a) Die Einbettung eines mit Einwilligung des Rechtsinhabers auf einer frei zugänglichen Internetseite verfügbaren Werks in die Internetseite eines Dritten im Wege des Framing stellt einen Eingriff in das Recht zur öffentlichen Wiedergabe nach § 15 UrhG dar, wenn sie unter Umgehung von Schutzmaßnahmen gegen Framing erfolgt, die der Rechtsinhaber getroffen oder veranlasst hat (Anschluss an EuGH, Urteil vom 9. März 2021 - C-392/19, GRUR 2021, 706 = WRP 2021, 600 - VG Bild-Kunst).

b) Bedingungen einer Nutzungsrechtseinräumung können im Sinne des § 34 Abs. 1 Satz 1 VGG angemessen sein, wenn sie der Gefahr von Rechtsverletzungen vorbeugen sollen, die nicht durch den zukünftigen Vertragspartner der Verwertungsgesellschaft, sondern durch Drittnutzer begangen werden.

c) Bei der nach § 34 Abs. 1 VGG vorzunehmenden Interessenabwägung ist nicht auf das tatsächlich bestehende Interesse einzelner Urheber abzustellen, sondern auf die typische, auf Rechtswahrung gerichtete Interessenlage der von der Verwertungsgesellschaft treuhänderisch vertretenen Urheberrechtsinhaber.
