DECIDES: 1. The Regulations on the Activity of the Authorized Intellectual Property Attorneys is

REGULATIONS on the Activity of the Authorized Intellectual Property Attorneys
I. GENERAL PROVISIONS
1. The Regulations on the Activity of the Authorized Intellectual Property Attorneys (hereinafter referred to as “the Regulations”) regulates the professional activity of the authorized intellectual property attorneys (hereinafter referred to as “the authorized attorneys), in accordance with the legislation on the protection of intellectual property and other normative acts, and with the provisions of the international treaties to which the Republic of Moldova is a party.
2. The provisions of the present Regulations shall extend to: 1) authorized attorneys; 2) applicants to obtain certificates of authorized attorney; 3) the Commission for Attestation and Discipline of Authorized Intellectual Property
Attorneys (hereinafter referred to as “the Attestation Commission”), established within the State Agency on Intellectual Property (hereinafter referred to as “AGEPI”). [Item 2 amended by Gov. Dec. No.1157 of 18/10/2016, in force from 25/10/2016]
3. For the purposes of the present Regulations, the principal terms used shall mean the following:
attestation – the procedure for assessing the level and quality of professional training in the field of intellectual property, through which the AGEPI officially recognizes the competence of the candidate;
certificate – authorization issued by AGEPI confirming the capacity of the person to act as an authorized attorney for all or some of the intellectual property objects;
authorized attorney – a natural person attested and registered in the National Register of Authorized Intellectual Property Attorneys (hereinafter referred to as “the Register”), representing the interests of natural and legal persons and providing them with the necessary assistance in the field of the protection of intellectual property.
4. The authorized attorneys’ activity consists in the representation of the natural and legal persons under the terms of the mandate contract or of another contract with analogous content (hereinafter referred to as “the contract”) and/or the power of representation (hereinafter referred to as “the power of attorney”) and the provision thereof with the necessary assistance in the field of intellectual property (trademarks, inventions, industrial designs, plant varieties, topographies of integrated circuits, appellations of origin, geographical indications, traditional specialties guaranteed).
II. ACQUISITION OF THE CAPACITY OF AUTHORIZED ATTORNEY
5. A person who fulfills the following conditions may acquire the capacity of authorized attorney:
1) is a citizen of the Republic of Moldova; 2) has permanent domicile in the Republic of Moldova; 3) has a higher education bachelor’s degree; in the case of a person applying for the
capacity of authorized attorney for the category specified in item 7 sub-item 1) of this Regulations, technical studies are required, and for the category specified in sub-item 6) in the same item – biological or agricultural studies;
4) has a practice of at least 3 years in the field of intellectual property or has higher education in this field or of counselor in intellectual property;
5) is not an employee of AGEPI at the time of requesting the capacity of authorized attorney;
6) knows the state language; 7) has full exercise capacity; 8) has passed the examination in front of the Attestation Commission of AGEPI. [Item 5 amended by Gov. Dec. No.1157 of 18/10/2016, in force from 25/10/2016]
6. Intellectual property specialists who have activated as AGEPI employees for at least 3 years and the teaching staff who have taught the subject of intellectual property protection in higher education institutions for at least 3 years may acquire the capacity of authorized attorney without passing the examination for the field of the intellectual property in which they have activated, and without paying the attestation fee, for the registration and issuance of the certificate.

7. The capacity of authorized attorney may be acquired for the following intellectual property objects:
1) inventions; 2) trademarks; (3) geographical indications, appellations of origin and traditional specialties guaranteed; 4) industrial designs; 5) topographies of integrated circuits; 6) plant varieties. 8. In order to be admitted to the certificate obtaining and attestation examination, the
applicant shall file with the AGEPI the application made on a standard form approved by AGEPI, with the annexation of the following documents:
1) the standard questionnaire approved by AGEPI; 2) the copy of the identity card; 3) a copy of the diploma on the respective studies; 4) a copy of the service record or other documents justifying the length of service; 5) a copy of the payment order for payment of the attestation, certificate registration and
issuance fee. 9. In the event of occurrence of any uncertainty or doubt as to the truthfulness of the
information submitted in accordance with the copies of the acts specified in item 8 of the present Regulations, the secretary of the Attestation Commission may request the presentation of these documents in their original form.
III. ATTESTATION PROCESS
10. Attestation of applicants to obtain certificates of authorized attorney is carried out by the Attestation Commission, which is formed of at least 5 persons and whose composition is approved by the order of the AGEPI Director General. The Attestation Commission is made up of the chairman, members (high qualified specialists in intellectual property working in the AGEPI for at least 3 years), secretary, and a representative of the professional association of authorized attorneys with the largest number of members. The members of the Attestation Commission are appointed indefinitely.
The attributions of the chairman of the Attestation Commission are exercised by the Director General or by the Deputy Director General of AGEPI.

11. The Attestation Commission has the following tasks: 1) examines the documents submitted according to the provisions of item 8 of the present
Regulations and decides the admission of the applicants for the attestation examination in order to obtain the certificate;
2) decides on attributing the capacity of authorized attorney without taking the attestation examination to the persons referred to in item 6 of this Regulations;
3) elaborates the subjects for the attestation examination; 4) checks the identity of the candidates according to the identity card; 5) analyzes and registers in the minutes any referral regarding the organization and
conduct of the attestation examination; 6) checks and evaluates the results of the attestation examination; 7) decides on granting (not granting) the certificates; 8) monitors the activity of authorized intellectual property attorneys, including examines
the information accumulated in the AGEPI databases on the activity of authorized attorneys; 9) decides to establish the limits of the activity of authorized attorneys on the basis of the
statistical information held by the AGEPI according to item 35 of this Regulations; 10) performs other duties in accordance with the law. [Item 11 amended by Gov. Dec. No.714 of 18/07/2018, in force from 27/07/2018]
12. Chairman of the Attestation Commission: 1) approves the list of candidates admitted to the attestation examination; 2) ensures that all sets of grid tests for the attestation examination are prepared and
maintained; 3) organizes the conduct of the attestation examination; 4) chairs the meetings of the Attestation Commission; 5) explains how to encode works; 6) organizes the verification of the works and the evaluation of the results of the
attestation examination; 7) signs the standard forms for answers; 8) submits to the AGEPI Director General the certificate for signing. 13. Secretary of the Attestation Commission: 1) receives the applications submitted in support of the attestation examination and for
obtaining the certificate; 2) checks and informs the applicant about the completeness and the compliance of
documents submitted with the requirements of this Regulations; 3) draws up the list of candidates admitted to the attestation examination; 4) draws up the personal file for each candidate; 5) distributes and collects the examination grids and standard forms for answers; 6) draws up the minutes of the meetings of the Attestation Commission; 7) ensures the keeping of the Registry of records of minutes on the results of the
attestation examinations; 8) ensures the drawing up of the certificates and verifies their accuracy; 9) hands over the qualification certificates;
10) transmits at the end of the year the minutes of the meetings of the Attestation Commission to the AGEPI archive;
11) is responsible for ensuring the full record of the documents related to the attestation/monitoring of the activity of the authorized attorneys, as well as for their transmission to the AGEPI archive.
14. The Attestation Commission is responsible for the prevention of fraudulent practices of the attestation examination, provided and sanctioned in accordance with item 21 of the present Regulations.

15. The quorum required to hold meetings of the Attestation Commission shall be at least 2/3 of its members.
The decisions of the Attestation Commission shall be adopted by a majority of the votes of the total number of members of the Attestation Commission.
16. Meetings of the Attestation Commission shall be convened on the basis of the applications submitted for the obtaining of the capacity of authorized attorney, the notifications regarding the activity of the authorized attorneys, as well as for the evaluation of their activity, according to statistical information held by AGEPI pursuant to item 35 of the present Regulations.

17. To the attestation examination shall be admitted the applicants who have presented all the necessary documents and meet the requirements set out in this Regulations. In case of subsequent detection of non-authentic data in the documents submitted for attestation or of presentation of false documents, the Attestation Commission will cancel the decision on the results of the attestation.
18. The conditions for organizing, promoting and evaluating the attestation examination are set out in instructions approved by the order of the Director General of AGEPI.
19. Attestation examinations are taken in writing. The subjects for the examination are elaborated by the members of the Attestation Commission and approved by the order of the General Director of AGEPI. The subjects for the attestation examination are placed on the AGEPI website (www.agepi.gov.md), at least 30 days before the attestation date.

