The Constitution was adopted in 1978 and is the supreme law of Solomon Islands. It lays down the framework defining fundamental political principles, establishes the structure, procedures, powers and duties, of the government and spells out the fundamental rights, directive principles and duties of citizens.
The Constitution does not contain provisions that specifically refer to intellectual property rights. However, Article 8 of Chapter II ('Protection of Fundamental Rights and Freedoms of the Individual') prohibits the deprivation of the property, providing in part 1: 'No property of any description shall be compulsorily taken possession of, and no interest or right over property of any description shall be compulsorily acquired...' (see page 20)
