Acuerdo y Sentencia Nº 557. Expediente: "Daniel Ramírez Candia c/ Sandra Mussa s/ Nulidad de Registro de Marcas y otros"

El Tribunal de Apelación revocó Sentencia de Primera Instancia fundado en que ni el actor ni la demandada tenían Derecho a usar la marca comercial en disputa "Lonas Guaraní". Esgrimió que su pretensión fue lograr la anulación de una marca comercial registrada en forma irregular por una persona que no tenía Derecho a su uso por la existencia del uso anterior. Peticionó que las Costas sean impuestas en el orden causado. La adversa contestó traslado, solicitando confirmatoria del Fallo impugnado.

A criterio de la Sala Civil de la Corte Suprema de Justicia, se advierte que el actor carece de derecho sobre el nombre comercial "Lonas Guaraní", y por ende carece de legitimación para solicitar la nulidad de la marca "Lonas Guaraní". En consecuencia, la sentencia apelada debe ser confirmada, en este punto.

Las costas deben ser impuestas a la perdidosa en esta instancia, conforme con el principio general del art. 192 del Código Procesal Civil, en concordancia con los arts. 203 inc. b) y 205 del mismo cuerpo legal.