20. For the purpose of legitimation, the candidate must present an identity card. Persons without an identity card or who are late shall be considered absent and transferred to the list for the subsequent examination.
21. The fraud attestation examination practices shall be found by any member of the Attestation Commission and shall be sanctioned by the Chairman of the Attestation Commission by excluding the candidate from the examination. These frauds consist in the copying, the use of electronic devices capable of mediating the communication or consultation of data, substitution of the person or the work, as well as the commission of other actions in order to obtain the unwarranted promotion of the examination. If the committed actions exceed the competence of the Attestation Commission, it has the obligation to notify the competent bodies.
22. The verification of the works is performed only after the attestation examination has been completed by the members of the Attestation Commission.
23. The results of the attestation examination shall be announced within 3 working days from the date of its conduct.

24. The candidate may appeal the decision of the Attestation Commission by submitting the respective requests within 7 working days of the announcement of the results. Appeals must be argued.

25. The requests for appeals shall be registered by the secretary of the Attestation Commission in the Registry of records of minutes on the results of the attestation examinations.
26. The requests for appeals shall be examined by the Attestation Commission within 7 working days from the date of expiry of the deadline for submission of appeals. The Attestation Commission rechecks and notes the appealed evidence. The amendment of the appealed grade shall only be admissible if the grade given after the examination of the appeal is higher than the one initially obtained, otherwise the initially obtained grade is maintained, it being final.

27. The examination of appeals shall be registered in separate minutes, signed by the members of the Attestation Commission.
28. In the case of unsatisfactory results of the attestation examination, the attestation fee shall not be refunded. The repeated taking of the examination will be carried out after payment of fee.
29. The repeated taking of the attestation examination, in case of non-accumulation of the minimum points, shall be admitted in one of the following meetings of the Attestation Commission.
If the attestation examination has not been taken twice consecutively, the candidate may apply for admission to the attestation examination only after the expiry of the 1 year period.
IV. REGISTRATION OF AUTHORIZED ATTORNEYS 30. The data on the status attributed to authorized attorneys following the attestation shall
be entered in the Register and published in the Official Bulletin of Intellectual Property of the Republic of Moldova.

31. AGEPI shall keep the Registry in accordance with the legislation and normative acts on registry management.
32. An authorized attorney, entered in the Register, shall be issued a certificate in accordance with the model established by AGEPI, signed by the Chairman of the Attestation Commission and the Director General of AGEPI. The data on the status of the authorized attorney shall be registered in the certificate, according to the latest information entered in the Register.
33. If the certificate has been lost, destroyed or its data have been substantially modified, a duplicate with the payment of the prescribed fee, including the payment for the publication of the notice in this respect shall be issued at the request of the authorized attorney.
34. The authorized attorney is obliged to notify AGEPI of any change in his/her personal data entered in the Register.
V. MONITORING THE ACTIVITY OF THE AUTHORIZED ATTORNEYS BY AGEPI
35. The monitoring of the activity of the authorized attorneys shall be carried out through the statistical record of the information held by AGEPI on the number of applications for the registration of intellectual property objects, including those related to the management of intellectual property rights, made through the authorized attorneys. This information will include the applications filed both on behalf of foreign and national persons and will not include data that are not related to AGEPI’s activity.
36. Authorized attorneys, interested in placing the information regarding their activity on the AGEPI website, under the heading “Authorized Attorneys”, are entitled, upon request and against payment, to request the placement of a banner, developed by AGEPI according to the parameters of its website, with reference to the information provided to the public (electronic address, web page and/or photo, name and surname of the attorney (name of the legal entity), legal address, contact details, other relevant information that will not exceed the format of an A4 sheet).

37. The information on newly attested authorized attorneys will be placed on the AGEPI website for a period of 3 years of activity. After the expiry of this period, the monitoring of the activity of the authorized attorneys shall be carried out in accordance with the provisions of item 35 of the present Regulations.

VI. ACTIVITY OF THE AUTHORIZED ATTORNEYS
42. The authorized attorney shall exercise his/her activity within the limits of the intellectual property objects specified in item 7 of the present Regulations, in respect of which he/she has passed the attestation examination. An authorized attorney who partially holds this capacity under the certificate will be able to extend his/her activity to another/intellectual property object/objects provided he/she takes the attestation examination.

43. The authorized attorney may carry out his/her professional activity as an individual entrepreneur, without being considered a legal person or being considered a legal person for the provision of services in the field of intellectual property, and as an employee of an institution, organization or enterprise with any form of legal organization.
44. The authorized attorney having the status of an individual entrepreneurial shall carry out his/her activity on the basis of the contracts for provision of intellectual property services
concluded with the customers and/or on the basis of the power of attorney granted by the customers.
An authorized attorney who has engaged himself/herself to an enterprise, profiled on the provision of intellectual property services, shall activate on the basis of the contracts concluded by the enterprise and/or the powers of attorney granted by the customers.
An authorized attorney who has engaged himself/herself as a permanent or temporary worker to institutions, organizations or enterprises with other profiles shall act in accordance with his/her service obligations provided in the employment contract.
441. Authorized attorneys have the right to form professional associations or to join such associations.
In the case of registration of a professional association of authorized attorneys, within 10 days from registration, the management of the association will inform AGEPI about such fact, with the presentation of data on the name, the headquarters of the management body and the number of the members of the association.
In order to record and update the information on professional associations of authorized attorneys, the management of the association will quarterly submit to the AGEPI the information on the continuation of its activity and the number of its members.
The professional association of authorized attorneys with the largest number of members will participate in the professional training of authorized attorneys, in their attestation and sanction in common with the Attestation Commission.

45. The authorized attorneys shall exercise their duties in compliance with the Code of Ethics and Conduct of Authorized Intellectual Property Attorneys, in accordance with the Annex to the present Regulations.
In courts, in order to defend the rights and interests of the customer, the authorized attorney may avail himself/herself, in accordance with his/her mandate, of a lawyer or legal advisor.

451. The authorized attorney who has breached the obligations laid down in the contract or the norms of the Code of Ethics and Conduct of Authorized Intellectual Property Attorneys shall be liable under the law.

46. Attestation, registration in the Register, issuance of the certificate or duplicate, operation of the changes in the Register and advanced training of the authorized attorneys shall be performed for payment in accordance with the legislation in the field of protection of intellectual property.
Annex to the Regulations on

