PART I PRELIMINARY

1. These Regulations may be cited as the CopyrightRegulations, 1999.

2. (1) In these Regulations —

“Act” means the Copyright Act, 1998;

“author” includes an employer or other person for whom a work is made for hire;

“basic registration” means a copyright registration made under sections 33 and 34 of the Act;

“Comptroller” means the Comptroller of Customs appointed under section 3 of the Ch. 293. Customs Management Act;

“masthead” means a body of information appearingin approximately the same location in most issues of a newspaper, magazine, journal, review or other periodical or serial, typicallycontaining the title of the periodical or serial, information about the staff, periodicity of issues, operation and subscription and editorialpolicies, of the publication;

“premises” means —

(a)
a dwelling, including a single-unit residenceor a single unit within a multiple unitresidence; or
(b)
a room in a hotel, hospital, nursing home or other commercial or institutional building;

“serial work” means a work issued or intended to be issued in successive parts bearing numerical or chronological designations and intended to be continued indefinitely;

“single-leaf work” means a work published in copies consisting of a single leaf, including copies on which the work is printed or otherwise reproduced on either one side or on both sides of the leaf and also folders which, without cutting ortearing the copies, can be opened out to form a single leaf; and a work need not consist oftextual matter in order to be considered a single-leaf work;

“small cable system” means a cable system that diffuses signals with or without a fee to not morethan one thousand premises in the same community;

“supplementary registration” means a registration made upon application under subsection (5) of section 33 of the Act;

“title page” means a page or two consecutive pages facing each other, appearing at or near the front of the copies of a work published in book formon which the complete title of the work isprominently stated and on which the name of the author, the name of the publisher, the place of publication or some combination of them, are given;

“Tribunal” means the Copyright Royalty Tribunal established by section 86 of the Act.

(2)
A work is published in book form if the copiesembodying it consist of multiple leaves bound, fastened or assembled in a predetermined order, as an example, a volume, booklet, pamphlet or multipage folder; and such awork need not consist of textual matter in order to be considered published in book form.
(3)
The meanings of the terms “back”, “first”, “last” and “following” when used in connection with works published in book form, will vary in relation to the physical form of the copies, depending upon the particular language in which the work is written.
(4)
In the case of a work published in book form with a hard or soft cover, the “front page” and “back page” of the copies are the outsides of the front and back covers;and where there is no cover, the “front page” and “backpage” are the pages visible at the front and back of the copies before they are opened.
(5)
In the case of a work consisting preponderantlyof leaves on which work is printed or otherwise produced on both sides, a “page” inside of a leaf; and where the preponderance of the leaves are printed on one side only, the terms “page” and “leaf” have the same meaning.
(6)
A notice considered “acceptable” under the resolution shall be considered to satisfy the requirement of subsection (3) of section 28 of the Act if it is affixed to thecopies in such manner and location as to give reasonable notice of the claim of copyright.

PART II WORKS OF AUTHORSHIP

3. (1) Any person having an interest in the copyright in an anonymous work who intends to record a statement pursuant to subsection (4) of section 10 of the Act, shall do so in Form A of the First Schedule.

(2) Any person having an interest in the copyright in any work who intends to record a statement of the date of death of the author of the copyright work pursuant tosubsection (8) of section 10 of the Act or a statement thatthe author is still living on a particular date shall do so in Form B of the First Schedule.

PART III AFFIXATION OF NOTICE

4. (1) The acceptability of a notice depends upon itbeing permanently legible to an ordinary user of the work under normal conditions of use and affixed to the copies in such manner and position that, when affixed, it is not concealed from view upon reasonable examination.

(2) Where, in a particular case, a notice does not appear in one of the precise locations prescribed in this regulation but a person looking in one of those locations would be reasonably certain to find a notice in another somewhat different location, that notice will be acceptable under this regulation.

5. (1) In the case of works published in book form, a notice reproduced on the copies in any of the followinglocations is acceptable —

