Chapter I:  GENERAL PROVISIONS

Article 1.
These Implementing Regulations are drawn up in accordance with the Patent
Law of the People's Republic of China (hereinafter referred to as the
Patent Law).


Article 2.
"
Invention" in the Patent Law means any new technical solution relating to
a product, a process or improvement thereof.


"Utility model" in the Patent Law means any new technical solution
relating to the shape, the structure, or their combination, of a product,
which is fit for practical use.


"Design" in the Patent Law means any new design of the shape, pattern,
color, or their combination, of a product, which creates an aesthetic
feeling and is fit for industrial application.


Article 3.
Any proceedings provided for by the Patent Law and these Implementing
Regulations shall be conducted in a written form.


Article 4.
Any document submitted under the Patent Law and these Implementing
Regulations shall be in Chinese. The standard scientific and technical
terms shall be used if there is a prescribed one set forth by the State.
Where no generally accepted translation in Chinese can be found for a
foreign name or scientific or technical term, the one in the original
language shall be also indicated.


Where any certificate and certified document submitted in accordance with
the Patent Law and these Implementing Regulations are in foreign
languages, and where the Patent Office deems it necessary, it may request
a Chinese translation of the certificate and the certified document to be
submitted within a specified time limit; where the translation is not
submitted within the specified time limit, the certificate and certified
document shall be deemed not to have been submitted.


Article 5.
For any document sent by mail to the Patent Office, the date of mailing
indicated by the postmark on the envelope shall be presumed to be the date
of filing. If the date of mailing indicated by the postmark on the
envelope is illegible, the date on which the Patent Office receives the
document shall be the date of filing, except where the date of mailing is
proved by the addressee.


Any document of the Patent Office may be served by mail, by personal
delivery or by public announcement. Where any party concerned appoints a
patent agency, the document shall be sent to the patent agency; where no
patent agency is appointed, the document shall be sent to the person first
named in the request or to the representative. If such person refuses to
accept the document, it shall be presumed to have been served.

 

For any document sent by mail by the Patent Office, the 15th day from the date of
mailing shall be presumed to be the date on which the addressee receives
the document.

 

For any document which shall be delivered personally in
accordance with the prescription of the Patent Office, the date of
delivery is the date on which the addressee receives the document.

Where the address of a document is not clear and it cannot be sent by
mail, the document may be served by making an announcement in the Patent
Gazette. At the expiration of one month from the date of the announcement,
the document shall be presumed to have been served.

Article 6.

The first day of any time limit prescribed in the Patent Law and these
Implementing Regulations shall not be counted. Where a time limit is
counted by year or by month, it shall expire on the corresponding day of
the last month; if there is no corresponding day in that month, the time
limit shall expire on the last day of that month.


If a time limit expires on an official holiday, the time limit shall
expire on the first working day after that official holiday.


Article 7.
Where a time limit prescribed in the Patent Law or these Implementing
Regulations or specified by the Patent Office is not observed because of
force majeure, resulting the loss of any right on the part of the party
concerned, he or it shall, within two months from the date on which the
impediment is removed, at the latest within two years immediately
following the expiration of that time limit, state the reasons, together
with relevant supporting documents and request the Patent Office to
restore his or its rights.


Where a time limit prescribed in the Patent Law or these Implementing
Regulations or specified by the Patent Office is not observed because of
any justified reason, resulting the loss of any right on the part of the
party concerned, he or it shall, within two months from the date of
receipt of a notification from the Patent Office, state the reasons and
request the Patent Office to restore his or its rights.

 Where the party concerned makes a request for an extension of a time limit specified by
the Patent Office, he or it shall, before the time limit expires, state
the reasons to the Patent Office and complete the relevant procedures.

The provisions of paragraphs one and two of this Rule shall not be
applicable to the time limits referred to in Articles 24, 29, 41, 45 and
61 of the Patent Law.

The provisions of paragraph two of this Rule shall
not be applicable to the time limit referred to in Article 88 of these
Implementing Regulations.

Article 8.
Where the invention for which a patent is applied for by the entity of the
national defence system relates to the security of the State concerning
national defence and is required to be kept secret, the application for
patent shall be filed with the patent organization set up by the competent
department of science and technology of national defence under the State
Council. Where any application for patent for invention relating to the
secrets of the State concerning national defence and requiring to be kept
classified is received by the Patent Office, the Patent Office shall
transfer the application to the said patent organization. The Patent
Office shall make a decision on the basis of the observations of the
examination of the application presented by the said patent organization.

Subject to the preceding paragraph, the Patent Office, after receipt of an
application for patent for invention which is required to be examined for
the purpose of security, shall send it to the competent department
concerned of the State Council for examination. The said department shall,
within four months from receipt of the application, send a report on the
results of the examination to the Patent Office. Where the invention for
which a patent is applied for is required to be kept classified, the
Patent Office shall handle it as an application for secret patent and
notify the applicant accordingly.


Article 9.
The date of filing referred to in the Patent Law, except that mentioned in
Articles 28 and 45, means the priority date where a right of priority is
claimed.


The date of filing referred to in these Implementing Regulations means the
date on which the application for patent is filed with the Patent Office.

Article 10.
"
Service invention-creation made by a person in execution of the tasks of
the entity to which he belongs" mentioned in Article 6 of the Patent Law
refers to any invention-creation made:
(1) in the course of performing his own duty;
(2) in execution of any task, other than his own duty, which was entrusted
to him by the entity to which he belongs;
(3) within one year from his resignation, retirement or change of work,
where the invention-creation relates to his own duty or the other task
entrusted to him by the entity to which he previously belonged.


"Material means of the entity" mentioned in Article 6 of the Patent Law
refers to entity's money, equipment, spare parts, raw materials, or
technical data which are not to be disclosed to the public.


Article 11.
"
Inventor" or "creator" mentioned in the Patent Law refers to any person
who has made creative contributions to the substantive features of the
invention-creation. Any person who, during the course of accomplishing the
invention-creation, is responsible only for organization work, or who
offers facilities for making use of material means, or who takes part in
other auxiliary functions, shall not be considered as inventor or creator.


Article 12.
For any identical invention-creation, only one patent right shall be
granted. Two or more applicants who file, on the same day, applications
for patent for the identical invention-creation, as provided for in
Article 9 of the Patent Law, shall, after receipt of a notification from
the Patent Office, hold consultation among themselves to decide the person
or persons who shall be entitled to file the application.


Article 13.
Any license contract for exploitation of the patent which has been
concluded by the patentee with an entity or individual shall, within three
months from the date of entry into force of the contract, be submitted to
the Patent Office for record.

Article 14.
"
The patent agency" referred to in Article 19, Paragraph one, and Article
20 of the Patent Law shall, on the authorization of the State Council, be
designated by the Patent Office.


Article 15.
Where any dispute arises concerning the right to apply for a patent for an
invention-creation or the right to own a patent right which has been
granted, any of the parties concerned may request the administrative
authority for patent affairs to handle the matter or may institute legal
proceedings in the people's court.


Any party to a dispute concerning the right to apply for a patent or the
right to own a patent right which is pending before the administrative
authority for patent affairs or the people's court, may request the Patent
Office to suspend the relevant procedures.

 Any party requesting suspension of the procedure before the Patent Office in accordance with
the preceding paragraph, shall submit a request to the Patent Office,
together with the relevant document of the administrative authority for
patent affairs or the people's court before which the dispute is pending.

Chapter II:  APPLICATION FOR PATENT

Article 16.
Anyone who applies for a patent shall submit application documents in two
copies.

Any applicant who appoints a patent agency for filing an
application for a patent with, or for dealing with other patent matters
before
, the Patent Office, shall submit a power of attorney indicating the
scope of the power entrusted.


Article 17.
Other related matters mentioned in Article 26, paragraph two, of the
Patent Law refer to:
(1) the nationality of the applicant;
(2) where the applicant is an enterprise or other organization, the name
of the country in which the applicant has the principal business office;
(3) where the applicant has appointed a patent agency, the relevant
matters which should be indicated;
(4) where the priority of an earlier application is claimed, the relevant
matters which should be indicated;
(5) the signature or seal of the applicant or the patent agency;
(6) a list of the documents constituting the application;
(7) a list of the documents appending the application;
(8) any other related matter which needs to be indicated.


Where there are two or more applicants and where they have not appointed a
patent agency, they shall designate a representative.

Article 18.
The description of an application for a patent for invention or utility
model shall be presented in the following manner and order:
(1) state the title of the invention or utility model as appearing in the
request;
(2) specify the technical field to which the invention or utility model
relates;
(3) indicate the background art which, as far as known to the applicant,
can be regarded as useful for the understanding, searching and examination
of the invention or utility model, and cite the documents reflecting such
art;
(4) specify the purpose which the invention or utility model is designed
to fulfil;
(5) disclose the technical solution of the invention or utility model, as
claimed, in such terms that a person having ordinary skill in the art can
understand it and fulfil the purpose of the invention or utility model;
(6) state the advantageous effects of the invention or utility model, with
reference to the background art;
(7) briefly describe the figures in the drawings, if any;
(8) describe in detail the best mode contemplated by the applicant for
carrying out the invention or utility model; this shall be done in terms
of examples, where appropriate, and with reference to the drawings, if
any.


The manner and order mentioned in the preceding paragraph shall be
observed by the applicant of a patent for invention or a patent for
utility model, unless, because of the nature of the invention or utility
model, a different manner or order would afford a better understanding and
a more economical presentation.


The description of the invention or utility model shall not contain such
references to the claims as: "as described in part......of the claim", nor
shall it contain commercial advertising.

Article 19.
The same sheet of drawings may contain several figures of the invention or
utility model, and the drawings shall be numbered and arranged in
numerical order consecutively as "Figure 1, Figure 2,......".


The scale and the distinctness of the drawings shall be such that a
reproduction with a linear reduction in size to two-thirds would still
enable all details to be clearly distinguished.


Drawing reference signs not appearing in the text of the description of
the invention or utility model shall not appear in the drawings. Drawing
reference signs not appearing in the drawings shall not appear in the text
of the description. Drawing reference signs for the same composite part
used in an application document shall be consistent throughout.


The drawings shall not contain any other explanatory notes, except words
which are indispensable.


Article 20.
The claims shall define clearly and concisely the matter for which
protection is sought in terms of the technical features of the invention
or utility model.


If there are several claims, they shall be numbered consecutively in
Arabic numerals.

The technical terminology used in the claims shall be
consistent with that used in the description. The claims may contain
chemical or mathematical formulate but no drawings. They shall not,
except where absolutely necessary, contain such references to the
description or drawings as: "as described in part......of the
description", or "as illustrated in figure......of the drawings".


The technical features mentioned in the claims may, in order to facilitate
quicker understanding of the claim, make reference to the corresponding
reference signs in the drawings of the description. Such reference signs
shall follow the corresponding technical features and be placed between
parentheses. They shall not be construed as limiting the claims.


Article 21.
The claims shall have an independent claim, and may also contain dependent
claims. An independent claim shall outline the technical solution of an
invention or utility model and describe the indispensable technical
features necessary for fulfilling the purpose of the invention or utility
model.


A dependent claim shall further define the claim which it refers to by
additional features which it is desired to protect.

Article 22.
An independent claim of an invention or utility model shall contain a
preamble portion and a characterizing portion, and be presented in the
following form:


(1) a preamble portion, indicating the title of the claimed subject matter
of the invention or utility model, and those technical features of the
invention or utility model which are necessary for the definition of the
claimed subject matter but which, in combination, are part of the prior
art;


(2) a characterizing portion, stating, in such words as "characterized in
that......" or in similar expressions, the technical features of the
invention or utility model, which distinguish it from the prior art. These
features, in combination with the features stated in the preamble portion,
served to define the scope of protection of the invention or utility
model.

Independent claims may be presented in any other form, where it is not
appropriate, according to the nature of the invention or utility model, to
present them in the form prescribed in the preceding paragraph.

Each invention or utility model shall have only one independent claim,
which shall precede all the dependent claims relating to the same
invention or utility model.


Article 23.
A dependent claim of an invention or utility model shall contain a
reference portion and a characterizing portion, and be presented in the
following form:


(1) a reference portion, indicating the serial number(s) of the claim(s)
referred to, and the title of the subject matter;


(2) a characterizing portion, stating the additional technical features of
the invention or utility model.

A dependent claim referring to one or more other claims shall refer only
to the preceding claim or claims. A multiple dependent claim which refers
to more than one other claim shall not serve as a basis for any other
multiple dependent claim.


Article 24.
The abstract shall indicate the technical field to which the invention or
utility model pertains, the technical problems to be solved, the essential
technical features and the use or uses of the invention or utility model.
The abstract may contain the chemical formula which best characterizes the
invention. In an application for a patent which contains drawings, the
applicant shall indicate and provide a drawing which best characterizes
the invention or utility model. The scale and the distinctness of the
drawings shall be such that a reproduction with a linear reduction in size
to 4cm*6cm would still enable all details to be clearly distinguished. The
whole text of the abstract shall contain not more than 200 Chinese
characters. There shall be no commercial advertising in the abstract.