CODE of Ethics and Conduct for Authorized Intellectual Property Attorneys
Chapter I GENERAL PROVISIONS
1. The Code of Ethics and Conduct for Authorized Intellectual Property Attorneys (hereinafter referred to as “the Code”) regulates the fundamental principles and rules of professional conduct mandatory for the authorized intellectual property attorney (hereinafter referred to as “the authorized attorney”) both in relations with customers, with national and international authorities, with non-governmental organizations, and with other authorized attorneys.
2. The authorized attorney is the natural person attested by the Commission for Attestation and Discipline of Authorized Intellectual Property Attorneys of the State Agency on Intellectual Property (hereinafter referred to as “AGEPI”) and registered in the National Register of Authorized Intellectual Property Attorneys, who represents the interests of natural and legal persons and provides them with the necessary assistance in the field of protection of intellectual property objects.
3. The norms of this Code are intended to secure the fulfilment of the professional commitment of an authorized attorney. Failure by the authorized attorney to comply with these norms shall entail liability under the law.
4. The authorized attorney must know and strictly abide by this Code, being also responsible for the observance and application of the principles of this Code by its employees and collaborators.
5. In the exercise of his/her profession, the authorized attorney has the duty to protect his/her customers against situations in which their rights are not respected and to provide them with the necessary assistance in the process of understanding the legal provisions, avoiding conflicts and resolving them.
Chapter II PRINCIPLES OF CONDUCT
Section 1 Independence
6. The authorized attorney must enjoy professional independence in his/her activity in such a way as to avoid any dependence which may prejudice the interests of his/her customer.
7. The authorized attorney must be free of any influence that might result from his/her own interests or those of third parties in relation to the commitment undertaken.
8. The professional probity shall be inclusively secured by ignoring any requests from the customer that are likely to prejudice the commitment of the authorized attorney and the rules for its realization.
9. The authorized attorney cannot accept a commitment when, due to other obligations, it is impossible to fulfil this commitment promptly or to consult the customer correctly.
Section 2 Moral Integrity and Trust
10. The authorized attorney must demonstrate honesty, probity, fairness, correctness, sincerity and confidentiality in the relationship with his/her customer, characteristics that motivate the customer’s decision to engage him/her.
11. Moral integrity consists in the behavior of the authorized attorney in such a way as not to prejudice the characteristics referred to in item 10 both in the exercise of the profession and outside of it.
12. The authorized attorney is required to abstain from assisting and consulting a customer in criminal activities.
Section 3 Professional Secret. Confidentiality
13. The authorized attorney is bound to keep the confidentiality of any data, including personal data, and information that becomes known to him/her directly or indirectly from his/her customer, whether directly linked to or not by the assumed commitment. He/she cannot disclose this information both during the commitment and after its termination, except with the express consent of his/her customer.
14. The right and obligation to maintain confidentiality apply to all information acquired during the exercise of the profession and will have to be respected even after the settlement of the commitment, except in cases expressly provided for by law.
15. The authorized attorney cannot pass on to any third party any document received from his/her customer, such as documents, printed or electronic files, samples and models, without the consent of the customer.
16. The obligation of confidentiality implies an active role of the authorized attorney in ensuring that such confidentiality is preserved, including by the persons he or she employs in order to fulfil a particular commitment or to carry out his/her professional activity in general.
17. Among the customers represented jointly, the confidentiality rule does not apply unless the parties decide otherwise.
Section 4 Competence
18. The authorized attorney carries out the activity entrusted to him/her on the basis of his/her professional competence.
19. The authorized attorney is not entitled to accept a commitment if he/she is certain that he/she does not have the necessary competence to deal with the matter, unless he/she cooperates with another authorized attorney or other specialist with that competence.
Section 5 Conflict of Interests
20. The authorized attorney is not entitled to participate in a particular commitment if he/she has already counseled or has already represented another party in the same case with conflicting interests, or has been involved professionally or otherwise in this case, which could prejudice the customer’s interest. In this case, the authorized attorney is obliged to notify the customer as soon as the circumstance becomes known to him/her.
21. The authorized attorney will abstain from dealing with the cases of all the customers involved in the commitment for which he was engaged when a conflict of interests arises, when
the professional secret runs the risk of being violated or when his/her independence takes the risk of casting doubt on it.
22. The authorized attorney cannot accept a case of a new customer when the secret of the information entrusted by an old customer runs the risk of being violated or when the customer’s knowledge of the old customer’s cases favors the new customer unjustifiably.
Section 6 Incompatibilities
23. The authorized attorney may carry out his/her professional activity as an individual entrepreneur without being considered a legal entity or being considered a legal entity for the provision of intellectual property services and as an employee of an institution, organizations or enterprises with any form of legal organization.
24. The authorized attorney may not act as such on grounds of incompatibility established under the law, such as the status of an employee of AGEPI or the exercise of a public function.
Section 7 Advertising of the Authorized Attorney’s Activity
25. The authorized attorney may promote his/her professional activity, subject to the compliance with the provisions of Section 3 of this Chapter relating to professional secret, providing concrete information on the exercise of his/her profession and carrying out his/her activity with dignity and prudence. It is in particular allowed to mention the core activities, the special experience acquired in the professional environment in which he/she activates and the qualifications formally obtained.
26. In all promotional and advertising actions, regardless of their material support, including the Internet, the authorized attorney must ensure that all the elements of identification of the form of exercise of the profession in which he/she activates, according to the forms of organization of the profession established by law, are presented in a correct and complete manner so that the public is aware of all the details of the person or persons providing the respective services and there is no confusion in relation to other attorneys as well as in relation to other institutions or organizations.
27. References to files and customers are only allowed if the customer has previously expressed expressly his/her consent in this respect, except that reference(s) is (are) only related to the information available to the public.
28. Advertising and promotion must not contain any allegations that may affect the status and dignity of the profession of authorized attorney or any other free profession.
29. Regardless of the means of advertising used, all laudatory or comparative mentions with other authorized attorneys are forbidden.
Chapter III CUSTOMER RELATIONSHIP
Section 1 Commitment and Acceptance of Commitment
30. The authorized attorney is free to accept or not a particular commitment offered by the customer. This commitment must be in written form.
31. Unless otherwise agreed by the parties, this commitment may be in the form of an exchange of messages, whether written or electronic. From this communication must unequivocally result the understanding of the terms of the commitment by the customer and acceptance of the commitment by the authorized attorney.
32. The authorized attorney and the customer agree on the content of the commitment, in particular on the extent of the obligation of assistance to be borne by the authorized attorney, the fee he will receive, the necessary conditions of payment and other reasonable and necessary expenses.
Section 2 Fixing the Honorarium
33. The authorized attorney and the customer are fully free to establish the honorarium to be paid.
34. The authorized attorney informs the customer of the honorarium/honoraria and its/their structure, and the total amount of honoraria must be fair and justified.
35. The authorized attorney shall provide the customer, upon request, with details of the actions undertaken or to be undertaken in relation to the fixed honorarium.
36. When the customer fails to pay the debts related to the honoraria and expenses, the authorized attorney has the right to renounce the commitment and to withdraw, respecting a reasonable possibility of the customer to independently deal with his/her own case.
37. The authorized attorney may not offset the debts he/she claims from the customer at the expense of the funds entrusted to him to discharge the specific commitment, except with the agreement of his/her customer.
Section 3 Interaction with the Customer
38. The authorized attorney acts only when he/she is empowered by his/her customer, based on the commitment made by the customer and accepted by the attorney. Relationship with the customer must be official.
39. The authorized attorney shall consult the customer conscientiously and shall inform him diligently of the progress of the commitment he/she has accepted.
40. If the authorized attorney is unable to carry out his/her duties, he/she must ensure that the customer in question is in a position to independently deal with his/her case or may in due time contract another person to provide him/her with the necessary assistance to avoid causing damage to the customer.
41. Even if the customer’s interest is paramount, the authorized attorney will not subordinate his/her personal and professional integrity to his/her customer.
42. The authorized attorney is not entitled to accept an unlawful proposal. 43. The authorized attorney cannot guarantee a certain result of the assumed
commitment; no matter how foreseeable it is, especially when the result depends on the decision of the AGEPI, the court, another public authority or a third party.
Section 4 Dossier of the Commitment Received
44. For each commitment entrusted, the authorized attorney must keep a dossier that gives a clear picture of the activity he/she has carried out.
45. The authorized attorney may keep the dossier in electronic format, provided that the original individual copies are not required to be kept. The authorized attorney also has the right to convert in part or in total a dossier from non-electronic format into electronic format, by making electronic copies and by destroying the copies kept on paper, provided that the legal provisions do not contradict this procedure.
46. At the customer’s request, the authorized attorney shall provide copies or extracts from the commitment dossier without incurring any additional charge that exceeds his/her own costs/expenses.
47. Upon completion of the commitment, the customer may ask the authorized attorney for a copy of the dossier that the attorney provides, except for those data, information, drawings, notes that are not directly related to the appropriate commitment or whose provision is prohibited by the obligation/obligations of the professional secret.
Section 5 Waiver of Commitment
48. The authorized attorney may not relinquish a file unjustifiably before the deadline if there are no reasonable reasons for doing so. However, for reasonable reasons, the authorized attorney is entitled to waive his/her commitment at any time, provided that a reasonable period of notice is observed, so that the customer may independently deal with his/her own case or may engage another authorized attorney.
49. In this case, the authorized attorney shall undertake any action that is urgent and decisive for the case of his/her customer, without making unreasonable, in some way, this behavior.
50. This obligation of maximum prudence in the event of waiving the commitment entrusted does not apply if the waiver is caused by the customer’s fault or if the customer agrees to take all future actions on his behalf.
Chapter IV INTERACTION WITH OTHER AUTHORIZED ATTORNEYS.
COLLEGIALITY 51. Collegiality requires trust-based relationships, in the customer’s interest, to avoid
unnecessary processes and any behavior likely to affect the reputation of the profession. 52. In no case will collegiality be the basis for the unreasonable contradiction with the
interests of the customers. Between them, authorized attorneys will exhibit collective and respectful behavior.
53. An authorized attorney shall not refer to another authorized attorney in improper or offensive terms.
54. Professional competition must be fair. When ordering, as well as in any other form of promotion, including on the Internet, the authorized attorney will abstain from making misleading or self-deceiving statements and/or by direct criticism or allusion to the work and quality of the work of other attorneys.
55. The authorized attorney shall not exercise or favor discrimination against other authorized attorneys on grounds of age, gender, religion, political option, social affiliation, etc. If an authorized attorney intends to bring an action against another authorized attorney in connection with the violation of these rules of conduct, he/she will first attempt to resolve the dispute through direct contact with the other attorney. In the event that no agreement can be
reached, the authorized attorney will continue to hand over the case to the Commission for Attestation and Discipline of the Authorized Intellectual Property Attorneys. Unless such mediation fails, the authorized attorney may bring legal action against the other attorney.
56. An authorized attorney may not enter into a direct relationship with a person in respect of a particular case when knowing that such person is represented or assisted by another authorized attorney, unless he/she has the consent of his/her colleague.
Chapter V INTERACTION WITH THE AGEPI,
THE COURTS AND OTHER AUTHORITIES 57. The authorized attorney is required to show respectful behavior towards the AGEPI,
the courts and any other authorities with which he/she interacts in the performance of his/her commitment.
58. An authorized attorney who presents himself/herself to the courts or who participates in a jurisdictional-administrative procedure must comply with the rules of conduct applicable to these procedures.
59. The obligation to comply with these rules does not limit the authorized attorneyto object to the actions of the authorities or to exercise other procedural rights.
60. The authorized attorney cannot knowingly provide obviously false data and information to the authorities with which he/she interacts in the discharge of his/her commitment.
61. The authorized attorney is not responsible for the truthfulness of the data and information provided by the customer. At the same time, the authorized attorney shall be obliged to notify the competent authorities if such data and information are likely to prejudice the legal provisions.”

