Acuerdo y Sentencia Nº 700. Acción de Inconstitucionalidad: "Contra el Decreto N° 6780/11 "Por el cual se reglamenta el Capítulo IV de la Ley N° 1328/98 De Derechos de Autor y Derechos Conexos". Año: 2011 - N° 949

Alegan como fundamento de su pretensión, que las disposiciones mencionadas son notoriamente contrarias a lo establecido en la Constitución Nacional violando abiertamente los Arts. 9 (de la liberta y seguridad de las personas), 34 (de la inviolabilidad de los recintos privados), 44 (de los tributos), 46 (de la igualdad), 108 (de la libre circulación de los productos), 110 (de los derechos de autor y propiedad intelectual) y 179 (de la creación de tributos) de la Constitución Nacional.

Sostienen entre los defectos de forma, que el citado Decreto, a través de una supuesta reglamentación crea solapadamente un impuesto o tributo aduanero del 0,50% a ser destinado a una Sociedad de Gestión Colectiva, lo que configura un atentado contra el orden constitucional y una desfiguración de la facultad constitucional conferida al Poder Ejecutivo. Afirma que todo tributo, en este caso aduanero, solo puede ser establecido por ley; por tanto al crearse un nuevo impuesto por un Decreto es inconstitucional.