Article 25.
Where an application for a patent for invention concerns a new micro-
organism, a micro-biological process or a product thereof and involves the
use of a micro-organism which is not available to the public, the
applicant shall, in addition to the other requirements provided for in the
Patent Law and these Implementing Regulations, complete the following
procedures.


(1) deposit a sample of the micro-organism with a depositary institution
designated by the Patent Office before the date of filing, or, at the
latest, on the date of filing, and submit, at the time of filing, or, at
the latest, within three months from the filing date, a receipt of deposit
and the viability proof from the depository institution; where they are
not submitted within the specified time limit, the sample of the micro-
organism shall be deemed not to have been deposited;


(2) give in the application document relevant information of the
characteristics of the micro-organism;


(3) indicate, where the application relates to the deposit of the micro-
organism, in the request and the description the scientific name (with its
Latin name) and the name of the depositary institution, the date on which
the sample of the micro-organism was deposited and the accession number of
the deposit; where, at the time of filing, they are not indicated, they
shall be supplied within three months from the date of filing; where after
the expiration of the time limit they are not supplied, the sample of the
micro-organism shall be deemed not to have been deposited.


Article 26.
After the publication of an application for a patent for invention
relating to a micro-organism, any entity or individual which or who
intends to make use of the micro-organism mentioned in the application for
the purpose of experiment shall make a request to the Patent Office
containing the following:


(1) the name and address of the entity or individual making the request;


(2) an undertaking not to make the micro-organism available to any other
person;


(3) an undertaking to use the micro-organism for experimental purpose only
before the grant of the patent right.


Article 27.
The size of drawings or photographs of a design submitted in accordance
with the provisions of Article 27 of the Patent Law shall not be smaller
than 3cm*8cm, nor
larger than 15cm*22cm.


Where an application for a patent for design seeking concurrent protection
of colors is filed, a drawing or photograph in color, and a drawing or
photograph in white and black, shall be submitted.


The applicant shall submit, in respect of the subject matter of the
product incorporating the design which is in need of protection, the
relevant views and stereoscopic drawings or photographs, so as to clearly
show the subject matter for which protection is sought.

Article 28.
Where an application for a patent for design is filed, a brief explanation
of the design shall, when necessary, be indicated.
The brief explanation of the design shall include the main creative
portion of the design, the colors for which protection is sought and the
omission of the view of the product incorporating the design. The brief
explanation shall not contain any commercial advertising and shall not be
used to indicate the function and the uses of the product.


Article 29.
Where the Patent Office finds it necessary, it may require the applicant
for a patent for design to submit a sample or model of the product
incorporating the design. The volume of the sample or model submitted
shall not exceed 30cm*30cm*30cm, and its weight shall not surpass 15
kilos. Articles easy to get rotten or broken, or articles that are
dangerous
may not be submitted as sample or model.


Article 30.
The existing technology mentioned in Article 22, paragraph three, of the
Patent Law means any technology which has been publicly disclose in
publications in the country or abroad, or has been publicly used or made
known to the public by any other means in the country, before the date of
filing (or the priority date where priority is claimed), that is, prior
art.


Article 31.
The academic or technological meeting mentioned in item (2) of Article 24
of the Patent Law means any academic or technological meeting organized by
a competent department concerned of the State Council or by a national
academic or technological association.

Where any application for a patent falls under the provisions of item (1) or item (2) of Article 24 of the
Patent Law, the applicant shall, when filing the application, make a
declaration and, within a time limit of two months from the date of
filing, submit a certificate issued by the entity which organized the
international exhibition or academic or technological meeting, stating
that the invention-creation was in fact exhibited or made public there and
also the date of its exhibition or making public.

Where any application for a patent falls under the provisions of item (3) of Article 24 of the
Patent Law, the Patent Office may, when necessary, require the applicant
to submit the relevant proof.


Article 32.
Where the applicant is to comply with the requirements for claiming the
right of priority in accordance with Article 30 of the Patent Law, he or
it shall, in his or its written declaration, indicate the date of filing
and the filing number of the application which was first filed
(hereinafter referred to as the earlier application) and the country in
which that application was filed. If the written declaration does not
contain the date of filing of the earlier application and the name of that
country, the declaration shall be deemed not to have been made.

Where the foreign priority is claimed, the copy of the earlier application
document submitted by the applicant shall be certified by the competent
authority of the foreign country; where the domestic priority is claimed,
the copy of the earlier application document shall be prepared by the
Patent Office.

Article 33.
Any applicant may claim one or more priorities for an application for a
patent; where the priorities of several earlier applications are claimed,
the priority period for the application shall be calculated from the
earliest priority date.


Where any applicant claims the right of domestic priority, if the earlier
application is one for a patent for invention, he or it may file an
application for a patent for invention or utility model for the same
subject matter; if the earlier application is one for a patent for utility
model, he or it may file an application for a patent for utility model or
invention for the same subject matter. But when the later application is
filed, if the earlier application falls under any of the following, it may
not be the basis of domestic priority:


(1) where it has claimed foreign or domestic priority;


(2) where it has been granted a patent right;


(3) where it is a divisional application filed as prescribed.


Where the domestic priority is claimed, the earlier application shall be
deemed to be withdrawn from the date on which the later application is
filed.


Article 34.
Where an application for a patent is filed or the right of foreign
priority is claimed by any applicant having no habitual residence or
business office in China, the Patent Office may, when necessary, require
the applicant to submit the following documents:


(1) a certificate concerning the nationality of the applicant;


(2) a certificate concerning the seat of the business office or the
headquarters, if the applicant is an enterprise or other organization;


(3) a testimonial showing that the country, to which the foreigner,
foreign enterprise or other foreign organization belongs, recognizes that
Chinese citizens and entities are, under the same conditions applied to
its nationals, entitled to patent right, right of priority and other
related rights in that country.

Article 35.
Two or more inventions or utility models belonging to a single general
inventive concept which may be filed as one application in accordance with
the provision of Article 31, paragraph one, of the Patent Law shall be
technically inter-related and contain one or more same or corresponding
special technical features. The expression "special technical features"
shall mean those technical features that define a contribution which each
of those inventions, considered as a whole, makes over the prior art.
The claims in one application for a patent for two or more inventions
which are in conformity with the provisions of the preceding paragraph may
be any of the following:


(1) independent claims of the same category for two or more products or
processes which cannot be included in one claim;


(2) an independent claim for a product and an independent claim for a
process specially adapted for the manufacture of the product;


(3) an independent claim for a product and an independent claim for a use
of the product;


(4) an independent claim for a product, an independent claim for a process
specially adapted for the manufacture of the product, and an independent
claim for a use of the product;


(5) an independent claim for a product, an independent claim for a process
specially adapted for the manufacture of the product, an independent claim
for an apparatus specially designed for carrying out the process;


(6) an independent claim for a process and an independent claim for an
apparatus specially designed for carrying out the process.


The claims in one application for a patent for two or more utility models
which are in conformity with the provisions of the first paragraph may be
independent claims for two or more products which cannot be included in
one claim.

Article 36.
The expression "the same class" mentioned in Article 31, paragraph two of
the Patent law means that the products incorporating the designs belong to
the same subclass in the classification of products for designs. The
expression "be sold or used in sets" means that the products incorporating
the designs have the same designing concept and are customarily sold or
used at the same time.


Where two or more designs are filed as one application in accordance with
the provisions of Article 31, paragraph two, of the Patent Law, they shall
be numbered consecutively and the numbers shall be placed in front of the
titles of the view of the product incorporating the design.


Article 37.
When withdrawing an application for a patent, the applicant shall submit
to the Patent Office a declaration stating the title of the invention-
creation, the filing number and the date of filing.


Where a declaration to withdraw an application for a patent is submitted
after the printing preparation has been done by the Patent Office for
publication of the application documents, the application shall be
published as scheduled.

Chapter III:  EXAMINATION AND APPROVAL OF APPLICATION FOR PATENT


Article 38.
In any of the following situations, any person who makes examination or
hears a case in the procedures of preliminary examination, examination as
to substance, reexamination, revocation and invalidation shall, on his own
initiative or upon the request of the parties concerned or any other
interested person, be excluded from exercising his function:


(1) where he is a close relative of the party concerned or his agent;


(2) where he has an interest in the application for patent or the patent
right;


(3) where he has such other kinds of relations with the party concerned or
his agent that might influence impartial examination and hearing.


Where a member of the Patent Reexamination Board has taken part in the
examination of the application, the provisions of the preceding paragraph
shall apply. The exclusion of persons making examination and hearing
cases shall be decided by the Patent Office.


Article 39.
Upon the receipt of an application for a patent for invention or utility
model consisting of a request, a description (a drawing being
indispensable for utility model) and one or more claims, or an application
for a patent for design consisting of a request and one or more drawings
or photographs showing the design, the Patent Office shall accord the date
of filing and a filing number and notify the applicant.


Article 40.
In any of the following situations, the Patent Office shall declare the
application unacceptable and notify the applicant accordingly;


(1) where the application for a patent for invention or utility model does
not contain a request, a description (the description of utility model
does not contain drawings) or claims, or the application for a patent for
design does not contain a request, drawings or photographs;


(2) where the application is not written in Chinese;


(3) where the application is not in conformity with the provisions of Article
94, paragraph one, of these Implementing Regulations;


(4) where the request does not contain the name and address of the
applicant;


(5) where the application is obviously not in conformity with the
provisions of Article 18, or Article 19, paragraph one, of the Patent Law;


(6) where the kind of protection (patent for invention, utility model or
design) of the application for a patent is not clear and definite or
cannot be discerned.


Article 41.
Where the description mentions that it contains "explanatory notes to the
drawings" but the drawings or part of them are missing, the applicant
shall, within the time limit specified by the Patent Office, either
furnish the drawings or make a declaration for the deletion of the
"explanatory notes to the drawings". If the drawings are submitted later,
the date of their delivering at, or mailing to, the Patent Office shall be
the date of filing of the application; if the mention of "explanatory
notes to the drawings" is to be deleted, the initial date of filing shall
be the date of filing of the application.

Article 42.
Where an application for a patent contains two or more inventions, utility
models or designs, the applicant may, at any time before the Patent Office
sends out the notification to grant the patent right, submit to the Patent
Office a divisional application.


If the Patent Office finds that an application for a patent is not in
conformity with the provisions of Article 31 of the Patent Law and Article 35
of these Implementing Regulations, it shall invite the applicant to amend
the application within the specified time limit; if the applicant does not
make any response within the time limit, the application shall be deemed
to have been withdrawn.


The divisional application may not change the kind of protection of the
initial application.

Article 43.
A divisional application filed in accordance with Article 42 of these
Implementing Regulations may enjoy the date of filing and, if priority is
validly claimed, the priority date of the initial application, provided
that the divisional application does not go beyond the scope of disclosure
contained in the initial application.

The divisional application shall be subject to the procedures in accordance with the provisions of the Patent Law and these Implementing Regulations.

The filing number and the date of filing of the initial application shall
be indicated in the request of a divisional application. When submitting
the divisional application, the applicant shall submit a copy of the
initial application document; if priority is claimed for the initial
application, the applicant shall submit a copy of the priority document of
the initial application as well.

Article 44.
"
Preliminary examination" mentioned in Articles 34 and 40 of the Patent
Law means examining an application for a patent to see whether or not it
contains the documents as provided for in Articles 26 or 27 of the Patent
Law and other necessary documents, and whether or not those documents are
in the prescribed form; such examination shall also include the following:


(1) whether or not an application for a patent for invention obviously
falls under Articles 5 or 25 of the Patent Law, or is obviously not in
conformity with the provisions of Article 18 or Article 19, paragraph one,
or is obviously not in conformity with the provisions of Article 31,
paragraph one, or Article 33 of the Patent Law, or Article 2, paragraph one,
of these Implementing Regulations;


(2) whether or not an application for a patent for utility model obviously
falls under Articles 5 or 25 of the Patent Law, or is obviously not in
conformity with the provisions of Article 18 or Article 19, paragraph one,
or is obviously not in conformity with the provisions of Article 31,
paragraph 1, or Article 33 of the patent Law, or Article 2, paragraph two, or
Article 12, paragraph one, or Articles 18 to 23 of these Implementing
Regulations, or cannot obtain a patent right according to the provisions
of Article 9 of the Patent Law;


(3) whether or not an application for a patent for design obviously falls
under Article 5 of the Patent Law, or is obviously not in conformity with
the provisions of Article 18 or Article 19, paragraph one, or is obviously
not in conformity with the provisions of Article 31, paragraph two, or
Article 33 of the Patent Law, or Article 2, paragraph three, or Article 12,
paragraph one, of these Implementing Regulations, or cannot obtain a
patent right according to the provisions of Article 9 of the Patent Law.