(a) on the title page;

on the page immediately following the title page;
(c)
on either side of the front cover or, if there is no front cover, either side of the front leaf of the copies;
(d)
on either side of the back cover or, if there is no back cover, either side of the back leaf of the copies;
(e)
on the first page of the main body of the work;
(f)
on the last page of the main body of the work;
(g)
on any page between the front page and the firstpage of the main body of the work —
(i)
if there are no more than ten pages betweenthe front page and the first page of the main body of the work; and
(ii)
if the notice is reproduced prominently andis set apart from the other matter on the page where it appears;
(h)
on any page between the last page of the main body of the work and back page —
(i)
if there are no more than ten pages betweenthe last page of the main body of the workand the back page; and
(ii)
if the notice is reproduced prominently andis set apart from the other matter on the page where it appears.
(2)
In the case of a work published as an issue of aperiodical or serial, in addition to any of the locations listed in paragraph (1) (a) to (h) a notice is acceptable if it is located —
(a)
as a part of, or adjacent to, the masthead;
(b)
on the page containing the masthead if the notice is reproduced prominently and is set apart from the other matter appearing on the page; or
(c)
adjacent to a prominent heading, appearing at ornear the front of the issue, containing the title of the periodical or serial and any combination of the volume and issue number and date of the issue.
(3)
In the case of a musical work, in addition to any of the locations listed in paragraph (1) (a) to (h) a notice is acceptable if it is located on the first page of music.
  1. In the case of single-leafworks, a notice reproduced on the copies anywhere on the front or back of the leaf isacceptable.

    1. (1) For a separate contribution to a collective work to be considered to bear its own notice of copyright, asprovided by section 31 of the Act, a notice reproduced on the copies in any of the following positions is acceptable —

        1. in a case where the separate contribution is reproduced on a single page, if the notice appears —

          1. under the title of the contribution on the page;

          2. adjacent to the contribution; or

        2. (iii) on the same page if, through format,wording or both, the application of thenotice to the particular contribution is madeclear;
        1. in a case where the separate contribution is reproduced on more than one page of thecollective work, if the notice appears —

          1. under a title appearing at or near thebeginning of the contribution;

          2. on the first page of the main body of thecontribution;

        2. (iii) immediately following the end of the contribution; or
        3. (iv) on any of the pages where the contribution appears —
          1. if the contribution is reproduced on no more than twenty pages of the collective work;

          2. if the notice is reproduced prominentlyand is set apart from other matter on the page where it appears; and

          3. through format, wording or both, theapplication of the notice to the particular contribution is made clear;

      1. in a case where the separate contribution is a musical work, in addition to any of the locationslisted in paragraph (1)(a) and (b), a notice is acceptable if it is located on the first page ofmusic of the contribution.

Works reproduced in machine- readable copies.

Motion pictures and other audiovisual works.

(2) As an alternative to placing the notice on one of the pages where a separate contribution itself appears, thecontribution is considered to bear its own notice if the notice appears clearly in juxtaposition with a separate listing of the contribution by title, or if the contribution is untitled, by a description reasonably identifying the contribution —

(a)
on the page bearing the copyright notice for thecollective work as a whole, if any; or
(b)
in a clearly identified and readily-accessible table of contents or listing of acknowledgements appearing near the front or back of the collective work as a whole.

8. For works reproduced in machine-readable copies such as magnetic tapes or disks, punched cards orthe like, from which the work cannot ordinarily be visually perceived except with the aid of a machine or device, each of the following constitute examples of acceptable methodsof affixation and position of notice —

(a)
a notice embodied in the copies from machine-readable form in such a manner that on visually perceptible print-outs it appears either with or near the title or at the end of the work;
(b)
a notice that is displayed at the user’s terminal at sign on;
(c)
a notice that is continuously on terminal display; or
(d)
a legible notice reproduced durably, so as towithstand normal use, on a gummed or otherlabel securely affixed to the copies or to a box,reel, cartridge, cassette or other container used as a permanent receptacle for the copies.

9. The following constitute examples of acceptable methods of affixation and positions of the copyright notice on motion pictures and other audiovisual works —

(a)
a notice that is embodied in copies by a photomechanical or electronic process, in such a position that it ordinarily would appearwhenever the work is performed in its entirety,and that is located —
(i)
with or near the title;
(ii)
with the cast, credits, and similar information;
(iii) at or immediately following the beginning of the work; or (iv) at or immediately preceding the end of thework;
(b)
in the case of an untitled motion picture or other audiovisual work whose duration is sixty secondsor less, in addition to any of the locations listedin paragraph (a), a notice that is embodied in thecopies by a photomechanical or electronic process, in such a position that it ordinarily would appear to the projectionist or broadcasterwhen preparing the work for performance, isacceptable if it is located on the leader of the filmor tape immediately preceding the beginning of the work;
(c)
in the case of a motion picture or other audiovisual work that is distributed to the public for private use, the notice may be affixed, in addition to the locations specified in paragraph

(a) on the housing or container, if it is apermanent receptacle for the work.

