Bekendtgørelse om henlæggelse af visse beføjelser til Patent- og Varemærkestyrelsen

§ 1. Beføjelser til at fastsætte bestemmelser, som efter følgende love er tillagt økonomi- og erhvervsmi‐ nisteren, udøves af Patent- og Varemærkestyrelsen, jf. dog § 2: 1) Patentloven, jf. lovbekendtgørelse nr. 91 af 28. januar 2009. 2) Varemærkeloven, jf. lovbekendtgørelse nr. 90 af 28. januar 2009. 3) Fællesmærkeloven, lov nr. 342 af 6. juni 1991. 4) Designloven, jf. lovbekendtgørelse nr. 89 af 28. januar 2009. 5) Lov om brugsmodeller, jf. lovbekendtgørelse nr. 88 af 28. januar 2009. 6) Lov om hemmelige patenter, jf. lovbekendtgørelse nr. 732 af 27. november 1989. 7) § 4, stk. 4, i lov om kommunernes styrelse, jf. lovbekendtgørelse nr. 696 af 27. juni 2008. 8) Lov om beskyttelse af halvlederprodukters udformning, lov nr. 778 af 9. december 1987. 9) § 7, stk. 1, i søloven, jf. lovbekendtgørelse nr. 538 af 15. juni 2004.

§ 2. Følgende beføjelser henlægges ikke til Patent- og Varemærkestyrelsen: 1) Beføjelser efter § 7, stk. 2 og 4 i patentloven, jf. lovbekendtgørelse nr. 91 af 28. januar 2009, om ned‐

sættelse af Patentankenævnet (Ankenævnet for Patenter og Varemærker) og om betaling af gebyrer. 2) Beføjelser efter § 17, stk. 1 og 2, i lov nr. 778 af 9. december 1987 om beskyttelse af halvlederpro‐

dukters udformning (topografi) om nedsættelse af et ankenævn og om fastsættelse af regler om anke‐ nævnets sammensætning og forretningsorden samt om betaling af gebyrer.

3) Beføjelse efter § 19 i lov nr. 778 af 9. december 1987 om beskyttelse af halvlederprodukters udform‐ ning (topografi) til at fastsætte tidspunktet for ikrafttrædelse af lovens kap. 3 om tvangslicens.

§ 3. Bekendtgørelsen træder i kraft den 1. marts 2009. Stk. 2. Bekendtgørelse nr. 39 af 17. januar 2002 om henlæggelse af visse beføjelser til Patent- og Vare‐

mærkestyrelsen ophæves.

Order on Reference of Certain Rights to the Patent and Trademark Office

1.- The rights to lay down provisions which

pursuant to the following acts are conferred on

the Minister of Economic and Business Affairs

shall be exercised by the Patent and Trademark

Office, cf., however, section 2:

(i) The Patents Act, cf. Consolidate Act No. 91

of 28 January 2009,

(ii) The Trade Marks Act, cf. Consolidate Act

No. 90 of 28 January 2009,

(iii) The Collective Marks Act, Act No. 342 of 6

June 1991,

(iv) The Designs Act, cf. Consolidate Act No. 89

of 28 January 2009,

(v) The Utility Models Act, cf. Consolidate Act

No. 88 of 28 January 2009,

(vi) The Secret Patents Act, cf. Consolidate Act

No. 732 of 27 November 1989,

(vii) Section 4(4) of the Municipal

Administration Act, cf. Consolidate Act No. 696

of 27 June 2008,

(viii) The Protection of Topographies of

Semiconductor Products Act, Act No. 778 of 9

December 1987,

(ix) Section 7(1) of the Merchant Shipping Act,

cf. Consolidate Act No. 538 of 15 June 2004.

2.- The following rights shall not be referred to

the Patent and Trademark Office:

(i) Rights pursuant to section 7(2) and (4) of the

Patents Act, cf. Consolidate Act No. 91 of 28

January 2009, concerning the establishment of

the Patent Board of Appeal (The Board of

Appeal for Patents and Trademarks) and

concerning the payment of fees.

(ii) Rights pursuant to section 17(1) and (2) of

Act No. 778 of 9 December 1987 on the

protection of topographies of semiconductor

products concerning the establishment of a

Board of Appeal, concerning the laying down of

rules relating to the composition and procedure

of the Board of Appeal and concerning the

payment of fees.

(iii) The right pursuant to section 19 of Act No.

778 of 9 December 1987 on the protection of

topographies of semiconductor products to fix

the date of entry into force of Part 3 of the Act

concerning compulsory licence.

3.-(1) This Order shall enter into force on 1

March 2009.

(2) Order No. 39 of 17 January 2002 on

reference of certain rights to the Patent and

Trademark Office shall be repealed.