1. Утвердить Положение о деятельности патентных поверенных в области интеллектуальной
собственности (прилагается).
2. Настоящее Постановление вступает в силу по истечении одного года со дня опубликования.

ПОЛОЖЕНИЕ
о деятельности патентных поверенных в области интеллектуальной собственности
I. Общие положения
1. Положение о деятельности патентных поверенных в области интеллектуальной собственности (в дальнейшем – Положение) регламентирует профессиональную деятельность патентных поверенных в области интеллектуальной собственности (в дальнейшем - патентные поверенные), осуществляемую ими в соответствии с законодательством в области интеллектуальной собственности и другими нормативными актами, а также положениями международных конвенций, стороной которых Республика Молдова является.
2. Действие настоящего положения распространяется на:
1) патентных поверенных;
2) заявителей на получение свидетельства патентного поверенного;
3) Аттестационно-дисциплинарную комиссию патентных поверенных в области интеллектуальной собственности Агентства (в дальнейшем – Аттестационная комиссия), созданную при Государственном агентстве по интеллектуальной собственности (в дальнейшем – AGEPI).

3. В настоящем Положении используемые основные понятия означают следующее:
аттестация – процедура оценки уровня и качества профессиональной подготовки в области интеллектуальной собственности, посредством которой AGEPI официально признает компетентность кандидата;
свидетельство – авторизация, выданная AGEPI, подтверждающая правоспособность лица действовать в качестве патентного поверенного для всех или части объектов интеллектуальной собственности;
патентный поверенный – физическое лицо, аттестованное и зарегистрированное в Национальном реестре патентных поверенных в области интеллектуальной собственности (в дальнейшем – Реестр), которое представляет интересы физических и юридических лиц и оказывает им необходимую помощь в области охраны объектов интеллектуальной собственности.
4. Деятельность патентных поверенных заключается в представлении физических и юридических лиц на условиях, предусмотренных договором поручения или другим договором аналогичного содержания (в дальнейшем – договор) и/или доверенностью на представление (в дальнейшем - доверенность), и в оказании им необходимой помощи в области охраны объектов интеллектуальной собственности (товарных знаков, изобретений, промышленных рисунков и моделей, сортов растений, топографий интегральных схем, наименований мест происхождения, географических указаний, гарантированных традиционных продуктов).
II. Приобретение статуса патентного поверенного
5. Статус патентного поверенного может получить лицо, отвечающее следующим требованиям:
1) является гражданином Республики Молдова;
2) имеет постоянное местожительство в Республике Молдова;
3) является обладателем диплома о высшем лицензионном образовании; для лица, ходатайствующего о статусе патентного поверенного по категории, указанной в подпункте 1) пункта 7 настоящего Положения, необходимо техническое образование, а для категории, указанной в подпункте 6) того же пункта, – биологическое или сельскохозяйственное образование;
4) имеет не менее трех лет стажа работы в области интеллектуальной собственности или высшее образование в данной области, либо советником в области интеллектуальной собственности;
5) не является работником AGEPI на момент ходатайства о статусе патентного поверенного;
6) владеет государственным языком;
7) полностью дееспособен;
8) сдал экзамен Аттестационной комиссии в составе AGEPI.

6. Специалисты в области интеллектуальной собственности, проработавшие в качестве работников AGEPI не менее трех лет, и педагогические кадры, преподававшие предмет по охране интеллектуальной собственности в высших учебных заведениях не менее трех лет, могут приобрести статус патентного поверенного без сдачи экзамена в области интеллектуальной собственности, в которой они осуществляли свою деятельность, а также без оплаты таксы за
аттестацию, регистрацию и выдачу свидетельства.

7. Статус патентного поверенного может быть получен по следующим объектам интеллектуальной собственности:
1) изобретения;
2) товарные знаки;
3) географические указания, наименования мест происхождения, гарантированные традиционные продукты;
4) промышленные рисунки и модели;
5) топографии интегральных схем;
6) сорта растений.
8. Для допуска к сдаче аттестационного экзамена и получения свидетельства заявитель должен подать в AGEPI заявку, заполненную на типовом бланке, утвержденном AGEPI, прилагая следующие документы:
1) типовую анкету, утвержденную AGEPI;
2) копию удостоверения личности;
3) копию диплома о соответствующем образовании;
4) копию трудовой книжки или иных документов, подтверждающих трудовой стаж;
5) копию платежного поручения о внесении платы за аттестацию, регистрацию и выдачу свидетельства.
9. В случае возникновения неясностей или сомнений относительно достоверности информации, представленной согласно копиям документов, указанных в пункте 8 настоящего Положения, секретарь Аттестационной комиссии может потребовать предоставления оригиналов данных документов.
III. Процесс аттестации
10. Аттестация заявителей для получения свидетельства патентного поверенного проводится Аттестационной комиссией, сформированной из не менее пяти человек, состав которой утверждается приказом генерального директора AGEPI. Аттестационная комиссия состоит из председателя, членов (высококвалифицированные специалисты в области интеллектуальной собственности, работающие в AGEPI не менее трех лет), секретаря, а также одного представителя профессиональной ассоциации патентных поверенных, которая имеет наибольшее число участников. Члены Аттестационной комиссии назначаются на неопределенный срок.
Функции председателя Аттестационной комиссии исполняются генеральным директором или заместителем генерального директора AGEPI.