10. The following constitute examples of acceptable methods of affixation and positions of the copyright notice on various forms of pictorial, graphic, and sculpturalworks —

(a)
where a work is reproduced in two-dimensional copies, a notice affixed directly or by means of a label cemented, sewn or otherwise attached durably, so as to withstand normal use, of thefront or back of the copies, or to any backing,mounting, matting, framing, or other material to which the copies are durably attached, so as to withstand normal use, or in which they are permanently housed, is acceptable;
(b)
where a work is reproduced in three-dimensional copies, a notice affixed directly or by means of a label cemented, sewn, or otherwise attached durably, so as to withstand normal use, to any visible portion of the work, or to any base,mounting, framing, or other material on which the copies are durably attached, so as to withstand normal use, or in which they are permanently housed, is acceptable;

Pictorial, graphic and sculptural works.

(c)
where, because of the size or physical characteristics of the material in which the work is reproduced in copies, it is impossible or extremely impracticable to affix a notice to the copies directly or by means of a durable label, a notice is acceptable if it appears on a tag that is of durable material, so as to withstand normal use, and that is attached to the copy withsufficient durability that it will remain with the copy while it is passing through its normal channels of commerce;
(d)
where a work is reproduced in copies consistingof sheet-like or strip material bearing multiple or continuous reproductions of the work, the noticemay be applied —
(i)
to the reproduction itself,
(ii)
to the margin, selvage or reverse side of thematerial at frequent and regular intervals, or
(iii) if the material contains neither a selvage nora reverse side, to tags or labels, attached tothe copies and to any spools, reels, orcontainers housing them in such a way thata notice is visible while the copies arepassing through their normal channels of commerce;
(e)
if the work is permanently housed in a container, such as a game or puzzle box, a noticereproduced on the permanent container is acceptable.

PART IV REGISTRATION OF WORKS

Classification of 11. Pursuant to subsection (3) of section 33 of the

works.

Act, the classes of works on which copyright may beclaimed and examples of works which they include are as follows —

(a)
Class TX: Non-dramatic literary works. This class includes all published and unpublishednon-dramatic literary works. Examples: fiction, non-fiction, poetry, textbooks, reference works,directories, catalogues, advertising copy and compilations of information;
(b)
Class PA: Works of the performing arts. Thisclass includes all published and unpublishedworks prepared for the purpose of beingperformed directly before an audience or indirectly by means of a device or process. Examples: musical works, including any accompanying words; dramatic works, including any accompanying music; pantomimes and choreographic works; and motion pictures and other audiovisual works;
(c)
Class VA: Works of the visual arts. This class includes all published and unpublished pictorial, graphic and sculptural works. Examples: twodimensional and three dimensional works of the fine, graphic and applied arts; photographs,prints, and art reproductions, maps, globes and charts; technical drawings, diagrams and models;and pictorial or graphic labels and advertisements;
(d)
Class SR: Sound recordings. This class includesall published and unpublished sound recordingsfixed on and after the appointed day. Claims tocopyright in literary, dramatic, and musical works embodied in phonorecords may also beregistered in this class under subparagraph (c) —
(i)
if registration is sought on the sameapplication for both a recorded literary,dramatic or musical work and a sound recording,
(ii)
if the recorded literary, dramatic or musical work and the sound recording are embodied in the same phonorecord, and
(iii) the same claimant is seeking registration of both the recorded literary, dramatic or musical work and the sound recording;
(e)
Class SE: Serials. This class includes all periodicals, newspapers, annuals, and the journals, proceedings and transactions of societies.

12. (1) An application for copyright registration may be submitted by any author or other copyright claimant ofa work, the owner of any exclusive right in a work, or the duly authorized agent of any such author, other claimant or owner.

(2)
An application for copyright registration shall besubmitted on the appropriate Form C, D, E or F of the First Schedule and shall be accompanied by the prescribed fee and deposit required under sections 33 and 34 of the Act.
(3)
The application shall contain the information required by the appropriate Form, its accompanying instructions and shall include a certification which shall consist of —
(a)
a designation of whether the applicant is theauthor of, or other copyright claimant or owner of exclusive rights in, the work, or the dulyauthorised agent of such author, other claimantor owner (whose identity shall also be given);
(b)
the handwritten signature of such author, other claimant, owner or agent, accompanied by the typed or printed name of that person;
(c)
a declaration that the statements made in the application are correct to the best of that person’s knowledge; and
(d)
the date of certification.
(4)
The application for registration of a publishedwork will not be accepted if the date of certification isearlier than the date of publication given in the application.

