Interpretation.

AN ACT to amend the Trademarks Act, No. 1 of 2012.
[ 18th May, 2012 ].
BE IT ENACTED bythe Queen’s Most Excellent Majesty, by and with the advice and consent of the Senate and the House of Representatives and by the authority of the same as follows–
1. This Act may be cited as the–
TRADEMARKS (AMENDMENT) ACT, 2012.
2. In this Act–
“principal Act” means the Trademarks Act, No. 1 of 2012.

Amendment of section 2 of the principal Act.
3. The definition of the term “attorney-at-law” in section 2 of the principal Act is amended by deleting the words “Eastern Caribbean Supreme Court in Grenada” and substituting with the following words–
“Supreme Court of Grenada and the West Indies Associated States”.
Amendment of section 11 of the principal Act.
4. Section 11(1) of the principal Act is amended by deleting the words “section 5” and substituting with “section 6”.
Amendment of section 22 of the principal Act.
5. Section 22 of the principal Act is amended by inserting immediately after the term “attorney-at-law” the following words–
“who is resident and practising law in Grenada, in accordance with the relevant enactment”.
Amendment of section 46 of the principal Act.
6. Section 46 of the principal Act is amended–
(a) in sub-sections (1) and (2), by deleting the words “United Kingdom Designs Protection Act Cap. 333” wherever found and substituting with the words “Registration of United Kingdom Trade Marks Act Cap. 284”; and
(b) by inserting immediately after subsection (2), the following new subsection–
“(2a) Where immediately before the coming into operation of this Act, an action has been

brought under the Merchandise Marks Act Cap. 192, such an action shall continue to be dealt with and completed or otherwise determined in all respects as if the Merchandise Marks Act Cap. 192 had not been repealed”.
7. Section 47 of the principal Act is repealed and substituted with the following section–
“47. The Registration of the United Kingdom Trade Marks Act Cap. 284 and the Merchandise Marks Act Cap. 192 are hereby repealed.”.
