Recurso de apelação

 

SUMÁRIO:

I. Para que fosse feita a análise, fina e de rigor, da existência de um quadro justificativo de uma muito excepcional derrogação à regra que afasta a produção de prova testemunhal no processo de recurso de marca, sempre a Recorrente teria que invocar e patentear o preenchimento de circunstâncias de excepção;

II. Na al. c) do n.º 1 do art. 615.º do Código de Processo Civil, o legislador buscou vedar a perda de continuidade lógica entre os esteios da decisão judicial e o seu conteúdo dispositivo;

III. A al. d) do n.º 1 do art. 615.º do Código de Processo Civil fere de nulidade as decisões judiciais que não contenham pronuncia sobre questões que nas mesmas devessem ser avaliadas ou que conheçam de questões de que o Tribunal não podia tomar conhecimento;

IV. Não estão aí contidos, por razões que vão da semântica e gramática do enunciado legal à estrutura técnica do acto de julgamento, os factos a fixar.

V. Para sanar vícios relativamente a tais factos existe preceito específico que é o  art. 640.º do Código de Processo civil.

VI. A recusa do registo com fundamento em reprodução colidente pressupõe a existência de uma marca anterior reproduzida, como se vê, designadamente, do estabelecido nas als. a) e b) do n.º 1 do art. 232.º do Código da Propriedade Industrial.
