The Secretary-General of the International Union for the Protection of New Varieties of Plants (UPOV) presents his compliments to the Minister for Foreign Affairs and has the honor to inform him of the deposit by the Government of the United States of America, on January 22, 1999, of its instrument of ratification of the International Convention for the Protection of New Varieties of Plants of December 2, 1961, as revised at Geneva on November 10, 1972, on October 23, 1978, and on March 19, 1991 (the 1991 Act).
The instrument was accompanied by the following reservation: "Pursuant to Article 35(2), the United States will continue to provide protection for asexually reproduced varieties by an industrial property title other than a breeder's right and will not, therefore, apply the terms of this Convention to those varieties."
The said Convention will enter into force, with respect to the United States of America, on February 22, 1999.
