COPYRIGHT AND RELATED RIGHTS (AMENDMENT) ACT 2004

AN ACT TO REMOVE DOUBT IN RELATION TO THE LAW- FULNESS, UNDER THE COPYRIGHT AND RELATED RIGHTS ACT 2000, OF DISPLAYING CERTAIN WORKS IN PUBLIC. [3rd June, 2004]

BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:

1.—Section 40 of the Copyright and Related Rights Act 2000 is amended by inserting the following subsection after subsection (7):

‘‘(7A) For the avoidance of doubt, no infringement of any right created by this Part in relation to an artistic or literary work occurs by reason of the placing on display the work, or a copy thereof, in a place or premises to which members of the public have access.’’.

2.—Nothing in this Act affects proceedings instituted before 26 May 2004.

3.—(1) This Act may be cited as the Copyright and Related Rights (Amendment) Act 2004.

(2) The Copyright and Related Rights Act 2000 and this Act may be cited together as the Copyright and Related Rights Acts 2000 and 2004.