11. Аттестационная комиссия имеет следующие обязанности:
1) рассматривает документы, предоставленные в соответствии с пунктом 10 настоящего Положения, и принимает решения о допуске заявителей к сдаче аттестационного экзамена для получения свидетельства;
2) принимает решения о присвоении статуса патентного поверенного без сдачи аттестационного экзамена лицам, указанным в пункте 6 настоящего Положения;
3) разрабатывает темы для аттестационного экзамена;
4) проверяет личность кандидатов согласно удостоверениям личности;
5) анализирует и вносит в протокол любые замечания, касающиеся организации и проведения аттестационного экзамена;
6) проверяет и оценивает результаты аттестационного экзамена;
7) принимает решения о выдаче (невыдаче) свидетельств;
8) осуществляет мониторинг деятельности патентных поверенных в области интеллектуальной собственности, в том числе рассматривает накопленную в базах данных AGEPI информацию о деятельности патентных поверенных, осуществленной в течение пятилетнего периода, и принимает решения о исключении из реестра тех патентных поверенных, о деятельности которых в течение вышеуказанного периода в AGEPI не зарегистрирована какая-либо статистическая информация, согласно пункту 35 настоящего Положения;
9) принимает решение об установлении ограничений на деятельность патентных поверенных на основании статистической информации, которой располагает AGEPI, согласно пункту 35 настоящего Положения;
10) исполняет другие обязанности в соответствии с законодательством.
12. Председатель Аттестационной комиссии:
1) утверждает список кандидатов, допущенных к аттестационному экзамену;
2) обеспечивает создание и хранение всех наборов тестов множественного выбора для аттестационного экзамена;
3) организует аттестационный экзамен;
4) председательствует на заседаниях Аттестационной комиссии;
5) объясняет способ шифрования работ;
6) организует проверку и оценку результатов аттестационного экзамена;
7) подписывает типовые бланки для ответов;
8) представляет свидетельства на подпись генеральному директору AGEPI.
13. Секретарь Аттестационной комиссии:
1) принимает поданные заявки на сдачу аттестационного экзамена и получение свидетельства;
2) проверяет и информирует заявителя о полноте поданных документов и их соответствии требованиям настоящего Положения;
3) подготавливает список кандидатов, допущенных к аттестационному экзамену;
4) подготавливает личное дело каждого кандидата;
5) распространяет и собирает экзаменационные листы и типовые бланки для ответов;
6) подготавливает протокол заседания Аттестационной комиссии;
7) обеспечивает ведение учетного реестра протоколов о результатах аттестационных экзаменов;
8) обеспечивает подготовку свидетельств и проверяет их точность;
9) вручает квалификационные свидетельства;
10) к концу года передает протоколы заседаний Аттестационной комиссии в архив AGEPI;
11) несет ответственность за обеспечение полного учета документов, относящихся к аттестации/мониторингу деятельности патентных поверенных, а также за их передачу в архив AGEPI.
14. Аттестационная комиссия несет ответственность за предотвращение и санкционирование правонарушений в ходе аттестационного экзамена путем подмены работы или личности экзаменуемых лиц, списывания во время экзамена, а также любой попытки склонения к нарушению.
15. Кворум, необходимый для проведения заседаний Аттестационной комиссии, должен составлять не менее 2/3 ее членов. Решения Аттестационной комиссии принимаются простым большинством голосов от числа присутствующих членов и заносятся в протокол.
16. Заседания аттестационной комиссии созываются в зависимости от заявок, поданных для получения статуса патентного поверенного, обращений относительно деятельности патентных поверенных, а также после пятилетнего периода, для оценки их деятельности согласно статистической информации, которой располагает AGEPI, на основании пункта 35 настоящего Положения.
17. К аттестационному экзамену допускаются заявители, представившие все необходимые документы и отвечающие требованиям, установленным настоящим Положением. В случае последующего обнаружения недостоверных данных в документах, представленных для аттестации, либо фальшивых документов Аттестационная комиссия аннулирует решение о результатах аттестации.
18. Условия организации, продвижения и оценки аттестационного экзамена устанавливаются в инструкциях, утвержденных генеральным директором AGEPI.
19. Аттестационные экзамены проводятся в письменном виде. Темы экзамена разрабатываются членами Аттестационной комиссии и утверждаются приказом генерального директора AGEPI. Темы для аттестационного экзамена размещаются на веб-странице AGEPI (www.agepi.gov.md) по меньшей мере за 30 дней до дня проведения аттестации.

20. В целях узаконивания кандидат должен представить документ, удостоверяющий личность. Лица, не имеющие документ, удостоверяющий личность, или опоздавшие, считаются отсутствующими и переносятся в список для следующего экзамена.
21. Случаи нарушения в ходе аттестационного экзамена констатируются любым членом Аттестационной комиссии и санкционируются председателем комиссии путем отстранения кандидата от сдачи экзамена. Данные нарушения состоят из списывания, использования электронных средств, способных передавать сообщения или консультировать данные, подмены личности экзаменуемых лиц или работы, а также совершение других действий с целью необоснованного продвижения экзамена. Если совершенные деяния превышают полномочия Аттестационной комиссии, она обязана уведомить компетентные органы.
22. Проверка работ осуществляется после завершения аттестационного экзамена только членами Аттестационной комиссии.
23. Результаты аттестационного экзамена объявляются на следующий рабочий день после его проведения.
24. Кандидат вправе обжаловать решение Аттестационной комиссии путем подачи соответствующей заявки на имя ее председателя в течение 2 рабочих дней от дня объявления результатов. Обжалования должны быть обоснованными.
25. Заявки на обжалование регистрируются секретарем Аттестационной комиссии в учетном реестре протоколов о результатах аттестационных экзаменов.
26. Заявки на обжалование рассматриваются Аттестационной комиссией на следующий день после истечения срока подачи обжалований. Аттестационная комиссия перепроверяет и оценивает обжалованные экзамены. Изменение обжалованной оценки допускается только в случае, если оценка, полученная после рассмотрения обжалования, выше оценки, полученной изначально. В противном случае сохраняется изначальная оценка, которая является окончательной.
27. Рассмотрение обжалований вносится в отдельные протоколы, подписанные членами аттестационной комиссии.
28. В случае неудовлетворительных результатов аттестационного экзамена, плата за аттестацию не возвращается. Повторная сдача экзамена состоится после внесения платы.
29. Повторная сдача аттестационного экзамена в случае недостаточного минимального балла допускается в ходе одного из следующих заседаний аттестационной комиссии.
Если аттестационный экзамен не был сдан два раза подряд, кандидат может запросить свое включение в списки кандидатов для сдачи аттестационного экзамена только по истечении одного года.
IV. Регистрация патентных поверенных
30. Данные о статусе, присвоенном патентным поверенным в результате аттестации, вносятся в Реестр и публикуются в Официальном бюллетене интеллектуальной собственности Республики Молдова.

31. Ведение реестра осуществляется AGEPI в соответствии с законодательными и другими нормативными актами о ведении реестров.
32. Патентному поверенному, включенному в реестр, выдается свидетельство согласно образцу, установленному AGEPI, подписанное председателем Аттестационной комиссии и генеральным директором AGEPI. В свидетельство вносятся данные о статусе патентного поверенного согласно последней информации, внесенной в Реестр.
33. При утере, уничтожении свидетельства или значительном изменении его данных по заявлению патентного поверенного выдается дубликат при условии внесения установленной платы, включая плату за публикацию сообщения об этом факте.
34. Патентный поверенный обязан известить AGEPI о любом изменении личных данных, внесенных в Реестр.
V. Мониторинг деятельности патентных поверенных, осуществляемый AGEPI
35. Мониторинг деятельности патентных поверенных будет проводиться путем статистического учета информации, которой располагает AGEPI, о числе заявок на регистрацию объектов интеллектуальной собственности, в том числе связанных с управлением правами интеллектуальной собственности, реализованных посредством патентных поверенных. Данная информация будет охватывать заявки, поданные от имени как национальных, так и иностранных лиц, и не будет включать данные, которые не имеют отношения к деятельности AGEPI.
36. Патентные поверенные, заинтересованные в размещении на сайте AGEPI в рубрике
«Патентные поверенные» информации о своей деятельности, имеют право при подаче заявки и оплате услуги ходатайствовать о размещении баннера, разработанного AGEPI по параметрам своего сайта, со ссылкой на предлагаемую для широкой публики информацию (электронный адрес, веб-страницу и/или фотографию, фамилию и имя поверенного (наименование юридического лица), юридический адрес, контактные данные, другую необходимую информацию в объеме, не превышающем размера страницы формата А4).

