ET TRAITÉS

1. La protection de la propriété industrielle est soumise à l'Accord relatif à la création d'une Organi- sation africaine de la propriété intellectuelle, dit Accord de Bangui, constituant révision de l'Accord relatif à la création d'un Office africain et malgache de la propriété industrielle'.

2. Toutefois, les dépôts effectués entre le 24 novembre 1958 et le 30 septembre 1984 et concer- nant les demandes de brevet d'invention, de certificat d'addition, d'enregistrement de marques de fabrique et de commerce et les dessins ou modèles industriels sont soumis aux dispositions de la présente loi.

3. Pour les demandes de brevet d'invention ou de certificat d'addition, les titres de protection sont délivrés à la condition que la requête en soit formulée par les titulaires.

4. Les dépôts de demandes d'enregistrement de marques de fabrique ou de commerce sont enregistrés à

la condition que la requête en soit formulée par les titulaires.

5. Il est institué les taxes suivantes:

1) pour les demandes de brevet d'invention et de certificat d'addition :

- taxe de dépôt couvrant la première annuité; - taxe de dépôt de certificat d'addition; - taxes annuelles de maintien en vigueur ou

annuités; - taxes concernant les actes portant sur des brevets

d'invention; - taxe d'obtention de renseignements; - taxe de publication d'un brevet ou d'un certificat

d'addition;

2) pour les demandes d'enregistrement d'une marque de fabrique ou de commerce :

- taxe de dépôt d'une demande d'enregistrement; - taxe de renouvellement; - taxe par classe de produits; - taxe concernant les actes portant sur des marques

de fabrique ou de commerce.

6. Les montants des taxes visées à l'article précédent sont fixés par voie réglementaire.

7. Les taxes visées à l'article 5 ci-dessus peuvent être valablement acquittées par des mandataires domiciliés sur le territoire national dans un délai de six mois dont la date d'ouverture sera fixée par voie réglementaire.