The Patent Office shall communicate its observations after examination of
the application to the applicant and invite him or it to submit his or its
observations or to correct his or its application within the time limit.
If the applicant makes no response within the time limit, the application
shall be deemed to have been withdrawn. Where, after the applicant has
made the observations or the corrections, the Patent Office still finds
that the application is not in conformity with the provisions of the
Articles and the Rules cited in the relevant preceding sub-paragraph, the
application shall be rejected.

Article 45.
In any of the following situations, any document relating to a patent
application, not including the patent application, which is submitted to
the Patent Office, shall be deemed not to have been submitted:


(1) where the document is not presented in the prescribed form or the
indications therein are not in conformity with the prescriptions;


(2) where no supporting document is submitted as prescribed.


The applicant shall be notified that the document is deemed not to have
been submitted.


Article 46.
Where the applicant requests an earlier publication of its or his
application for a patent for invention, a declaration shall be made to the
Patent Office. The Patent Office shall, after preliminary examination of
the application and, unless it is to be rejected, publish it immediately.


Article 47.
The applicant shall, when indicating in accordance with Article 27 of the
Patent Law the product incorporating the design and the class to which
that product belongs, refer to the classification of products for designs
published by the Patent Office. Where no indication, or an incorrect
indication, of the class to which the product incorporating the design
belongs is made, the Patent Office shall supply the indication or correct
it.


Article 48.
Any person may, from the date of publication of an application for a
patent for invention till the date of announcing the grant of the patent
right, submit to the Patent Office observations, with the reasons
therefor, on the application which is not in conformity with the
provisions of the Patent Law.

Article 49.
Where the applicant for a patent for invention cannot furnish, for
justified reasons, the documents concerning any search or the results of
any examination under Article 36 of the Patent law, it or he shall make a
statement to that effect and submit them when the said documents are
available.


Article 50.
The Patent Office shall, when proceeding on its own initiative to examine
an application for a patent for invention in accordance with the
provisions of Article 35, paragraph two, of the Patent Law, notify the
applicant accordingly.


Article 51.
When a request for examination as to substance is made, or when a response
is made in regard to the first communication of the observations of the
Patent Office after examination as to substance, the applicant may amend
the application for a patent for invention on its or his own initiative.

Within three months from the date of filing, the applicant for a patent
for utility model or design may amend the application for a patent for
utility model or design on its or his own initiative.


Article 52.
When an amendment to the description or the claims in an application for a
patent for invention or utility model is made, a replacement sheet in
prescribed form shall be submitted, unless the amendment concerns only the
alteration, insertion or deletion of a few words. Where an amendment to
the drawings or photographs of an application for a patent for design is
made, a replacement sheet in prescribed form shall be submitted.


Article 53.
According to the provisions of the Patent Law and these Implementing
Regulations, the situations where after examination as to substance an
application for patent for invention shall be rejected by the Patent
Office shall comprise the following:


(1) where the application does not comply with the provisions of Article 2,
paragraph one, of these Implementing Regulations;


(2) where the application falls under the provisions of Articles 5 or 25
of the Patent Law; or it does not comply with the provisions of Article 22
of the Patent Law and Article 12, paragraph one, of these Implementing
Regulations, or the applicant cannot obtain a patent right according to
the provisions of Article 9 of the Patent Law;


(3) where the application does not comply with the provisions of Article
26, paragraphs three or four, or Article 31, paragraph one, of the Patent
Law;


(4) where the amendment to the application or the divisional application
goes beyond the scope of disclosure contained in the initial description
and the claims.

Article 54.
After the Patent Office issues the notification to grant the patent right,
the applicant shall go through the formalities of registration within two
months from the date of receipt of the notification. If the applicant goes
through the formalities of registration within the said time limit, the
Patent Office shall grant the patent right, issue the patent certificate,
and announce it. The patent right shall come into force upon the date of
issue of the patent certificate.

If the time limit for going through the formalities of registration is not
met, the applicant shall be deemed to have abandoned its or his right to
obtain the patent right.


Article 55.
The grounds on which a revocation may be requested under Article 41 of the
Patent Law of a patent right, which is announced and granted by the Patent
Office, shall comprise the following:


(1) where the invention or utility model for which the patent right is
granted does not comply with the provisions of Article 22 of the Patent
Law;


(2) where the design for which the patent right is granted does not comply
with the provisions of Article 23 of the Patent Law.


Article 56.
Anyone requesting revocation of a patent right in accordance with the
provisions of Article 41 of the Patent Law shall submit to the Patent
Office a request and the relevant documents in two copies, stating the
facts and reasons on which the request is based.

The person requesting revocation may withdraw his request before the
Patent Office makes a decision on it.


Article 57.
After the receipt of the request for revocation of the patent right, the
Patent Office shall make an examination of it. Where the request does not
conform to the prescribed requirements, the Patent Office shall notify the
person making the request to rectify it within the specified time limit.
If the time limit for making rectification is not met, the request for
revocation shall be deemed not to have been filed.

Where, in the request for revocation of the patent right, no facts and reasons have been given
to support the request or the reasons given do not conform to the
provisions of Article 55 of these Implementing Regulations, the request shall
be declared to be unacceptable.

The Patent Office shall send a copy of the request for revocation of the
patent right and copies of the relevant documents to the patentee and
invite it or him to present its or his observations within a specified
time limit. The patentee may amend its or his patent specification, but
may not broaden the scope of patent protection. If no response is made
within the time limit, the examination procedure of the Patent office will
not be affected.

Article 58.
The Patent Reexamination Board shall consist of experienced technical and
legal experts designated by the Patent Office. The Director General of the
Patent Office shall be the Director of the Board.


Article 59.
Where the applicant requests the Patent Reexamination Board to make a
reexamination in accordance with the provisions of Article 43, paragraph
one, of the Patent Law, it or he shall file a request for reexamination
and state the reasons therefor, together with the relevant supporting
documents. The request and the supporting documents shall be in two
copies.

The applicant or the patentee may amend its or his application, which has
been rejected, or its or his patent specification, which has been revoked,
at the time when it or he requests reexamination, but the amendments shall
be limited only to the part to which the decision of rejection of the
application or the decision of revocation of the patent right relates.


Article 60.
Where the request for reexamination does not comply with the prescribed
form, the person making the request shall rectify it within the time limit
fixed by the Patent Reexamination Board. If the time limit for making
rectification is not met, the request for reexamination shall be deemed
not to have been filed.


Article 61.
The Patent Reexamination Board shall send the request for reexamination
which the Board has received to the examination department which has made
the examination to make an examination. Where the examination department
agrees to revoke its former decision upon the request of the person
requesting reexamination, the Patent Reexamination Board shall make a
decision accordingly and notify that person.


Article 62.
Where the Patent Reexamination Board finds after reexamination that the
request does not comply with the provisions of the Patent Law, it shall
invite the person requesting reexamination to submit his observations
within the specified time limit. If the time limit for making response is
not met, the request for reexamination shall be deemed to have been
withdrawn.


Article 63.
At any time before the Patent Reexamination Board makes its decision on
the request for reexamination, the person making the request may withdraw
his request for reexamination.

Article 64.
The Patent Office may amend the obvious mistakes which it finds in the
title of the invention-creation, the abstract or the request of the
application, and notify the applicant.

The patent office shall correct promptly the mistakes in the Patent
Gazettes and documents issued by it once they are discovered.

Chapter IV:  INVALIDATION OF PATENT RIGHT

Article 65.
Anyone requesting invalidation or part invalidation of a patent right
according to the provisions of Article 48 of the Patent Law shall submit
the request and the relevant documents in two copies, stating the facts
and reasons on which the request is based, to the Patent Reexamination
Board.

The person requesting invalidation may withdraw his request before the
Patent Reexamination Board makes a decision on it.


Article 66.
Where the request for invalidation of the patent right does not comply
with the prescribed form, the person making the request shall rectify it
within the time limit fixed by the Patent Reexamination Board. If the
rectification fails to be made within the time limit, the request for
invalidation shall be deemed not to have been filed.

 The grounds on which the request for invalidation may be based shall comprise that the
invention-creation for which the patent right is granted does not comply
with the provisions of Articles 22 or 23, Article 26, paragraphs three or
four, or Article 33 of the Patent Law, or Article 2, or Article 12, paragraph
one of these Implementing Regulations; or it falls under the provisions of
Articles 5 or 25 of the Patent Law; or the person to whom the patent was
granted cannot obtain a patent right according to the provisions of
Article 9 of the Patent Law.

Where, in the request for invalidation, no facts and reasons have been
given to support the request or the reasons given do not conform to the
provisions of the preceding paragraph, or where invalidation is requested
after the request for revocation is made but no decision on that request
has yet been rendered, or where, after decision on any request for
revocation or invalidation of the patent right was made, invalidation
based on the same facts and reasons is requested again, the request shall
be declared to be unacceptable by the Patent Reexamination Board.


Article 67.
The Patent Reexamination Board shall send a copy of the request for
invalidation of the patent right and copies of the relevant documents to
the patentee and invite it or him to present its or his observations
within a specified time limit. The patentee may amend its or his patent
specification, but may not broaden the scope of patent protection. Where
no response is made within the time limit, the hearing procedure of the
Patent Reexamination Board will not be affected.

Chapter V:  COMPULSORY LICENSE FOR EXPLOITATION OF PATENT

Article 68.
After the expiration of three years from the grant of the patent right,
any entity may, in accordance with the provisions of Article 51 of the
Patent Law, request the Patent Office to grant a compulsory license.

Any entity or individual requesting a compulsory license shall submit to
the Patent Office a request for compulsory license and state the reasons
therefor, together with relevant supporting documents. The request and the
supporting documents shall be in two copies respectively.

The Patent Office shall send a copy of the request for compulsory license
to the patentee. He or it shall make his or its observations within the
time limit specified by the Patent Office. Where no response is made
within the time limit, the Patent Office will not be affected in making a
decision to grant a compulsory license.

Where a national emergency or any extraordinary state of affairs occurs, or in cases of public non-
commercial use, the Patent Office may grant a compulsory license.

The decision of the Patent Office granting a compulsory license for
exploitation shall limit the scope and duration of the exploitation on the
basis of the reasons justifying the grant, and provide that the
exploitation shall be predominately for the supply of the domestic market.

The decision of the Patent Office granting a compulsory license shall be
notified to the patentee as soon as reasonably practicable, and shall be
registered and announced by the Patent Office. If and when the
circumstances which led to such compulsory license cease to exist and are
unlikely to recur, the Patent Office may, upon the request of the
patentee, review the continued existence of these circumstances, and
terminate the compulsory license.


Article 69.
Any party requesting, in accordance with the provisions of Article 57 of
the Patent Law, the Patent Office to adjudicate the fees for exploitation,
shall submit a request for adjudication and furnish documents showing that
the parties have not been able to conclude an agreement in respect of the
amount of the fees. The Patent Office shall make an adjudication within
three months from the date of receipt of the request and notify the
parties accordingly.

Chapter VI:  REWARDS TO INVENTOR OR CREATOR OF SERVICE INVENTION-CREATION

Article 70.
"Rewards" mentioned in Article 16 of the Patent Law includes money prizes
and remunerations which are to be awarded to inventors and creators.


Article 71.
Any entity holding a patent right shall, after the grant of the patent
right, award to inventors or creators of a service invention-creation a
sum of money as prize. The sum of money prize for a patent for invention
shall not be less than 200 yuan; the sum of money prize for a patent for
utility model or design shall not be less than 50 yuan.

 Where an invention-creation was made on the basis of an inventor's or creator's
proposal adopted by the entity to which he belongs, after the grant of the
patent right, the entity holding it shall award to him a money prize
liberally.

Any enterprise holding the patent right may include the said money prize
paid to such inventors or creators into its production cost; any
institution holding the patent right may disburse the said money prize out
of its operating expenses.


Article 72.
Any entity holding a patent right shall, after exploiting the patent for
invention-creation within the duration of the patent right, draw each year
from any increase in profits after taxation a percentage of 0.5%-2% due to
the exploitation of the invention or the utility model, or a percentage of
0.05%-0.2% due to the exploitation of the design, and award it to the
inventor or creator as remuneration. The entity shall, otherwise, by
making reference to the said percentage, award a lump sum of money to the
inventor or creator as remuneration.


Article 73.
Where any entity holding a patent right for invention-creation authorizes
other entities or individuals to exploit its or his patent, it shall,
after taxation, draw a percentage of 5%-10% from the fees for exploitation
it received and award it to the inventor or creator as remuneration.


Article 74.
The remuneration provided for in these Implementing Regulations shall be
disbursed out of the profits derived from the making of patented products
or the use of patented process and out of the fees obtained for the
exploitation of the patents. The remuneration shall not be included in the
amount of the normal bonuses of the entity, nor subject to the bonus tax.
But the inventor or creator shall pay tax for his income.