37. Информация о новых аттестованных патентных поверенных будет размещена на сайте AGEPI на трехлетний срок деятельности. По истечении этого срока мониторинг деятельности патентных поверенных будет осуществляться согласно пункту 35 настоящего Положения.
38. Что касается патентных поверенных, за исключением тех, кто приостановил свою
деятельность, информация о деятельности которых отсутствует полностью или только относительно одного объекта/нескольких/объектов интеллектуальной собственности в статистических данных, указанных в пункте 35 настоящего Положения, в течение 5 лет подряд, Аттестационная комиссия выносит решение об исключении из Реестра, а в случае ограничения их деятельности указывает объект/объекты интеллектуальной собственности, относительно которого/ которых патентный поверенный будет исключен из Реестра.
39. Решение об исключении из Реестра, указанное в пункте 38 настоящего Положения, может быть обжаловано в Комиссии по рассмотрению возражений AGEPI в течение 15 дней со дня его отправки AGEPI.
40. В случае патентных поверенных, деятельность которых была ограничена в соответствии с пунктом 38 настоящего Положения, AGEPI аннулирует принадлежащее им свидетельство и выдает новое свидетельство с указанием объекта/объектов интеллектуальной собственности, по которым патентный поверенный сможет осуществлять свою деятельность.
41. Лица, исключенные из Реестра на основании пункта 38 настоящего Положения, могут быть аттестованы повторно для получения статуса патентного поверенного в соответствии с положениями главы III настоящего Положения.
VI. Деятельность патентных поверенных
42. Патентный поверенный осуществляет свою деятельность в пределах объектов интеллектуальной собственности, указанных в пункте 7 настоящего Положения, в отношении которых он сдал аттестационный экзамен и не был исключен из Реестра в соответствии с пунктом
38 настоящего Положения. Патентный поверенный, частично обладающий этим статусом на основании свидетельства, сможет расширить свою деятельность относительно другого объекта/других объектов интеллектуальной собственности при условии сдачи аттестационного экзамена.
43. Патентный поверенный может осуществлять свою профессиональную деятельность как индивидуальный предприниматель, без статуса или со статусом юридического лица, по оказанию услуг в области интеллектуальной собственности, а также в качестве служащего учреждения, организации или предприятия любой организационно-правовой формы.
44. Патентный поверенный, имеющий статус индивидуального предпринимателя, осуществляет свою деятельность на основании договоров об оказании услуг в области интеллектуальной собственности, заключенных с клиентами, и/или доверенностей, выданных клиентами.
Патентный поверенный, нанятый на предприятие, оказывающее услуги в области интеллектуальной собственности, работает на основании договоров, заключенных предприятием, и/или доверенностей, выданных клиентами.
Патентный поверенный, нанятый на постоянную или временную работу в учреждения,
организации или предприятия с другим профилем, работает в соответствии со своими служебными обязанностями, предусмотренными трудовым договором.
441. Патентные поверенные имеют право создавать профессиональные ассоциации или
вступать в такие ассоциации.
При регистрации профессиональной ассоциации патентных поверенных руководство
ассоциации в течение 10 дней с момента регистрации должно проинформировать AGEPI об этом и представить сведения о наименовании, местонахождении руководящего органа и числе
участников ассоциации.
В целях учета и обновления информации о профессиональных ассоциациях патентных поверенных руководство ассоциации должно ежеквартально представлять AGEPI информацию о продолжении своей деятельности и о числе своих участников.
Профессиональная ассоциация патентных поверенных, которая имеет наибольшее число участников, совместно с Аттестационной комиссией принимает участие в профессиональной подготовке патентных поверенных, в их аттестации и определении в их отношении меры дисциплинарного взыскания.

45. Патентные поверенные выполняют свои обязанности на принципах добросовестности, честности, доверия и конфиденциальности.
В судебных инстанциях для защиты прав и интересов клиента патентный поверенный может привлечь, в соответствии со своими полномочиями, адвоката или юридического советника.
46. Аттестация, регистрация в реестре, выдача свидетельства или дубликата, внесение изменений в Реестр и повышение квалификации патентного поверенного оказываются за плату, в соответствии с законодательством в области интеллектуальной собственности.

(4) din Legea nr. 161-XVI din 12 iulie 2007 privind protecţia desenelor şi modelelor industriale (Monitorul Oficial al Republicii Moldova, 2007, nr. 136-140, art. 577), art. 29 alin. (3) din Legea nr. 38-XVI din 29 februarie 2008 privind protecţia mărcilor (Monitorul Oficial al Republicii Moldova, 2008, nr. 99-101, art. 362), art. 87 alin. 1. Se aprobă Regulamentul privind activitatea mandatarilor autorizaţi în proprietatea intelectuală (se anexează).
2. Prezenta Hotărîre intră în vigoare la 1 an de zile de la data publicării.

REGULAMENT
privind activitatea mandatarilor autorizaţi în proprietatea intelectuală
I. DISPOZIŢII GENERALE
1. Regulamentul privind activitatea mandatarilor autorizaţi în proprietatea intelectuală (în continuare – Regulament) reglementează activitatea profesională a mandatarilor autorizaţi în domeniul proprietăţii intelectuale (în continuare – mandatari autorizaţi), în conformitate cu legislaţia privind protecţia proprietăţii intelectuale şi alte acte normative, precum şi cu dispoziţiile tratatelor internaţionale la care Republica Moldova este parte.
2. Prevederile prezentului Regulament se extind asupra:
1) mandatarilor autorizaţi;
2) solicitanţilor de a obţine certificate de mandatar autorizat;
3) Comisiei de atestare şi disciplină a mandatarilor autorizaţi în domeniul proprietăţii intelectuale (în continuare – Comisia de atestare), instituită în cadrul Agenţiei de Stat pentru Proprietatea Intelectuală (în continuare – AGEPI).

3. În sensul prezentului Regulament, noţiunile principale utilizate semnifică următoarele:
atestare – procedura de evaluare a nivelului şi a calităţii pregătirii profesionale în domeniul proprietăţii intelectuale, prin care AGEPI recunoaşte oficial competenţa candidatului;
certificat – autorizaţie eliberată de AGEPI, prin care se confirmă capacitatea persoanei de a acţiona în
calitate de mandatar autorizat pentru toate sau pentru o parte dintre obiectele de proprietate intelectuală;
mandatar autorizat – persoană fizică atestată şi înregistrată în Registrul naţional al mandatarilor autorizaţi în proprietatea intelectuală (în continuare - Registru), care reprezintă interesele persoanelor fizice şi juridice şi le acordă asistenţa necesară în domeniul protecţiei obiectelor de proprietate intelectuală.
4. Activitatea mandatarilor autorizaţi constă în reprezentarea persoanelor fizice şi juridice în condiţiile
prevăzute de contractul de mandat sau de un alt contract cu un conţinut analogic (în continuare – contract) şi/sau de procura de reprezentare (în continuare – procură) şi în acordarea asistenţei necesare acestora în domeniul protecţiei obiectelor de proprietate intelectuală (mărci, invenţii, desene şi modele industriale, soiuri de plante, topografii de circuite integrate, denumiri de origine, indicaţii geografice, specialităţi tradiţionale garantate).
II. DOBÎNDIREA CALITĂŢII DE
MANDATAR AUTORIZAT
5. Poate dobîndi calitatea de mandatar autorizat persoana care îndeplineşte următoarele condiţii:
1) este cetăţean al Republicii Moldova;
2) are domiciliu permanent în Republica Moldova;
3) dispune de diplomă de studii superioare de licenţă; în cazul persoanei ce solicită obţinerea calităţii de mandatar autorizat pentru categoria specificată la pct. 7 subpunctul 1) din prezentul Regulament, sînt necesare studii tehnice, iar pentru categoria specificată la subpunctul 6) din acelaşi punct – studii biologice sau agricole;
4) are o practică de cel puţin 3 ani în domeniul proprietăţii intelectuale ori are studii superioare în acest
domeniu sau de consilier în domeniul proprietăţii intelectuale;
5) nu este angajat al AGEPI la momentul solicitării calităţii de mandatar autorizat;
6) cunoaşte limba de stat;
7) are capacitate de exerciţiu deplină;
8) a susţinut examenul în faţa Comisiei de atestare din cadrul AGEPI.

6. Specialiştii în domeniul proprietăţii intelectuale care au activat în calitate de angajaţi ai AGEPI cel puţin 3 ani şi cadrele didactice care au predat disciplina privind protecţia proprietăţii intelectuale în instituţiile de învăţămînt superior cel puţin 3 ani pot dobîndi calitatea de mandatar autorizat fără a susţine examenul pentru domeniul proprietăţii intelectuale în care au activat, precum şi fără achitarea taxei pentru atestare, pentru înregistrarea şi eliberarea certificatului.