13. (1) Any author or other copyright claimant of a copyright work, or the owner of any exclusive right in the work, or the duly authorised agent of any such author,other claimant or owner, who wishes to correct or amplify the information given in the basic registration for the work may file an application for supplementary registration.

(2) An application for supplementary registration shall be made in Form H of the First Schedule, shall be accompanied by the fee prescribed by section 95 of the Act,and shall contain the following information —

(a)
the title of the work as it appears in the basic registration, including previous or alternative titles if they appear;
(b)
the registration number of the basic registration;
(c)
the year when the basic registration was completed;
(d)
(e)
(f)
(g)
(h)

the name or names of the author or authors of the work, and the copyright claimant in the work, as they appear in the basic registration;

in the case of a correction —

(i)
the line number and heading or description of the part of the basic registration wherethe error occurred;
(ii)
a transcription of the erroneous information as it appears in the basic registration;

(iii) a statement of the correct information as it

should have appeared; in the case of an amplification —

(i)
the line number and heading or description of the part of the basic registration wherethe information to be amplified appears;
(ii)
a clear and succinct statement of the information to be added; and

(iii) if desired, an explanation of the amplifica

tion; the name and address —

(i)
to which correspondence concerning theapplication should be sent; and
(ii)
to which the certificate of supplementary

registration shall be mailed; and a certification which shall consist of —

(i)
the handwritten signature of the author,other copyright claimant, or owner of exclusive rights in the work, or of the dulyauthorized agent of such author, other claimant or owner (who shall also beidentified);
(ii)
the typed or printed name of the person whose signature appears, and the date ofsignature; and

(iii) a statement that the person signing the application is the author, other copyrightclaimant or owner of exclusive rights in the work, or the authorized agent of such author, other claimant or owner, and that the statements made in the application are correct to the best of that person’s knowledge.

(3) Copies, phonorecords or supporting documentsshall not be made part of the record of a supplementary registration and shall not be submitted with the application.

14. (1) When a supplementary registration is completed, the Registrar shall assign it a new registration number in the appropriate class and issue a certificate of supplementary registration under that number.

(2) As provided in subsection (5) of section 33 ofthe Act, the information contained in a supplementary registration augments but does not supersede that contained in the earlier registration.

PART V CUSTOMS

15. (1) The notice required by subsection (1) of section 56 of the Act shall be in Form I of the First Schedule and a separate notice on Form I shall be given in respect of each work.

(2) The notice required by subsection (3) of section56 of the Act shall be in Form J of the First Schedule and a separate notice on Form J shall be given in respect of each importation, whether of one or more works.

  1. A fee of twenty dollars in respect of each noticeshall be paid to the Comptroller at the time such notice is given.

  2. (1) The owner of the copyright in any work forwhich a notice has been given shall notify the Comptroller in writing of any change in ownership or other change affecting the notice within twenty-eight days of such change and further notice shall be given as the Comptroller may require.

(2) On a change of ownership of copyright, whethernotified to the Comptroller or not, any notice alreadygiven shall be deemed to have been withdrawn as from theexpiry of twenty-eight days from the change of ownership.

18. (1) The owner of the copyright in any work orany agent of his who gives a notice shall either at the time ofgiving the notice or at the time when the work is imported or at both such times furnish to the Comptroller such evidence and information within such time and in such form as he may require and shall produce within such time as he may specify such books or other documents as hemay require.

(2) If such evidence and information is not furnished and if such books or other documents are not produced asrequired by the Comptroller, the notice shall be deemed to have been withdrawn as from such time as the Comptrollershall specify.

19. (1) The owner of the copyright in any work orany agent of his, who gives notice, shall give to the Comptroller security or further security, within such time and in such manner, whether by bond, deposit of a sum of money orotherwise as the Comptroller may require, against allactions, proceedings, claims and demands whatsoever which may be taken or made against, or costs and expenses which may be incurred by him, in consequence of the detention of any copy to which the notice relates.

(2) Any security or further security under paragraph

(1) shall be given at the time the notice is given or at such time as the Comptroller may require and if such security orfurther security is not given within the time or in the manner required by the Comptroller, the notice shall be deemed to have been withdrawn as from the expiry of the time so required.

20. (1) In every case —

(a)
in which the Comptroller has not required the security or further security referred to in regulation 18 to be given;
(b)
in which the Comptroller has taken security andthat security is insufficient; or
(c)
in which the notice is deemed to have been withdrawn under regulation 17, 18 or 19,

the owner of the copyright in any work and any agent of his, who has given a notice shall jointly and severally keepthe Comptroller indemnified against all actions, proceedings, claims and demands whatsoever which may be taken or made against him and shall repay to the Comptroller all costs and expenses which may be incurred by him inconsequence of the detention of or anything done in relation to any copy of a work to which the notice relates.