Article 75.
The Chinese entities under collective ownership and other enterprises may
award to the inventor or creator money prize and remuneration by making
reference to the provisions in this chapter.

Chapter VII:  ADMINISTRATIVE AUTHORITY FOR PATENT AFFAIRS

Article 76.
"The administrative authority for patent affairs" mentioned in the Patent
Law and these Implementing Regulations refers to the administrative
authorities for patent affairs set up by the competent departments
concerned of the State Council and the people's governments in the
localities.


Article 77.
Where, after the publication of an application for a patent for invention
and before the grant of the patent right, any entity or individual has
exploited the invention without paying appropriate fees, the patentee may,
after the grant of the patent right, request the administrative authority
for patent affairs to handle the matter, or may directly institute legal
proceedings in the people's court. The administrative authority handling
the matter shall have the power to decide that the entity or individual
shall pay appropriate fees within the specified time limit. Where any of
the parties concerned is not satisfied with the decision of the said
authority, it or he may institute legal proceedings in the people's court.

Where any dispute arises between any inventor or creator, and the entity
to which he belongs, as to whether an invention-creation is a service
invention-creation, or whether an application for a patent is to be filed
in respect of a service invention-creation, or where the entity owning or
holding the patent right has not according to law awarded a reward or paid
remuneration to the inventor or creator of service invention-creation, the
inventor or creator may request the competent department at the higher
level or the administrative authority for patent affairs of the region in
which the entity is located to handle the matter.

The prescription for requesting the administrative authority for patent
affairs to handle patent disputes is two years counted from the date on
which the patentee or any interested party obtains or should have obtained
knowledge of the relevant fact.


Article 78.
Pursuant to the provisions of Article 63, paragraph two, of the Patent
Law, where any person passes any unpatented product off as patented
product or passes any unpatented process off as patented process, the
administrative authority for patent affairs may, according to the
circumstances, order such person to stop the passing off, to eliminate its
ill effects and, in addition, to pay a fine of 1000 yuan to 50000 yuan or
a fine from 100% to 300% of the amount of his illegal income.


Article 79.
Where parties to any transdepartmental or transregional infringement
dispute request the administrative authority for patent affairs to handle
the matter, the said dispute shall be handled by the administrative
authority for patent affairs of the region in which the infringement has
taken place, or by the administrative authority for patent affairs of the
higher competent department of the infringing entity.

Chapter VIII:  PATENT REGISTER AND PATENT GAZETTE

Article 80.
The Patent Office shall maintain a Patent Register in which shall be
recorded the following matters relating to any patent right:
(1) any grant of the patent right;
(2) any assignment and succession of the patent right;
(3) any revocation and invalidation of the patent right;
(4) any cessation of the patent right;
(5) any restoration of the patent right;
(6) any compulsory license for exploitation of the patent;
(7) any changes in the name, the nationality and the address of the
patentee;


Article 81.
The Patent Office shall publish the Patent Gazette at regular intervals,
publishing or announcing the following;
(1) the bibliographic data contained in patent applications;
(2) the abstract of the description of an invention or utility model, the
drawings or photographs of a design and its brief explanation;
(3) any request for examination as to substance of an application for a
patent for invention and any decision made by the Patent Office to proceed
on its own initiative to examine as to substance an application for a
patent for invention;
(4) any declassification of secret patents;
(5) any rejection, withdrawal and being deemed withdrawal of an
application for a patent for invention after its publication;
(6) any assignment and succession of an application for a patent for
invention after its publication;
(7) any grant of the patent right;
(8) any revocation and invalidation of the patent right;
(9) any cessation of the patent right;
(10) any assignment and succession of the patent right;
(11) any grant of compulsory license for exploitation of the patent;
(12) any restoration of a patent application or patent right;
(13) any change in the name or address of the patentee;
(14) any notification to the applicant whose address is not known;
(15) any other related matters.
The description, its drawings and the claims of an application for a
patent for invention or utility model shall be published in pamphlet form.

Chapter IX:  FEES

Article 82.
When any person files an application for a patent with, or has other
formalities to perform in, the Patent Office, he or it shall at the same
time pay the following fees;
(1) filing fee and maintenance fee of an application;
(2) examination fee and reexamination fee;
(3) annual fee;
(4) fee for a change in the bibliographic data, fee for claiming priority,
fee for a request for restoration of rights, fee for a request for
revocation, fee for a request for invalidation, fee for a request for
compulsory license, fee for a request for adjudication on exploitation fee
of a compulsory license, fee for patent registration, and additional fees
as prescribed.


The amount of the fees mentioned in the preceding paragraph shall be
prescribed separately by the Patent Office in conjunction with the
competent departments concerned of the State Council.


Article 83.
The fees provided for in the Patent Law and in these Implementing
Regulations may be paid directly to the Patent Office or paid by way of
bank or postal remittance, but not by telegraphic remittance.


Where fees are paid by way of bank or postal remittance, the applicant or
the patentee shall indicate on the money order the filing number or the
patent number, the name of the applicant or the patentee, the purpose of
the payment and the title of the invention-creation.


Where fees are paid by way of bank or postal remittance, the date on which
the transfer of such fee is ordered shall be the date of payment. Where
the time between such a date and the date of receipt of the order at the
Patent Office lasts more than fifteen days, unless the date of remittance
is proved by the bank or the post office, the date of receipt at the
Patent Office shall be the date of payment.


The payment which is not made in accordance with the provisions of the
second paragraph of this Article shall be deemed not to have been made.

Where any patent fee is paid more than as prescribed, paid once again or
wrongly paid, the person making the payment may claim a refund, but the
request for such refund shall be made within one year from the date of
payment.


Article 84.
The applicant shall, after receipt of the notification of acceptance of
the application from the Patent Office, pay the filing fee at the latest
within two months from the filing date. If the fee is not paid or not paid
in full within the time limit, the application shall be deemed to have
been withdrawn.

Where the applicant claims the right of priority, he or it shall pay the
fee for claiming priority at the same time with the payment of the filing
fee. If the fee is not paid or not paid in full within the time limit, the
claim to the right of priority shall be deemed not to have been made.

Article 85.
Where a request for an examination as to substance, a restoration of
right, a reexamination or revocation of patent right is made, by the party
concerned, the relevant fee shall be paid within the time limit as
prescribed respectively for such requests by the Patent Law. If the fee is
not paid or not paid in full within the time limit, the request is deemed
not to have been made.


Article 86.
Where the applicant for a patent for invention has not been granted a
patent right within two years from the date of filing, it or he shall pay
a fee for the maintenance of the application from the third year. The
first maintenance fee shall be paid within the first month of the third
year. The subsequent maintenance fees shall be paid in advance within the
month before the expiration of the preceding year.


Article 87.
When the applicant goes through the formalities of patent registration, it
or he shall pay a fee for patent registration, and the annual fee of the
year in which the patent right was granted. Where the maintenance fee of
the application of the year in which the patent right was granted has been
paid, the annual fee of that year shall not be paid. If such fees are not paid in the prescribed time limit, the patent registration shall be deemed
not to have been made. The subsequent annual fees shall be paid in advance
within the month before the expiration of the preceding year.


Article 88.
Where the maintenance fee of the application or the annual fee of the
years after the year in which the patent was granted is not paid in due
time by the applicant or the patentee, or the fees are not paid in full,
the Patent Office shall notify the applicant or the patentee to pay the
fee or to make up the insufficiency within six months from the expiration
of the time limit within which the maintenance fee or the annual fee was
to be paid, and at the same time pay a surcharge which amounts to 25% that
of the maintenance fee or the annual fee. Where the fees are not paid
within the time limit, the application shall be deemed to have been
withdrawn or the patent right shall be deemed lapsed from the expiration
of the time limit within which the maintenance fee or the annual fee
should be paid.


Article 89.
The fee for a change in the bibliographic data, fee for a request for
compulsory license, fee for a request for adjudication on exploitation fee
of a compulsory license and fee for a request for invalidation shall be
paid as prescribed within one month from the date on which such request is
filed. If the fee is not paid or not paid in full within the time limit,
the request shall be deemed not to have been made.

Article 90.
Where any person filing an application for a patent or having other
formalities to go through, has difficulties in paying the various fees
prescribed by Article 82 of these Implementing Regulations, that person may,
according to prescriptions, submit a request to the Patent Office, asking
for a reduction or postponement of the payment. The conditions for the
reduction and postponement of the payment shall be prescribed by the
Patent Office.

Chapter X:  SUPPLEMENTARY PROVISIONS

Article 91.
Any person may, after approval by the Patent Office, inspect or copy the
files of the published or announced patent applications and the Patent
Register. Any person may request the Patent Office to issue a copy of
extracts from the Patent Register.

The files of patent applications which have been withdrawn or deemed to have been withdrawn or which have been rejected, shall not be preserved after expiration of two years from the
date on which they cease to be valid.


Where the patent right ceases or has been revoked, abandoned or
invalidated, the files shall not be preserved after expiration of three
years from the date on which the patent right ceases to be valid.


Article 92.
Any patent application which is filed with, and any formalities which are
performed in the Patent Office, shall be made in the prescribed form of
the Patent Office and signed or sealed by the applicant, the patentee, any
other interested person or his or its representative. Where any patent
agency is appointed, it shall be sealed by such agency.

Where a change of the name of the inventor, the name, nationality and address of the
applicant or the patentee, or the name of the patent agency and patent
agent is requested, a request for a change in the bibliographic data shall
be made to the Patent Office, together with the relevant supporting
documents.


Article 93.
The documents relating to a patent application or patent right which are
mailed to the Patent Office shall be mailed by registered letter, not by
parcel.


When any document (not including any patent application filed for the
first time) is submitted to and any formalities are performed in the
Patent Office, the filing number or the patent number, the title of the
invention-creation and the name of the applicant or the patentee shall be
indicated.


Only documents relating to the same application shall be included in one
letter.


Article 94.
Any sheets constituting an application for patent shall be typed or
printed. All the characters shall be in black ink, neat and clear. They
shall be free from any alterations. Drawings shall be made in black ink
with the aid of drafting instruments. The lines shall be uniformly thick
and well-defined, and free from alterations.

The request, description,
claim, drawings and abstract shall be numbered separately in Arabic
numerals and arranged in numerical order.

The written language shall run from left to right. Only one side of each
sheet shall be used.

Article 95.
The Patent Office shall be responsible for interpreting these Implementing
Regulations.


Article 96.
These Implementing Regulations shall enter into force on January 1, 1993.


The applications for patent filed before the entry into force of these
Implementing Regulations and the patent rights granted on the basis of the
said applications shall continue to be governed by the provisions of the
Patent Law before they were amended by the Decision Regarding the Revision
of the Patent Law of the People's Republic of China, adopted at the 27th
Session of the Standing Committee of the Seventh National People's
Congress on September 4, 1992 and the relevant provisions of the
Implementing Regulations of the Patent Law of the People's Republic of
China, approved by the State Council on January 19, 1985 and promulgated
by the Patent Office on the same day. However, the procedures provided by
the amended Articles 39 to 44 and the amended Article 48 of the Patent Law
concerning the approval of applications for patent, and the revocation and
invalidation of the patent right and the relevant provisions of these
Implementing Regulations shall apply to the said applications which,
before the entry into force of these Implementing Regulations, are not
announced according to the provisions of Articles 39 and 40 of the Patent
Law before they were amended.

une demande d'enregistrement de Ia marque de produits aupres de I'Office des marques.

Les entreprises, les institutions ou les producteurs et commer~ants individuels ayant !'intention d'obtenir le droit exclusif d'utiliser une marque de services pour les services qu'ils fournissent doivent deposer une demande d'enregistrement de Ia marque de services aupres de !'Of- fice des marques.

Les dispositions de Ia presente loi qui s'appliquent aux marques de produits s'appliquent egalement aux marques de services.

5. Pour Ies produits dont I'Etat exige qu 'ils portent une marque enregistree, une demande d'enregistrement doit etre deposee. Lorsqu'aucun enregistrement de marque n'a ete accorde, de tels produits ne doivent pas etre vendus sur Ie marche.

6. Tout utilisateur d'une marque est responsable de Ia qualite des produits pour lesquels Ia marque est utilisee. Les autorites administratives pour l'industrie et Ie commerce supervisent a differents niveaux, par !'adminis- tration des marques, Ia qualite des produits et font cesser toute pratique qui trompe Ies consommateurs.

7. Les mots, Ies elements figuratifs ou les combinai- sons de mots et d'elements figuratifs utilises comme marques doivent etre distinctifs au point de pouvoir etre distingues. Lorsqu'une marque enregistree est utilisee, elle doit etre accompagnee de Ia mention «marque enregistree» ou d'un signe indiquant qu'elle est enregistree.