7. Calitatea de mandatar autorizat poate fi dobîndită pentru următoarele obiecte de proprietate intelectuală:
1) invenţii;
2) mărci;
3) indicaţii geografice, denumiri de origine şi specialităţi tradiţionale garantate;
4) desene şi modele industriale;
5) topografii de circuite integrate;
6) soiuri de plante.
8. Pentru a fi admis la susţinerea examenului de atestare şi obţinerea certificatului, solicitantul va depune la AGEPI cererea întocmită pe un formular-tip aprobat de AGEPI, cu anexarea următoarelor acte:
1) chestionarul-tip aprobat de AGEPI;
2) copia actului de identitate;
3) copia diplomei privind studiile respective;
4) copia carnetului de muncă sau a altor documente ce justifică vechimea în muncă;
5) copia dispoziţiei de plată privind achitarea taxei pentru atestare, pentru înregistrarea şi eliberarea
certificatului.
9. În cazul apariţiei unor neclarităţi sau dubii privind veridicitatea informaţiilor prezentate conform copiilor actelor specificate la pct. 8 din prezentul Regulament, secretarul Comisiei de atestare poate solicita prezentarea actelor respective în original.
III. procesul de atestare
10. Atestarea solicitanţilor de a obţine certificate de mandatar autorizat se efectuează de către Comisia de atestare, care se formează din cel puţin 5 persoane şi a cărei componenţă se aprobă prin ordinul directorului general al AGEPI. Comisia de atestare este constituită din preşedinte, membri (specialişti de calificare înaltă în domeniul proprietăţii intelectuale care activează în AGEPI de cel puţin 3 ani), secretar,
precum şi un reprezentant al asociaţiei profesionale a mandatarilor autorizaţi care are cel mai mare număr de membri. Membrii Comisiei de atestare sînt numiţi pe un termen nedeterminat.
Atribuţiile preşedintelui Comisiei de atestare sînt exercitate de către directorul general sau de către
vicedirectorul general al AGEPI.

11. Comisia de atestare are următoarele atribuţii:
1) examinează documentele depuse conform prevederilor pct. 8 din prezentul Regulament şi decide admiterea solicitanţilor pentru susţinerea examenului de atestare în vederea obţinerea certificatului;
2) decide asupra atribuirii calităţii de mandatar autorizat fără susţinerea examenului de atestare
persoanelor menţionate la pct. 6 din prezentul Regulament;
3) elaborează subiectele pentru examenul de atestare;
4) verifică identitatea candidaţilor conform actului de identitate;
5) analizează şi consemnează în procesul-verbal orice sesizare cu privire la organizarea şi desfăşurarea examenului de atestare;
6) verifică şi evaluează rezultatele examenului de atestare;
7) decide asupra acordării (neacordării) certificatelor;
8) monitorizează activitatea mandatarilor autorizaţi în proprietatea intelectuală, inclusiv examinează informaţia acumulată în bazele de date ale AGEPI privind activitatea mandatarilor autorizaţi, acumulată în decurs de 5 ani, şi decide radierea din Registru a mandatarilor autorizaţi despre a căror activitate, în decursul perioadei menţionate, nu sînt înregistrate la AGEPI careva informaţii statistice conform pct. 35 din prezentul Regulament;
9) decide stabilirea limitelor activităţii mandatarilor autorizaţi în temeiul informaţiei statistice deţinute de
AGEPI conform pct. 35 din prezentul Regulament;
10) exercită alte atribuţii în conformitate cu legislaţia.
12. Preşedintele Comisiei de atestare:
1) aprobă lista candidaţilor admişi la examenul de atestare;
2) asigură întocmirea şi păstrarea tuturor seturilor testelor grilă pentru examenul de atestare;
3) organizează desfăşurarea examenului de atestare;
4) prezidează şedinţele Comisiei de atestare;
5) explică modul de codificare a lucrărilor;
6) organizează verificarea lucrărilor şi evaluarea rezultatelor examenului de atestare;
7) semnează formularele-tip pentru răspunsuri;
8) prezintă directorului general al AGEPI certificatul pentru semnare.
13. Secretarul Comisiei de atestare:
1) recepţionează cererile depuse pentru susţinerea examenului de atestare şi obţinerea certificatului;
2) verifică şi informează solicitantul despre plenitudinea şi corespunderea actelor depuse cu cerinţele
prezentului Regulament;
3) întocmeşte lista candidaţilor admişi la examenul de atestare;
4) întocmeşte dosarul personal pentru fiecare candidat;
5) distribuie şi colectează grilele de examen şi formularele-tip pentru răspunsuri;
6) întocmeşte procesul-verbal al şedinţei Comisiei de atestare;
7) asigură ţinerea Registrului de evidenţă a proceselor-verbale privind rezultatele examenelor de atestare;
8) asigură întocmirea certificatelor şi verifică corectitudinea acestora;
9) înmînează certificatele de calificare;
10) transmite la finele anului procesele-verbale ale şedinţelor Comisiei de atestare în arhiva AGEPI;
11) poartă răspundere pentru asigurarea evidenţei integrale a documentelor ce se referă la
atestarea/monitorizarea activităţii mandatarilor autorizaţi, precum şi pentru transmiterea acestora în arhiva AGEPI.
14. Comisia de atestare este responsabilă pentru prevenirea şi sancţionarea practicilor de fraudare a examenului de atestare, manifestate prin substituirea lucrărilor sau a identităţii persoanelor examinate, copiatul la examen, precum şi prin orice tentativă de corupere spre fraudă.
15. Cvorumul necesar pentru ţinerea şedinţelor Comisiei de atestare este de cel puţin 2/3 din membrii
ei.
Deciziile Comisiei de atestare se adoptă cu majoritatea de voturi din numărul total de membri ai
Comisiei de atestare.
16. Şedinţele Comisiei de atestare se convoacă în funcţie de cererile depuse în vederea obţinerii calităţii de mandatar autorizat, de sesizările privind activitatea mandatarilor autorizaţi, precum şi, la finele perioadei de 5 ani, în vederea evaluării activităţii acestora, conform informaţiei statistice deţinute de AGEPI în temeiul pct. 35 din prezentul Regulament.
17. La examenul de atestare se admit solicitanţii care au prezentat toate actele necesare şi corespund cerinţelor stabilite în prezentul Regulament. În cazul depistării ulterioare a datelor neautentice în documentele prezentate pentru atestare sau prezentării unor documente false, Comisia de atestare va anula hotărîrea privind rezultatele atestării.
18. Condiţiile privind organizarea, promovarea şi evaluarea examenului de atestare sînt stabilite în instrucţiuni aprobate prin ordinul directorului general al AGEPI.
19. Examenele de atestare se susţin în scris. Subiectele pentru examen sînt elaborate de către membrii Comisiei de atestare şi aprobate prin ordinul directorului general al AGEPI. Subiectele pentru examenul de atestare se plasează pe pagina-web a AGEPI (www.agepi.gov.md), cu cel puţin 30 de zile pînă la ziua desfăşurării atestării.

20. În scopul legitimării, candidatul trebuie să prezinte un act de identitate. Persoanele fără act de identitate sau care au întîrziat se consideră absente şi sînt transferate în lista pentru examenul ulterior.
21. Practicile de fraudare a examenului de atestare se constată de către orice membru al Comisiei de atestare şi se sancţionează de către preşedintele Comisiei de atestare prin excluderea candidatului de la susţinerea examenului. Aceste fraude constau în copiere, utilizarea unor dispozitive electronice capabile să intermedieze comunicarea sau consultarea de date, substituirea persoanei sau a lucrării, precum şi săvîrşirea altor acţiuni cu scopul de a obţine promovarea nejustificată a examenului. În cazul în care acţiunile săvîrşite depăşesc competenţa Comisiei de atestare, aceasta are obligaţia de a sesiza organele competente.
22. Verificarea lucrărilor se efectuează după finalizarea examenului de atestare doar de către membrii
Comisiei de atestare.
23. Rezultatele examenului de atestare se anunţă în ziua lucrătoare imediat următoare după desfăşurarea acestuia.
24. Candidatul poate contesta hotărîrea Comisiei de atestare prin depunerea cererii respective pe numele preşedintelui Comisiei de atestare în decurs de 2 zile lucrătoare din ziua anunţării rezultatelor. Contestaţiile trebuie să fie argumentate.
25. Cererile pentru contestaţii se înregistrează de către secretarul Comisiei de atestare în Registrul de evidenţă a proceselor-verbale privind rezultatele examenelor de atestare.
26. Cererile pentru contestaţii vor fi examinate de către Comisia de atestare în ziua imediat următoare după expirarea termenului de depunere a contestaţiilor. Comisia de atestare reverifică şi notează probele contestate. Modificarea notei contestate se admite doar în cazul în care nota acordată după examinarea contestaţiei este mai mare decît cea obţinută iniţial, în caz contrar nota obţinută iniţial se menţine,
aceasta fiind definitivă.
27. Examinarea contestaţiilor se consemnează în procese-verbale separate, semnate de către membrii
Comisiei de atestare.
28. În cazul rezultatelor nesatisfăcătoare ale examenului de atestare, plata pentru atestare nu se restituie. Susţinerea repetată a examenului se va efectua după achitarea taxei.
29. Susţinerea repetată a examenului de atestare, în caz de neacumulare a minimului de puncte, se admite în cadrul uneia dintre şedinţele următoare ale Comisiei de atestare.
În cazul în care examenul de atestare nu a fost susţinut de două ori consecutiv, candidatul poate solicita admiterea sa la susţinerea examenului de atestare doar după expirarea perioadei de 1 an.
IV. ÎNREGISTRAREA MANDATARILOR
AUTORIZAŢI
30. Datele despre statutul atribuit mandatarilor autorizaţi în urma atestării se înscriu în Registru şi se publică în Buletinul Oficial de Proprietate Intelectuală al Republicii Moldova.

