Acuerdo y Sentencia Nº 64. Juicio: "Johnson & Johnson c/ La Química Farmacéutica S.A. s/ Nulidad de Registro de Marcas,"

La actora "Johnson & Johnson" alegó ser propietaria de la marca "DESITIN". Mientras que "La Química Farmacéutica S.A." adujo ser propietaria de la marca "DESIQUIM". La firma accionante demandó nulidad del Registro de la marca "DESIQUIM", expresando que es parecida y por ello confundible gramatical, visual y fonéticamente con la marca "DESITIN".

Por Acuerdo y Sentencia Número 16, con fecha 19 de Junio del 2.020, el Tribunal de Apelación en lo Civil y Comercial, Primera Sala, resolvió: "DECLARAR desierto el Recurso de Nulidad; REVOCAR la S.D. Nº 412 de fecha 23 de Mayo del 2.018, dictada por el Juzgado de Primera Instancia en lo Civil y Comercial del Decimo Turno de la Capital y en consecuencia hacer lugar a la presente demanda por nulidad de registro de la marca "DESIQUIM", inscripta bajo la nomenclatura Clase 5, con registro Nº 401232 de fecha 30 de julio de 2014.