8. Dans les marques, les mots ou elements figuratifs ci-apres ne doivent pas etre utilises :

I) ceux qui sont identiques ou semblables au nom de I'Etat,___au_drapeau. national,_a l.~emhleme .national,_ au drapeau militaire ou aux decorations de Ia Republique populaire de Chine;

2) ceux qui sont identiques ou semblables aux noms de I'Etat, aux drapeaux nationaux, aux emblemes natio- naux ou aux drapeaux militaires des pays etrangers;

3) ceux qui sont identiques ou semblables aux drapeaux, etnblemes ou denominations des organisations internationales intergouvemementales;

4) ceux qui sont identiques ou semblables aux symboles ou aux noms de Ia Croix-Rouge ou du Crois- sant-Rouge;

5) ceux qui concement des noms generiques ou des dessins de produits pour lesquels la marque est utilisee;

6) ceux qui renvoient directement a la qualite, aux principales matieres premieres, a la fonction, a !'usage, au poids, a la quantite ou a d'autres caracteristiques des produits pour lesquels la marque est utilisee;

7) ceux qui, par nature, sont discriminatoires a l'egard d'une nationalite;

8) ceux qui, par nature, exagerent et trompent dans la publicite en faveur des produits;

9) ceux qui portent prejudice a la moralite ou aux coutumes socialistes ou qui ont d'autres influences malsaines.

Les noms geographiques designant des circonscriptions administratives au niveau du canton ou au-dessus, ainsi que Ies noms geographiques etrangers bien connus du public, ne doivent pas etre choisis comme marques sauf si les termes utilises revetent un autre sens par ailleurs. Lorsqu'une marque faisant appel a l'un des noms geogra- phiques susmentionnes a ete approuvee et enregistree, elle demeure valable.

9. Les personnes ou entreprises etrangeres ayant !'in- tention de demander l'enregistrement d'une marque. en Chine doivent deposer une demande, conformement a tout accord conclu entre Ia Republique populaire de Chine et le A pays auquel appartient le deposant, ou conformement au • traite international auquel les deux pays sont parties ou sur Ia base du principe de reciprocite.

10. Les personnes ou entreprises etrangeres ayant !'in- tention de demander !'enregistrement d'une marque ou de traiter d'autres questions concernant une marque en Chine doivent charger une organisation designee par I'Etat d' etre leur mandataire.

Chapitre II Demande d'enregistrement de marque

11. Toute demande d'enregistrement d'une marque doit indiquer, sur une formule, conformement a Ia classifi- cation des produits prescrite, la classe et Ia denomination des produits pour lesquels la marque est destinee a etre utilisee.

12. Lorsqu'un deposant a !'intention d'utiliser Ia meme marque pour des produits appartenant a des classes diffe- - rentes, une demande d'enregistrement doit etre deposee W pour chaque classe de Ia classification des produits pres- crite.

13. Lorsque Ia marque enregistree est destinee a etre utilisee pour d'autres produits appartenant a Ia meme classe, une nouvelle demande d'enregistrement doit etre deposee.

14. Lorsqu'un mot ou un element figuratif d'une marque enregistree doit etre modifie, une nouvelle demande d'enregistrement doit etre deposee.

15. Lorsque, apres !'enregistrement d'une marque, le nom, radresse ou d'autres mentions enregistrees concer- nant le titulaire de Ia marque changent, une demande visant a !'acceptation du changement doit etre deposee.

Chapitre III Examen et acceptation

de I'enregistrement de Ia marque

16. Lorsqu'une marque dont !'enregistrement a ete demand€ est conforme aux dispositions pertinentes de Ia presente Joi, I'Office des marques, apres examen, accepte Ia marque atitre provisoire et Ia publie.

17. Lorsqu'une marque dont !'enregistrement a ete demand€ n'est pas conforme aux dispositions .Pertinentes de Ia presente Ioi, ou Iorsqu'elle est identique ou similaire a Ia marque d 'un tiers, enregistree ou, apres examen, acceptee a titre provisoire, pour Jes memes produits ou pour des produits similaires, I'Office des marques rejette Ia demande et ne publie pas Iadite marque.

18. Lorsque deux ou plusieurs deposants demandent I'enregistrement de marques identiques ou similaires pour Jes memes produits, ou pour des produits similaires, J'ac- ceptation a titre provisoire apres examen, et Ia publication, sont effectuees pour Ia marque deposee en premier lieu. Lorsque Jes demandes ont ete deposees Ie meme jour, I' ac- ceptation a titre provisoire apres examen, et Ia publication, sont effectuees pour la marque utilisee Ia premiere; quant aux autres deposants, leur demande est rejetee et leur marque n'est pas plibliee.

19. Toute personne peut, dans un delai de trois mois a compter de Ia date de publication, former opposition contre Ia marque qui, apres examen, a ete acceptee a titre provisoire. Si aucune opposition n'est formee ou s'il est decide que !'opposition n'est pas justifiee, !'enregistrement est accept€, un certificat d'enregistrement de Ia marque delivre et Ia marque publiee. S'il est decide que I'opposi- tion est justifiee, aucun enregistrement n'est accept€.

20. La Chambre d' examen e~ de decision en matiere de marques, rattachee a J'autorite administrative pour I'in- dustrie et Je commerce subordonnee au Conseil d'Etat, est responsable du traitement des contestations en matiere de marques.

21. Lorsque Ia demande d'enregistrement d'une marque est rejetee et qu'a4cune publication n'est effec- tuee, I'Office des marques le notifie par ecrit au deposant. Lorsque le deposant n'est pas satisfait, il peut, dans un delai de 15 jours a compter de Ia date de reception de Ia notification. presenter une requete en reexamen de Ia deci- sion. La Chambre d'examen et de decision en matiere de marques rend une decision definitive et Ia notifie par ecrit au deposant.

22. Lorsqu'une opposition est formee contre Ia marque qui, apres examen, a ete acceptee a titre provisoire et

publiee, I'Office des marques entend les faits et motifs presentes par 1'opposant et le deposant et, apres enquete et verification, rend une decision. Lorsque I'une des parties n'est pas satisfaite, elle peut, dans un delai de 15 jours a compter de Ia date de reception de Ia notification, presenter une requete en reexamen de la decision, auquel cas Ia Chambre d'examen et de decision en matiere de marques rend une decision definitive et Ia notifie par ecrit aI'opposant et au deposant. .

Chapitre IV Renouvellement, cession et licence

de marques enregistrees

23. La duree de validite d'une marque enregistree est de 10 ans a compter de ]a date d'acceptation de !'enregis- trement.

24. Lorsque le titulaire de J'enregistrement a I'inten- tion de continuer a utiliser une marque enregistree apres J'expiration de Ia duree de validite, une demande de renouvellement de I'enregistrement doit etre deposee dans les six mois qui precedent cette expiration. Lorsqu'une telle demande n'a pas ete deposee au cours de cette periode, un delai de grace de six mois_ peut etre accord€. Si aucune demande n'a ete deposee a !'expiration du delai de grace. Ia marque enregistree est radiee.

La duree de validite de chaque renouvellement est de 10 ans.

Le renouvellement est publie apres avoir ete accept€.

25. Lorsqu 'une marque enregistree est cedee, Ie cedant et le cessionnaire doivent deposer conjointement une demande aupres de !'Office des marques. Le cessionnaire doit garantir Ia qualite des produiis pour Iesquels Ia marque enregistree est utilisee. ,

La cession d 'une marque enregistree est publiee apres avoir ete acceptee.

26. Le titulaire d'une marque enregistree peut, en signant le contrat de licence de marque, autoriser des tiers a utiliser sa marque enregistree. Le donneur de licence doit contr6ler Ia qualite des produits pour Jesquels sa marque est utilisee par le preneur de licence et celui-ci doit garantir Ia qualite des produits pour lesquels il utilise Ia marque enregistree.

Lorsqu'une personne est autorisee a utiliser Ia marque enregistree d'un tiers, le nom du preneur de licence et I'origine des produits doivent etre indiques sur les produits qui portent Ia marque enregistree.

Le contrat de licence de marque doit etre soumis a !'Office des marques afin qu'il soit verse au dossier.

Chapitre V Decision relative aux contestations

portant sur les marques enregistrees

27. Lorsqu'une marque enregistree est en contraven- tion avec les dispositions de !'article 8 de Ia presente loi, ou lorsque !'enregistrement d'une marque a ete obtenu de maniere frauduleuse ou par tout autre moyen deloyal, !'Of- fice des marques radie Ia marque en question; tout autre organisme ou personne physique peut demander a Ia Chambre d'examen et de decision en matiere de marques de prendre Ia decision de radier ladite marque.

Outre les cas prevus a I'alinea precedent, toute personne qui conteste une marque enregistree peut, dans un delai d'un an a compter de Ia date d'acceptation de I'enregistrement, deposer une demande de decision aupres de Ia Chambre d'examen et de decision en matiere de marques.

La Chambre d'examen et de decision en matiere de marques, apres reception de Ia demande de decision, Ia notifie aux parties interessees et leur demande de presenter leurs arguments dans le delai prescrit.

28. Lorsque Ia marque, avant d'avoir ete acceptee a !'enregistrement, a fait !'objet d'une opposition et d'une decision, aucune demande de decision fondee sur les memes faits et motifs ne peut etre presentee.

29. La Chambre d'examen et de decision en matiere de marques, apres avoir rendu sa decision definitive de maintenir ou de radier !'enregistrement, Ia notifie par ecrit aux parties interessees.

Chapitre VI Administration de l'utilisation des marques

30. Lorsqu'une personne utilisant Ia marque enregis- tree a commis I'un des actes ci-apres, !'Office des marques lui ordonne de rectifier Ia situation dans un delai determine. voire radie Ia marque enregistree:

I) modifier de maniere unilaterale (c'est-a-dire sans I'enregistrement requis) Ies mots ou Ies elements figuratifs de Ia marque enregistree, ou leur combinaison;

2} modifier de maniere unil,aterale (c'est-a-dire sans Ia demande requise) le nom. I'adresse ou d'autres mentions enregistrees concernant le titulaire de Ia marque enre- gistn!e;

3) ceder de maniere unilaterale Ia marque enregistree (c'est-a-dire sans !'acceptation requise);

lorsque Ia qualite superieure de ceux-ci a ete remplacee par une qualite inferieure trompant les consommateurs, les autorites administratives pour l'industrie et le commerce, a differents niveaux, ordonnent, en tenant compte des circonstances, Ia rectification de Ia situation dans un delai determine et ont, en outre, Ia faculte de faire circuler une note de critique ou d'infliger une amende, !'Office des marques pouvant meme radier Ia marque enregistree.

32. Lorsqu'une marque enregistree a ete radiee ou est expiree pour cause de non-renouvellement, 1'Office des marques n'accepte pas de demandes d'enregistrement de marques identiques ou similaires a ladite marque pendant une annee a compter de Ia date de radiation ou de suppression.

33. Lorsqu 'une personne viole Ies dispositions de !'article 5 de Ia presente loi, l'autorite administrative locale pour I'industrie et Ie commerce lui ordonne de deposer une demande d'enregistrement dans un delai determine et peut, en outre, infliger une amende.

34. Lorsqu'une personne utilisant une marque qui n'est pas enregistree a commis I'un des actes ci-apres, I'autorite administrative locale pour I'industrie et Ie commerce fait cesser I'utilisation de Ia marque, ordonne a Iadite personne de rectifier Ia situation dans un delai determine et peut, en outre, faire circuler une note de critique ou infliger une amende:

I) presenter comme enregistree une marque qui ne !'est pas;

2) violer une des dispositions de I'article 8 de Ia presente loi;

3) fabriquer Ie produit de fac;:on grossiere ou mediocre ou remplacer sa qualite superieure par une qualite infe- rieure, et tremper ainsi Ies consommateurs.

35. Quiconque n'est pas satisfait de Ia decision de !'Office des marques de radier une marque enregistree peut, dans un delai de 15 jours a compter de Ia date de reception de Ia notification correspondante, presenter une requete en reexamen de Ia decision. La Chambre d'examen et de decision en matiere de marques rend une decision definitive et Ia notifie par ecrit au deposant.

36. Quiconque n'est pas satisfait de la decision de l'autorite administrative pour I'industrie et Ie commerce d'infliger une amende en vertu des dispositions des arti- cles 31, 33 ou 34 peut intenter une action aupres du tribunal du peuple dans un delai de 15 jours acompter de Ia date de reception de Ia notification correspondante. A !'expiration dudit delai, si aucune action n'a ete intentee ou s'il n'y a pas eu execution de Ia decision, l'autorite administrative pour I'industrie et le commerce peut demander au tribunal du peuple I'execution obligatoire.

Chapitre VII Protection du droit exclusif

d'utiliser les marques enregistrees

37. Le droit exclusif d'utiliser une marque enregistree est limite a la marque acceptee a l 'enregistrement, ainsi qu'aux produits pour lesquels !'utilisation de la marque a ete acceptee.