31. AGEPI ţine Registrul în conformitate cu legislaţia şi actele normative privind gestiunea registrelor.
32. Mandatarului autorizat, înscris în Registru, i se eliberează un certificat conform modelului stabilit de AGEPI, semnat de preşedintele Comisiei de atestare şi de directorul general al AGEPI. În certificat se consemnează datele privind statutul mandatarului autorizat, conform ultimelor informaţii înscrise în Registru.
33. Dacă certificatul a fost pierdut, distrus sau datele acestuia au fost modificate esenţial, la cererea mandatarului autorizat, se eliberează un duplicat cu achitarea taxei stabilite, inclusiv a plăţii pentru publicarea anunţului în acest sens.
34. Mandatarul autorizat este obligat să anunţe AGEPI orice modificare a datelor sale personale
înscrise în Registru.
V. MONITORIZAREA ACTIVITĂŢII MANDATARILOR AUTORIZAŢI DE CĂTRE AGEPI
35. Monitorizarea activităţii mandatarilor autorizaţi se va efectua prin evidenţa statistică a informaţiei deţinute de către AGEPI privind numărul de cereri de înregistrare a obiectelor de proprietate intelectuală, inclusiv a celor ce ţin de gestionarea drepturilor de proprietate intelectuală, realizate prin intermediul mandatarilor autorizaţi. Informaţia menţionată va cuprinde cererile depuse atît în numele persoanelor străine, cît şi celor naţionale şi nu va include date ce nu ţin de activitatea AGEPI.
36. Mandatarii autorizaţi, interesaţi de plasarea pe site-ul AGEPI, la rubrica „Mandatari autorizaţi”, a informaţiei referitoare la activitatea lor, sînt în drept, la cerere şi contra plată, să solicite plasarea unui banner, elaborat de AGEPI conform parametrilor site-ului său, cu trimitere la informaţia oferită publicului (adresa electronică, pagina web şi/sau fotografia, numele şi prenumele mandatarului (denumirea persoanei juridice), adresa juridică, datele de contact, altă informaţie relevantă ce nu va depăşi formatul unei file A4).

37. Informaţia privind mandatarii autorizaţi noi atestaţi va fi plasată pe pagina web a AGEPI pentru o perioadă de 3 ani de activitate. După expirarea acestei perioade, monitorizarea activităţii mandatarilor autorizaţi se va efectua conform prevederilor pct. 35 din prezentul Regulament.
38. În ceea ce priveşte mandatarii autorizaţi, cu excepţia celor care şi-au suspendat
activitatea, informaţia despre activitatea cărora lipseşte, în totalitate sau doar referitor la un/unele obiect/obiecte de proprietate intelectuală, din statistica menţionată la pct. 35 din prezentul Regulament,
pe parcursul a 5 ani consecutivi, Comisia de atestare va emite o hotărîre de radiere din Registru, iar în cazul limitării activităţii acestuia, va specifica obiectul/obiectele de proprietate intelectuală în privinţa cărui/cărora mandatarul autorizat va fi radiat din Registru.
39. Hotărîrea de radiere din Registru, specificată la pct. 38 din prezentul Regulament, poate fi contestată la Comisia de Contestaţii a AGEPI, în termen de 15 zile de la data expedierii acesteia de către AGEPI.
40. În cazul mandatarilor autorizaţi, a căror activitate a fost limitată conform pct. 38 din prezentul Regulament, AGEPI va anula certificatul deţinut de aceştia şi va elibera un nou certificat, cu specificarea obiectului/obiectelor de proprietate intelectuală cu referinţă la care mandatarul autorizat îşi va putea exercita activitatea.
41. Persoanele radiate din Registru în temeiul pct. 38 din prezentul Regulament vor putea fi atestate repetat pentru a redobîndi calitatea de mandatar autorizat în conformitate cu prevederile capitolului III din prezentul Regulament.
VI. ACTIVITATEA MANDATARILOR
AUTORIZAŢI
42. Mandatarul autorizat îşi exercită activitatea în limita obiectelor de proprietate intelectuală, specificate la pct. 7 din prezentul Regulament, în privinţa cărora a susţinut examenul de atestare şi nu a fost radiat din Registru conform pct. 38 din prezentul Regulament. Mandatarul autorizat care deţine parţial această calitate în temeiul certificatului îşi va putea extinde activitatea referitor la alt/alte obiect/obiecte de proprietate intelectuală cu condiţia susţinerii examenului de atestare.
43. Mandatarul autorizat poate să-şi desfăşoare activitatea profesională ca întreprinzător individual, fără a se constitui ca persoană juridică sau constituindu-se ca persoană juridică pentru prestarea serviciilor în domeniul proprietăţii intelectuale, precum şi în calitate de salariat al unei instituţii, organizaţii sau întreprinderi cu orice formă de organizare juridică.
44. Mandatarul autorizat care are statut de întreprinzător individual îşi desfăşoară activitatea în baza contractelor privind prestarea serviciilor în domeniul proprietăţii intelectuale, încheiate cu clienţii, şi/sau în baza procurilor acordate de către clienţi.
Mandatarul autorizat care s-a angajat într-o întreprindere, profilată pe prestarea serviciilor în domeniul proprietăţii intelectuale, activează în baza contractelor încheiate de întreprindere şi/sau procurilor acordate de către clienţi.
Mandatarul autorizat care s-a angajat ca lucrător permanent sau temporar în instituţii, organizaţii ori întreprinderi cu alte profiluri activează conform obligaţiilor sale de serviciu prevăzute în contractul de muncă.
441. Mandatarii autorizaţi au dreptul să formeze asociaţii profesionale sau să adere la asemenea
asociaţii.
În caz de înregistrare a unei asociaţii profesionale a mandatarilor autorizaţi, în decurs de 10 zile de la momentul înregistrării, conducerea asociaţiei va informa AGEPI despre acest fapt, cu prezentarea datelor privind denumirea, sediul organului de conducere şi numărul membrilor asociaţiei.
În scopul evidenţei şi actualizării informaţiei privind asociaţiile profesionale ale mandatarilor autorizaţi, conducerea asociaţiei va prezenta semestrial AGEPI informaţia privind continuarea activităţii sale şi numărul membrilor săi.
Asociaţia profesională a mandatarilor autorizaţi care are cel mai mare număr de membri va participa la pregătirea profesională a mandatarilor autorizaţi, la atestarea şi sancţionarea acestora în comun cu Comisia de atestare.

45. Mandatarii autorizaţi îşi exercită atribuţiile conform principiilor bunei credinţe, onestităţii, încrederii şi confidenţialităţii.
În instanţele de judecată, pentru apărarea drepturilor şi intereselor clientului, mandatarul autorizat
poate beneficia, conform împuternicirii acestuia, de avocat sau de consilier juridic.
46. Atestarea, înregistrarea în Registru, eliberarea certificatului sau duplicatului, operarea modificărilor în Registru şi perfecţionarea mandatarilor autorizaţi se efectuează contra plată în conformitate cu legislaţia în domeniul protecţiei proprietăţii intelectuale.
