El Juzgado Noveno de Circuito de lo Civil, del Primer Distrito Judicial de Panamá, dentro del Proceso DE DERECHO DE AUTOR propuesto por el señor ILDEFONSO MARÍN ALVARADO en contra de SERVMOR REALTY, S.A., mediante la Sentencia N°65-24 de 28 de junio de 2024, decidió  NO RECONOCER la excepción por falta de legitimidad, propuesta por el demandado SERVMOR REALTY, S.A., CONDENAR a SERVMOR REALTY, S.A. por violación de los derechos morales y patrimoniales de ILDEFONSO MARÍN ALVARADO, por modificar y cometer actos de comunicación al público, en relación con la puesta a disposición del público no autorizada de la obra fotográfica de su autoría, titulada “BAHÍA DE PANAMÁ” y CONDENAR a SERVMOR REALTY, S.A., al pago de DOS MIL BALBOAS (B/.2,000.00),  en concepto de multa. 

 

El Tercer Tribunal Superior del Primer Distrito Judicial de Panamá, al conocer el Recurso de Apelación decidió MODIFICAR la Sentencia No.65-24 de 28 de junio de 2024, proferida por el Juzgado Noveno de Circuito, Ramo de lo Civil del Primer Circuito Judicial, en el sentido de que NIEGA las pretensiones de la demandante dentro de la causa judicial y SE CONFIRMA que NO RECONOCE la EXCEPCIÓN DE FALTA DE LEGITIMACIÓN ACTIVA.