38. Tous les actes ci-apres sont reputes violer le droit exclusif d'utiliser une marque enregistree:

l) utiliser . une marque identique ou similaire a la marque enregistree pour des produits identiques ou simi- laires, sans l'autorisation du proprietaire de la marque enregistree;

2) vendre des produits en sachant qu 'ils portent une marque enregistree contrefaite;

3) contrefaire ou fabriquer, sans autorisation, des representations d'une marque enregistree appartenant a un tiers, ou vendre ces representations d'une marque enregis- tree qui sont contrefaites ou fabriquees sans autorisation;

4) porter atteinte, de toute autre maniere, au droit exclusif d'un tiers d'utiliser la marque enregistree.

39. Lorsqu'une personne a commis l'un des actes constituant, en vertu de !'article 38 de la presente loi, une violation du droit exclusif d'utiliser une marque enregis- tree, la personne dont le droit a ete viole peut demander a l'autorite administrative pour l'industrie et le commerce, au niveau du canton ou au-dessus, de prendre des mesures. L 'autorite administrative pour l'industrie et le commerce a le pouvoir d'ordonner a !'auteur de la violation qu'il cesse immediatement l 'acte incrimine et qu' il indemnise celui dont le droit a ete viole pour les dommages subis. Le montant de l 'indemnite est equivalent soit au profit tire par !'auteur de la violation, grace a celle-ci, pendant la duree de la. violation, soit aux dommages subis, en raison de Ia violation et pendant la duree de celle-ci, par la personne dont le droit a ete viole. Lorsque la violation du droit exclusif d'utiliser une marque enregistree n'est pas suffisamment grave pour constituer un crime, l'autorite administrative pour l'industrie et le commerce peut infliger une amende. Toute personne interessee qui n' est pas satis- faite de Ia decision prise par l'autorite administrative pour l'industrie et le commerce consistant a faire cesser l'acte de violation ou a infliger une amende a son auteur peut intenter une action aupres du tribunal du peuple dans un delai de 15 jours a compter de la date de reception de la notification. En cas de violation du droit exclusif d'utiliser une marque enregistree, la partie dont le droit a ete viole peut intenter une action directement aupres du tribunal du peuple.

40. Outre l'indemnite due a la personne dont le droit a ete viole pour les dommages qu'elle a subis, quiconque fait passer pour sienne une marque enregistree appartenant a un tiers fera, si !'infraction est suffisamment grave pour constituer un crime, !'objet de poursuites penales confor- mement a la loi.

Chapitre VIII Dispositions complementaires

41. Toute demande d'enregistrement d'une marque et toute autre procedure en matiere de marques donne lieu au paiement de la taxe prescrite. Le bareme des taxes est etabli separement.

42. Le reglement d'application de la presente loi sera etabli par l'autorite administrative pour l'industrie et le commerce subordonnee au Conseil d'Etat. II entrera· en vigueur apres avoir ete soumis au Conseil d'Etat et approuve par lui.

43. La presente loi entre en vigueur le 1er mars 1983. Le «Reglement sur les marques de fabrique et de commerce» promulgue par le Conseil d'Etat le 10 avril 1963 est abroge a Ia meme date, et toutes les autres dispo- sitions relatives aux marques, si elles sont contraires a la presente loi, cessent d'etre applicables a cette meme date.

Les marques enregistrees avant !'entree en vigueur de la presente loi demeurent valables.

第一章

第一条 根据《中华人民共和国专利法》(以下简称专利法),制定本 细则。

第二条 专利法所称发明,是指对产品、方法或者其改进所提出的新 的技术方案。

专利法所称实用新型,是指对产品的形状、构造或者其结合所提出的 适于实用的新的技术方案。

专利法所称外观设计,是指对产品的形状、图案、色彩或者其结合所 作出的富有美感并适于工业上应用的新设计。

第三条 专利法和本细则规定的各种手续,应当以书面形式办理。

第四条 依照专利法和本细则规定提交的各种文件应当使用中文。国 家有统一规定的科技术语,应当采用规范词。外国人名、地名和科技术语 没有统一中文译文的,应当注明原文。

依照专利法和本细则规定提交的各种证件和证明文件是外文的,专利 局认为必要时,可以要求当事人在指定期限内附送中文译文;期满未附送 的,视为未提交该证件和证明文件。

第五条 向专利局邮寄的各种文件,以寄出的邮戳日为递交日。信封 上寄出的邮戳日不清晰的,除当事人能够提出证明外,以专利局收到日为 递交日。

专利局的各种文件,可以通过邮寄、直接送交或者以公告的方式送达 当事人。当事人委托专利代理机构的,文件送交专利代理机构;未委托专 利代理机构的,文件送交请求书中第一署名人或者代表人。当事人拒绝接 收文件的,该文件视为已经送达。

专利局邮寄的各种文件,自文件发出之日起满十五日,推定为当事人 收到文件之日。

根据专利局规定应当直接送交的文件,以交付日为送达日。

文件送交地址不清,无法邮寄的,可以通过公告的方式送达当事人。 自公告之日起满一个月,该文件视为已经送达。

第六条 专利法和本细则规定的各种期限的第一日不计算在期限内。 期限以年或者月计算的,以其最后一月的相应日为期限届满日;该月无相 应日的,以该月最后一日为期限届满日。

期限届满日是法定节假日的,以节假日后的第一个工作日为期限届满 日。

第七条 当事人因不可抗拒的事由而耽误专利法或者本细则规定的期 限或者专利局指定的期限,造成其权利丧失的,自障碍消除之日起二个月 内,但是最迟自期限届满之日起二年内,可以向专利局说明理由并附具有 关证明文件,请求恢复其权利。

当事人因正当理由而耽误专利法或者本细则规定的期限或者专利局指 定的期限,造成其权利丧失的,可以自收到专利局的通知之日起二个月内 向专利局说明理由,请求恢复其权利。

当事人请求延长专利局指定的期限的,应当在期限届满前,向专利局 说明理由并办理有关手续。

本条第一款和第二款的规定不适用专利法第二十四条、第二十九条、 第四十一条、第四十五条、第六十一条规定的期限。

本条第二款的规定不适用本细则第八十八条规定的期限。

第八条 国防系统各单位申请发明专利,涉及国防方面的国家秘密需 要保密的,其专利申请由国务院国防科学技术主管部门设立的专利机构受 理;专利局受理的涉及国防方面的国家秘密需要保密的发明专利申请,应 当移交国务院国防科学技术主管部门设立的专利机构审查,由专利局根据 该专利机构的审查意见作出决定。

除前款规定外,专利局受理发明专利申请后,应当将需要进行保密审 查的申请转送国务院有关主管部门审查;有关主管部门应当自收到该申请 之日起四个月内,将审查结果通知专利局;需要保密的,由专利局按照保 密专利申请处理,并且通知申请人。

第九条 除专利法第二十八条和第四十五条的规定外,专利法所称申 请日,有优先权的,指优先权日。

本细则所称申请日,是指向专利局提出专利申请之日。

第十条 专利法第六条所称执行本单位的任务所完成的职务发明创造 是指:

()在本职工作中作出的发明创造;

()履行本单位交付的本职工作之外的任务所作出的发明创造;

()退职、退休或者调动工作后一年内作出的,与其在原单位承担的 本职工作或者原单位分配的任务有关的发明创造。

专利法第六条所称本单位的物质条件,是指本单位的资金、设备、零 部件、原材料或者不对外公开的技术资料等。

第十一条 专利法所称发明人或者设计人,是指对发明创造的实质性 特点作出创造性贡献的人。在完成发明创造过程中,只负责组织工作的人 、为物质条件的利用提供方便的人或者从事其他辅助工作的人,不应当被 认为是发明人或者设计人。

第十二条 同样的发明创造只能被授予一项专利。

专利法第九条规定的两个以上的申请人在同一日分别就同样的发明创 造申请专利的,应当在收到专利局的通知后自行协商确定申请人。

第十三条 专利权人与他人订立的专利实施许可合同,应当自合同生 效之日起三个月内向专利局备案。

第十四条 专利法第十九条第一款和第二十条规定的专利代理机构由 国务院授权专利局指定。

第十五条 对一项发明创造的专利申请权或者被授予的专利权发生争 议时,当事人可以请求专利管理机关处理,也可以直接向人民法院提起诉 讼。

当事人因专利申请权或者专利权发生纠纷,并已请求专利管理机关处 理或者向人民法院提起诉讼的,可以请求专利局中止有关程序。

依照前款规定请求中止有关程序的,应当向专利局提交请求书,并附 具专利管理机关或者人民法院的有关受理文件。

第二章 专利的申请

第十六条 申请专利的,应当向专利局提交申请文件一式两份。

申请人委托专利代理机构向专利局申请专利和办理其他专利事务的, 应当同时提交委托书,写明委托权限。

第十七条 专利法第二十六条第二款所称请求书中的其他事项是指:

()申请人的国籍;

()申请人是企业或者其他组织的,其总部所在的国家;

()申请人委托专利代理机构的,应当注明的有关事项;

()要求优先权的,应当注明的有关事项;

()申请人或者专利代理机构的签字或者盖章;

()申请文件清单;

()附加文件清单;

()其他需要注明的有关事项。

申请人有两个以上而未委托专利代理机构的,应当指定一人为代表人

第十八条 发明或者实用新型专利申请的说明书应当按照下列方式和 顺序撰写:

()发明或者实用新型的名称,该名称应当与请求书中的名称一致;

()发明或者实用新型所属技术领域;

()就申请人所知,写明对发明或者实用新型的理解、检索、审查有 用的背景技术,并且引证反映这些背景技术的文件;

()发明或者实用新型的目的;

()写明要求保护的发明或者实用新型的技术方案,使所属技术领域 的技术人员能够理解,并且能够达到发明或者实用新型的目的;

()发明或者实用新型与背景技术相比所具有的有益的效果;

()有附图的,应当有图面说明;

()详细描述申请人认为实现发明或者实用新型的最好方式,在适当 的情况下,应当举例说明;有附图的,应当对照附图。

发明或者实用新型专利申请人应当按照前款规定的方式和顺序撰写说 明书,除非其发明或者实用新型的性质用其他方式或者顺序撰写能节约说 明书的篇幅并使他人能更好地理解其发明或者实用新型。

发明或者实用新型说明书中不得使用如权利要求……所述的……” 一类的引用语,也不得使用商业性宣传用语。

第十九条 发明或者实用新型的几幅附图可以绘在一张图纸上,附图 应当按照1,图2……”顺序编号排列。

附图的大小及清晰度,应当保证在该图缩小到2/3时,仍能清楚地分辨 出图中的各个细节。

发明或者实用新型说明书文字部分中未提及的附图标记不得在附图中 出现,附图中未出现的附图标记不得在说明书文字部分中提及。申请文件 中表示同一组成部分的附图标记应当一致。

附图中除必需的词语外,不应当含有其他注释。

第二十条 权利要求书应当说明发明或者实用新型的技术特征,清楚 并简要地表述请求保护的范围。

权利要求书有几项权利要求的,应当用阿拉伯数字顺序编号。

权利要求书中使用的科技术语应当与说明书中使用的科技术语一致, 可以有化学式或者数学式,但是不得有插图。除绝对必要的外,不得使用如说明书……部分所述或者如图……所示的用语。

权利要求中的技术特征可以引用说明书附图中相应的标记,该标记应 当放在相应的技术特征后面,并置于括号内,以利于理解权利要求。附图 标记不得解释为对权利要求的限制。

第二十一条 权利要求书应当有独立权利要求,也可以有从属权利要 求。

独立权利要求应当从整体上反映发明或者实用新型的技术方案,记载 为达到发明或者实用新型目的的必要技术特征。

从属权利要求应当用要求保护的附加技术特征,对引用的权利要求作 进一步的限定。

第二十二条 发明或者实用新型的独立权利要求应当包括前序部分和 特征部分,按照下列规定撰写:

()前序部分:写明发明或者实用新型要求保护的主题名称和发明或 者实用新型主题与现有技术共有的必要技术特征;

()特征部分:使用其特征是……”或者类似的用语,写明发明或 者实用新型区别于现有技术的技术特征。这些特征和前序部分写明的特征 合在一起,限定发明或者实用新型要求保护的范围。

发明或者实用新型的性质不适合用前款方式表达的,独立权利要求可 以用其他方式撰写。

一项发明或者实用新型应当只有一个独立权利要求,并写在同一发明 或者实用新型的从属权利要求之前。

第二十三条 发明或者实用新型的从属权利要求应当包括引用部分和 限定部分,按照下列规定撰写:

()引用部分:写明引用的权利要求的编号及其主题名称;