PART VI LIBRARIES AND ARCHIVES

21. (1) Subject to paragraph 2, each of the class of library or archive shall be a class prescribed for the purposes of sections 68, 69, 70 and 71 of the Act as follows —

(a)
any library of a school, university, college of a university, university college or any library of an establishment for further education (within themeaning assigned to that expression by section 30 of the Education Act);
(b)
any library administered by a Library Authority under the Nassau Library Act or the Out Island Public Libraries Act;
(c)
any Parliamentary Library, library or archive administered as part of a Government Department;
(d)
any library conducted for, or administered by any establishment or organisation conducted for, the purpose of facilitating or encouraging the study of all or any of the following: religion,philosophy, science (including any natural orsocial science), technology, medicine, history, literature, languages, education bibliography,fine arts, music or law.

(2) Paragraph (1) shall not apply to any library orarchive established or conducted for profit.

22. For the purposes of subsection (2) of section 67of the Act, no copy or phonorecord of any work or any partof a work shall be made for or supplied to any person unless that person has delivered to the librarian or archivist concerned or to some person appointed by the librarian or archivist for that purpose, a declaration and undertaking in writing in relation to that work or part, substantially inaccordance with Form K of the First Schedule.

PART VII CABLE SYSTEM

23. These Regulations fix the aggregate royalties Application. payable pursuant to paragraph (d) of section 83 of the Act, the terms and conditions related to such royalties, andthe apportionment of such royalties among the organisations entitled to receive such royalties.

25. Subject to regulations 26, 27 and 28, the royalty for any secondary transmission of radio signals by a cable system shall be — Royalty for radio signals.

calculated at 3.6 cents for each premise served bythe diffusion service on the last day of Decemberof the previous year; and

  1. The royalty for a small cable system shall be $72.00 a year to cover all television signals retransmittedby it and $8.00 a year to cover all radio signalsretransmitted by it, and shall be payable on the last dayof January of the current year.

  2. In determining the amount of royalties payable by a cable system, no account shall be taken of premises receiving a signal without the direct or indirect authority of the cable system.

    1. The royalty payable for the following types ofpremises shall be reduced as follows —

      1. rooms in hospitals, nursing homes and other health care facilities: reduced by 100 per cent;

      2. rooms in hotels: reduced by 75 per cent;

      3. rooms in schools and other educational institutions: reduced by 100 per cent.

  3. Royalties shall be initially payable to the Tribunal which shall allocate all royalties on an equitable basisamong the organisations entitled to receive royalty subjectto the deduction of the reasonable costs and expenses ofthe Tribunal relating to such royalties and such allocation.

    1. Every cable system shall provide the Tribunal at least once a year with the following information —

      1. the name of the cable system together with any trade name under which it carries on business;

      2. the address of the cable system’s principal place of business;

      3. the cable system’s address (including any telecopier number) for the purposes of notice;

      4. the number of premises of each type served, divided into residential, health-care, hotels, educational institutions and others;

      5. the total number of subscribers;

      6. the gross amounts paid to the cable system for the basic service of providing secondary transmissions of primary broadcast transmitters;

      7. the names and locations of all primary transmitters whose transmissions were further transmitted by the cable system; and

        1. for each signal distributed —

          1. the name or call letters;

          2. any network affiliation;

    2. (iii) if the signal is a repeater, the call letters and any network affiliation of the mother signal;
      1. any other name by which the service or signal may be commonly known;

      2. an indication of whether the signal is offered on the basic or discretionary tier;and

      3. the number of premises of each typereceiving the signal.

  4. (1) Adjustment in the amount of royalties owed by a cable system (including excess payments), as a result of the discovery of an error or otherwise, shall be made on the date the cable system’s next royalty payment is due, and in this regard a cable system may deduct any amountowed to it from its next royalty payments until no money remains owing to it.

(2)
Any amount not received by the due date shall bear interest from that date to the last day of the month in which payment is made.
(3)
Any amount found to be owing, through an audit or otherwise shall bear interest from the date it was due to the last day of the month in which payment is made.
(4)
Interest shall be calculated monthly on the last dayof each month, at the bank rate fixed in the last week of the previous month (as published by the Central Bank of The Bahamas) plus one per cent.

PART VIII MISCELLANEOUS

32. The fees to be charged, pursuant to subsection

(1) of section 95 of the Act, shall be those specified in theSecond Schedule.