()限定部分:写明发明或者实用新型附加的技术特征。

引用一项或者两项以上权利要求的从属权利要求,只能引用在前的权 利要求。引用两项以上权利要求的多项从属权利要求,不得作为另一项多 项从属权利要求的基础。

第二十四条 摘要应当写明发明或者实用新型所属的技术领域、需要 解决的技术问题、主要技术特征和用途。摘要可以包含最能说明发明的化 学式。有附图的专利申请,应当由申请人指定并提供一幅最能说明该发明 或者实用新型技术特征的附图。附图的大小及清晰度应当保证在该图缩小 4厘米×6厘米时,仍能清楚地分辨出图中的各个细节。摘要文字部分不 得超过200个字。摘要中不得使用商业性宣传用语。

第二十五条 申请专利的发明涉及新的微生物、微生物学方法或者其 产品,而且使用的微生物是公众不能得到的,除该申请应当符合专利法和 本细则的有关规定外,申请人并应当办理下列手续:

()在申请日前或者最迟在申请日,将该微生物菌种提交专利局指定 的微生物菌种保藏单位保藏,并在申请时或者最迟自申请日起三个月内提 交保藏单位出具的保藏证明和存活证明;期满未提交证明的,该菌种被视 为未提交保藏;

()在申请文件中,提供有关微生物特征的资料;

()涉及微生物菌种保藏的专利申请应当在请求书和说明书中写明该 微生物的分类命名(注明拉丁文名称)、保藏该微生物菌种的单位名称、地 址、保藏日期和保藏编号;申请时未写明的,应当自申请日起三个月内补 正;期满未补正的,该菌种被视为未提交保藏。

第二十六条 有关微生物的发明专利申请公布后,任何单位或者个人 需要将专利申请所涉及的微生物作为实验目的使用的,应当向专利局提出 请求,并写明下列事项:

()请求人的姓名或者名称和地址;

()不向其他任何人提供菌种的保证;

()在授予专利权之前,只作为实验目的使用的保证。

第二十七条 依照专利法第二十七条规定提交的外观设计的图片或者 照片,不得小于3厘米×8厘米,也不得大于15厘米×22厘米。

同时请求保护色彩的外观设计专利申请,应当提交彩色和黑白的图片 或者照片各一份。

申请人应当就每件外观设计产品所需要保护的内容提交有关视图或者 照片,以清楚地显示请求保护的对象。

第二十八条 申请外观设计专利的,必要时应当写明对外观设计的简 要说明。

外观设计的简要说明应当写明使用该外观设计的产品的主要创作部位 、请求保护色彩、省略视图等情况。简要说明不得使用商业性宣传用语, 也不能用来说明产品的性能和用途。

第二十九条 专利局认为必要时,可以要求外观设计专利申请人提交 使用外观设计的产品样品或者模型。样品或者模型的体积不得超过30厘米 ×30厘米×30厘米,重量不得超过15公斤。易腐、易损或者危险品不得作 为样品或者模型提交。

第三十条 专利法第二十二条第三款所称已有的技术,是指申请日前 在国内外出版物上公开发表、在国内公开使用或者以其他方式为公众所知 的技术,即现有技术。

第三十一条 专利法第二十四条第二项所称学术会议或者技术会议, 是指国务院有关主管部门或者全国性学术团体组织召开的学术会议或者技 术会议。

专利申请有专利法第二十四条第一项或者第二项所列情形的,申请人 应当在提出专利申请时声明,并自申请日起二个月内,提交有关国际展览 会或者学术会议、技术会议的组织单位出具的有关发明创造已经展出或者 发表,以及展出或者发表日期的证明文件。

专利申请有专利法第二十四条第三项所列情形的,专利局认为必要时 可以要求申请人提出证明文件。

第三十二条 申请人依照专利法第三十条的规定办理要求优先权手续 的,应当在书面声明中写明第一次提出的专利申请(以下称在先申请)的申 请日、申请号和受理该申请的国家;书面声明中未写明在先申请的申请日 和受理该申请的国家的,视为未提出声明。

要求外国优先权的,申请人提交的在先申请文件副本应当经该国受理 机关证明;要求本国优先权的,申请人提交的在先申请文件副本应当由专 利局制作。

第三十三条 申请人在一件专利申请中,可以要求一项或者多项优先 权;要求多项优先权的,该申请的优先权期限从最早的优先权日起算。

申请人要求本国优先权的,如果在先申请是发明专利申请,可以就相 同主题提出发明或者实用新型专利申请;如果在先申请是实用新型专利申 请,可以就相同主题提出实用新型或者发明专利申请。但是,提出后一申 请时,在先申请有下列情形之一的,不得作为要求本国优先权的基础:

()已经要求过外国或者本国优先权的;

()已经被批准授予专利权的;

()属于按照规定提出的分案申请的。

申请人要求本国优先权时,其在先申请自后一申请提出之日起即被视 为撤回。

第三十四条 在中国没有经常居所或者营业所的申请人,申请专利或 者要求外国优先权的,专利局认为必要时,可以要求其提供下列文件:

()国籍证明;

()申请人是企业或者其他组织的,其营业所或者总部所在地的证明 文件;

()外国人、外国企业、外国其他组织的所属国,承认中国公民和单 位可以按照该国国民的同等条件,在该国享有专利权、优先权和其他与专 利有关的权利的证明文件。

第三十五条 依照专利法第三十一条第一款规定,可以作为一件专利 申请提出的属于一个总的发明构思的两项以上的发明或者实用新型,应当 在技术上相互关联,包含一个或者多个相同或者相应的特定技术特征,其 中特定技术特征是指每一项发明或者实用新型作为整体考虑,对现有技术 作出贡献的技术特征。符合前款规定的两项以上发明专利申请的权利要求 ,可以是下列各项之一:

()不能包括在一项权利要求内的两项以上产品或者方法的同类独立 权利要求;

()产品和专用于制造该产品的方法的独立权利要求;

()产品和该产品的用途的独立权利要求;

()产品、专用于制造该产品的方法和该产品的用途的独立权利要求

()产品、专用于制造该产品的方法和为实施该方法而专门设计的设 备的独立权利要求;

()方法和为实施该方法而专门设计的设备的独立权利要求。

符合本条第一款规定的两项以上实用新型专利申请的权利要求,可以 是不能包括在一项权利要求内的两项以上产品的独立权利要求。

第三十六条 专利法第三十一条第二款所称同一类别,是指产品属于 分类表中同一个小类;成套出售或者使用,是指各产品的设计构思相同, 并且习惯上是同时出售、同时使用。

依照专利法第三十一条第二款规定将两项以上外观设计作为一件申请 提出的,应当将各件外观设计顺序编号标在每件使用外观设计产品的视图 名称的前面。

第三十七条 申请人撤回专利申请的,应当向专利局提出声明,写明 发明创造的名称、申请号和申请日。

撤回专利申请的声明是在专利局作好公布专利申请文件的印刷准备工 作后提出的,申请文件仍予公布。

第三章 专利申请的审查和批准

第三十八条 在初步审查、实质审查、复审、撤销和无效宣告程序中 进行审查和审理的人员有下列情形之一的,应当自行回避,当事人或者其 他利害关系人可以要求其回避:

()是当事人或者其代理人的近亲属的;

()与专利申请或者专利权有利害关系的;

()与当事人或者其代理人有其他关系,可能影响公正审查和审理的

专利复审委员会成员曾参与原申请的审查的,适用前款的规定。

审查和审理人员的回避,由专利局决定。

第三十九条 专利局收到发明或者实用新型专利申请的请求书、说明 (实用新型必须包括附图)和权利要求书,或者外观设计专利申请的请求 书和外观设计的图片或者照片后,应当明确申请日、给予申请号,并且通 知申请人。

第四十条 专利申请文件有下列情形之一的,专利局不予受理,并且 通知申请人:

()发明或者实用新型专利申请缺少请求书、说明书(实用新型无附图 )和权利要求书的,或者外观设计专利申请缺少请求书、图片或者照片的;

()未使用中文的;

()不符合本细则第九十四条第一款规定的;

()请求书中缺少申请人姓名或者名称及地址的;

()明显不符合专利法第十八条或者第十九条第一款的规定的;

()专利申请类别(发明、实用新型或者外观设计)不明确或者无法确 定的。

第四十一条 说明书中写有对附图的说明但无附图或者缺少部分附图 的,申请人应当在专利局指定的期限内补交附图或者声明取消对附图的说 明。申请人补交附图的,以向专利局提交或者邮寄附图之日为申请日;取 消对附图的说明的,保留原申请日。

第四十二条 一件专利申请包括两项以上发明、实用新型或者外观设 计的,申请人可以在专利局发出授予专利权的通知前,向专利局提出分案 申请。

专利局认为一件专利申请不符合专利法第三十一条和本细则第三十五 条的规定的,应当通知申请人在指定期限内对其申请进行修改;申请人期 满未答复的,该申请被视为撤回。

分案的申请不得改变原申请的类别。

第四十三条 依照本细则第四十二条规定提出的分案申请,可以保留 原申请日,享有优先权的,可以保留优先权日,但是不得超出原申请公开 的范围。

分案申请应当依照专利法及本细则的规定办理各种手续。

分案申请的请求书中应当写明原申请的申请号和申请日。提交分案申 请时,申请人应当提交原申请文件副本;原申请享有优先权的,并应当提 交原申请的优先权文件副本。

第四十四条 专利法第三十四条和第四十条所称初步审查,是指审查 专利申请是否具备专利法第二十六条或者第二十七条规定的文件和其他必 要的文件,这些文件是否符合规定的格式;并包括审查下列各项:

()发明专利申请是否明显属于专利法第五条、第二十五条的规定的 ,或者不符合专利法第十八条、第十九条第一款的规定的,或者明显不符 合专利法第三十一条第一款、第三十三条或者本细则第二条第一款的规定 的;

()实用新型专利申请是否明显属于专利法第五条、第二十五条的规 定的,或者不符合专利法第十八条、第十九条第一款的规定的,或者明显 不符合专利法第三十一条第一款、第三十三条、本细则第二条第二款、第 十二条第一款、第十八条至第二十三条的规定的,或者依照专利法第九条 规定不能取得专利权的;

()外观设计专利申请是否明显属于专利法第五条规定的,或者不符 合专利法第十八条、第十九条第一款的规定的,或者明显不符合专利法第 三十一条第二款、第三十三条、本细则第二条第三款、第十二条第一款的 规定的,或者依照专利法第九条规定不能取得专利权的。

专利局应当将审查意见通知申请人,要求其在指定期限内陈述意见或 者补正;申请人期满未答复的,其申请被视为撤回。申请人陈述意见或者 补正后,专利局仍然认为不符合前款所列各项规定的,应当予以驳回。

第四十五条 除专利申请文件外,申请人向专利局提交的与专利申请 有关的其他文件,有下列情形之一的,被视为未提出:

()未使用规定的格式或者填写不符合规定的;

()未按照规定提交证明材料的。

专利局应当将视为未提出的审查意见通知申请人。

第四十六条 申请人请求早日公布其发明专利申请的,应当向专利局 声明。专利局对该申请进行初步审查后,除予以驳回的外,应当立即将申 请予以公布。

第四十七条 申请人依照专利法第二十七条规定写明使用外观设计的 产品及其所属类别时,应当使用专利局公布的外观设计产品分类表。未写 明使用外观设计的产品所属类别或者所写的类别不确切的,专利局可以予 以补充或者修改。

第四十八条 自发明专利申请公布之日起至公告授予专利权之日前, 任何人均可以对不符合专利法规定的专利申请向专利局提出意见,并说明 理由。

第四十九条 发明专利申请人因有正当理由无法提交专利法第三十六 条规定的检索资料或者审查结果资料的,应当向专利局声明,并在得到该 项资料后补交。

第五十条 专利局依照专利法第三十五条第二款规定对专利申请自行 进行审查时,应当通知申请人。

第五十一条 发明专利申请人在提出实质审查请求或者在对专利局第 一次实质审查意见作出答复时,可以对发明专利申请主动提出修改。

实用新型或者外观设计专利申请人自申请日起三个月内,可以对实用 新型或者外观设计专利申请主动提出修改。

第五十二条 发明或者实用新型专利申请的说明书或者权利要求书的 修改部分,除个别文字修改或者增删外,应当按照规定格式提交替换页。 外观设计专利申请的图片或者照片的修改,应当按照规定提交替换页。

第五十三条 依照专利法和本细则规定,发明专利申请经实质审查应 当予以驳回的情形是指:

()申请不符合本细则第二条第一款规定的;

()申请属于专利法第五条、第二十五条的规定的,或者不符合专利 法第二十二条、本细则第十二条第一款的规定的,或者依照专利法第九条 规定不能取得专利权的;

()申请不符合专利法第二十六条第三款、第四款或者第三十一条第 一款的规定的;

()申请的修改或者分案的申请超出原说明书和权利要求书记载范围 的。

第五十四条 专利局发出授予专利权的通知后,申请人应当自收到通 知之日起二个月内办理登记手续。申请人按期办理登记手续的,专利局应 当授予专利权,颁发专利证书,并予以公告。专利权自颁发专利证书之日 起生效。

期满未办理登记手续的,视为放弃取得专利权的权利。

第五十五条 依照专利法第四十一条规定,对专利局公告授予的专利 权,可以提出撤销的理由是指:

()授予专利权的发明和实用新型不符合专利法第二十二条规定的;

()授予专利权的外观设计不符合专利法第二十三条规定的。

第五十六条 依照专利法第四十一条规定请求专利局撤销专利权的, 应当提交撤销专利权请求书和有关文件一式两份,说明请求撤销专利权所 依据的事实和理由。

专利局对撤销专利权的请求作出决定前,撤销专利权请求人可以撤回 其请求。

第五十七条 专利局收到撤销专利权请求书后,应当进行审查。对不 符合规定的撤销专利权请求书,应当通知撤销专利权请求人在指定的期限 内补正;期满未补正的,该撤销专利权的请求被视为未提出。

撤销专利权请求书中未写明撤销专利权所依据的事实和理由或者提出 的理由不符合本细则第五十五条规定的,专利局不予受理。

专利局应当将受理的撤销专利权请求书的副本和有关文件的副本送交 专利权人,要求其在指定的期限内陈述意见,专利权人可以修改专利文件 ,但是不得扩大原专利保护的范围;期满未答复的,不影响专利局审查。

第五十八条 专利复审委员会由专利局指定有经验的技术专家和法律 专家组成,主任委员由专利局局长兼任。

第五十九条 依照专利法第四十三条第一款的规定向专利复审委员会 请求复审的,应当提交复审请求书,说明理由并附具有关的证明文件。请 求书和证明文件应当一式两份。

申请人或者专利权人请求复审时,可以修改被驳回的专利申请或者被 撤销的专利文件,但是修改应当仅限于驳回申请的决定或者撤销专利权的 决定所涉及的部分。

第六十条 复审请求书不符合规定格式的,复审请求人应当在专利复 审委员会指定的期限内补正;期满未补正的,该复审请求被视为未提出。

第六十一条 专利复审委员会应当将受理的复审请求书转交专利局原 审查部门进行审查。原审查部门根据复审请求人的请求,同意撤销原决定 的,专利复审委员会应当据此作出复审决定,并通知复审请求人。

第六十二条 专利复审委员会进行复审后,认为复审请求不符合专利 法规定的,应当通知复审请求人,要求其在指定期限内陈述意见;期满未 答复的,该复审请求被视为撤回。

第六十三条 复审请求人在专利复审委员会作出决定前,可以撤回其 复审请求。

第六十四条 专利局对专利申请文件中的发明创造名称、摘要或者请 求书的明显错误可以予以修改,并通知申请人。

专利局对专利公报和发出的文件中出现的错误,一经发现,应当及时 更正。

第四章 专利权的无效宣告

第六十五条 依照专利法第四十八条的规定,请求宣告专利权无效或 者部分无效的,应当向专利复审委员会提交专利权无效宣告请求书和有关 文件一式两份,说明所依据的事实和理由。

专利复审委员会对无效宣告的请求作出决定前,无效宣告请求人可以 撤回其请求。

第六十六条 专利权无效宣告请求书不符合规定格式的,无效宣告请 求人应当在专利复审委员会指定的期限内补正;期满未补正的,该无效宣 告请求被视为未提出。

无效宣告请求的理由是指被授予专利权的发明创造不符合专利法第二 十二条、第二十三条、第二十六条第三款、第四款、第三十三条或者本细 则第二条、第十二条第一款的规定的,或者属于专利法第五条、第二十五 条的规定的,或者依照专利法第九条规定不能取得专利权的。

专利权无效宣告请求书中未说明所依据的事实和理由或者所提出的理 由不符合本条第二款规定的,或者在已提出的撤销专利权请求尚未作出决 定前又请求无效宣告的,或者就撤销专利权请求、无效宣告请求已作出的 决定,又以同一的事实和理由请求无效宣告的,专利复审委员会不予受理

第六十七条 专利复审委员会应当将专利权无效宣告请求书的副本和 有关文件的副本送交专利权人,要求其在指定的期限内陈述意见,专利权 人可以修改专利文件,但是不得扩大原专利保护的范围;期满未答复的, 不影响专利复审委员会审理。

第五章 专利实施的强制许可

第六十八条 自专利权被授予之日起满三年后,任何单位均可以依照 专利法第五十一条的规定,请求专利局给予强制许可。

请求强制许可的,应当向专利局提交强制许可请求书,说明理由并附 具有关证明文件各一式两份。

专利局应当将强制许可请求书的副本送交专利权人,专利权人应当在 专利局指定的期限内陈述意见;期满未答复的,不影响专利局作出关于强 制许可的决定。

在国家出现紧急状态或者非常情况时,或者为了公共目的的非商业性 使用的情况下,专利局可以给予强制许可。

专利局作出的给予实施强制许可的决定,应当依据强制许可的理由规 定实施的范围和时间,并限定强制许可实施主要为供应国内市场的需要。

专利局作出的给予实施强制许可的决定,应当尽快通知专利权人,并 予以登记和公告。强制许可的理由消除或者不再发生时,专利局可以根据 专利权人的请求,对这种情况进行审查,终止实施强制许可。

第六十九条 依照专利法第五十七条规定请求专利局裁决使用费数额 的,当事人应当提出裁决请求书,并附具双方不能达成协议的证明文件。 专利局应当自收到请求书之日起三个月内作出裁决,并通知当事人。

第六章 对职务发明创造的发明人或者设计人的奖励

第七十条 专利法第十六条所称奖励,包括发给发明人或者设计人的 奖金和报酬。

第七十一条 专利权被授予后,专利权的持有单位应当对发明人或者 设计人发给奖金。一项发明专利的奖金最低不少于200元;一项实用新型专 利或者外观设计专利的奖金最低不少于50元。

由于发明人或者设计人的建议被其所属单位采纳而完成的发明创造, 专利权被授予后,专利权的持有单位应当从优发给奖金。

发给发明人或者设计人的奖金,企业单位可以计入成本,事业单位可 以从事业费中列支。

第七十二条 专利权的持有单位在专利权的有效期限内,实施发明创 造专利后,每年应当从实施发明或者实用新型所得利润纳税后提取o5 -2%,或者从实施外观设计所得利润纳税后提取005-˜0%,作 为报酬支付发明人或者设计人;或者参照上述比例,发给发明人或者设计 人一次性报酬。

第七十三条 发明创造专利权的持有单位许可其他单位或者个人实施 其专利的,应当从收取的使用费中纳税后提取5-10%作为报酬支付发明 人或者设计人。

第七十四条 本细则规定的报酬,一律从制造专利产品、使用专利方 法所获得的利润和收取的使用费中列支,不计入单位的奖金总额,不计征 奖金税。但是,发明人或者设计人的个人所得,应当依法纳税。

第七十五条 本章关于奖金和报酬的规定,集体所有制单位和其他企 业可以参照执行。

第七章 专利管理机关

第七十六条 专利法和本细则所称专利管理机关,是指国务院有关主 管部门或者地方人民政府设立的专利管理机关。

第七十七条 对于在发明专利申请公布后、专利权授予前使用发明而 未支付适当费用的单位或者个人,在专利权授予后,专利权人可以请求专 利管理机关处理,也可以直接向人民法院提起诉讼。专利管理机关处理时 ,有权决定该单位或者个人在指定的期限内支付适当的费用。当事人对专 利管理机关的决定不服的,可以向人民法院提起诉讼。

发明人或者设计人与其所在单位对其发明创造是否属于职务发明创造 以及对职务发明创造是否提出专利申请有争议的,或者专利权的所有单位 或者持有单位对职务发明创造的发明人或者设计人没有依法发给奖金或者 支付报酬的,发明人或者设计人可以请求上级主管部门或者单位所在地的 专利管理机关处理。

请求专利管理机关处理专利纠纷的时效为两年,自专利权人或者利害 关系人得知或者应当得知之日起计算。

第七十八条 依照专利法第六十三条第二款的规定,对将非专利产品 冒充专利产品的或者将非专利方法冒充专利方法的,专利管理机关可以视 情节,责令停止冒充行为,消除影响,并处以1000元至5万元或者非法所得 13倍的罚款。

第七十九条 属于跨部门或者跨地区的侵权纠纷,当事人请求专利管 理机关处理的,由发生侵权行为地的专利管理机关或者侵权单位上级主管 部门的专利管理机关处理。

第八章 专利登记和专利公报

第八十条 专利局设置专利登记簿,登记下列专利权有关事项:

()专利权的授予;

()专利权的转让和继承;

()专利权的撤销和无效宣告;

()专利权的终止;

()专利权的恢复;

()专利实施的强制许可;

()专利权人的姓名或者名称、国籍和地址的变更。

第八十一条 专利局定期出版专利公报,公布或者公告下列内容:

()专利申请中记载的著录事项;

()发明或者实用新型说明书的摘要,外观设计的图片或者照片及其 简要说明;

()发明专利申请的实质审查请求和专利局对发明专利申请自行进行 实质审查的决定;

()保密专利的解密;

()发明专利申请公布后的驳回、撤回和视为撤回;

()发明专利申请公布后的专利申请权转让和继承;

()专利权的授予;

()专利权的撤销和无效宣告;

()专利权的终止;

()专利权的转让和继承;

(十一)专利实施的强制许可的给予;

(十二)专利申请或者专利权的恢复;

(十三)专利权人的姓名或者名称、地址的变更;

(十四)对地址不明的申请人的通知;

(十五)其他有关事项。

发明或者实用新型的说明书及其附图、权利要求书另行全文出版。

第九章

第八十二条 向专利局申请专利和办理其他手续时,应当缴纳下列费 用:

()申请费、申请维持费;

()审查费、复审费;

()年费;

()著录事项变更费、优先权要求费、恢复权利请求费、撤销请求费 、无效宣告请求费、强制许可请求费、强制许可使用费的裁决请求费,专 利登记费以及规定的附加费。

前款所列各种费用的数额,由国务院有关主管部门会同专利局另行规 定。

第八十三条 专利法和本细则规定的各种费用,可以直接向专利局缴 纳,也可以通过邮局或者银行汇付,但是不得使用电汇。

通过邮局或者银行汇付的,应当写明申请号或者专利号、申请人或者 专利权人的姓名或名称、费用名称及发明创造名称。

通过邮局或者银行汇付的,以汇出日为缴费日。但是,自汇出日至专 利局收到日超过十五日的,除邮局、银行出具证明外,以专利局收到日为 缴费日。

不符合本条第二款规定的,视为未办理缴费手续。

多缴、重缴、错缴专利费用的,当事人可以向专利局提出退款请求, 但是该请求应当自缴费日起一年内提出。

第八十四条 申请人应当在收到受理通知书后,最迟自申请之日起二 个月内缴纳申请费;期满未缴纳或者未缴足的,其申请被视为撤回。

申请人要求优先权的,应当在缴纳申请费的同时缴纳优先权要求费; 期满未缴纳或者未缴足的,视为未要求优先权。

第八十五条 当事人请求实质审查、恢复权利、复审或者请求撤销专 利权的,应当在专利法及本细则规定的相关期限内缴纳费用;期满未缴纳 或者未缴足的,视为未提出请求。

第八十六条 发明专利申请人自申请日起满二年尚未被授予专利权的 ,自第三年度起每年缴纳申请维持费。第一次申请维持费应当在第三年度 的第一个月内缴纳,以后的申请维持费应当在前一年度期满前一个月内预 缴。

第八十七条 申请人办理登记手续时,应当缴纳专利登记费和授予专 利权当年的年费。授予专利权当年已缴纳申请维持费的,不再缴纳当年的 年费。期满未缴纳费用的,视为未办理登记手续。以后的年费应当在前一 年度期满前一个月内预缴。

第八十八条 申请人或者专利权人未按时缴纳申请维持费或者授予专 利权当年以后的年费,或者缴纳的数额不足的,专利局应当通知申请人自 应当缴纳申请维持费或者年费期满之日起六个月内补缴,同时缴纳金额为 申请维持费或者年费的25%滞纳金;期满未缴纳的,自应当缴纳申请维持 费或者年费期满日起,其申请被视为撤回或者专利权终止。

第八十九条 著录事项变更费、强制许可请求费、强制许可使用费的 裁决请求费、无效宣告请求费应当自提出请求之日起一个月内,按照规定 缴纳;期满未缴纳或者未缴足的,视为未提出请求。

第九十条 申请专利和办理其他手续,缴纳本细则第八十二条规定的 各种费用有困难的,可以按照规定向专利局提出减缴或者缓缴的请求。减 缴或者缓缴的办法由专利局另行规定。

第十章

第九十一条 任何人经专利局同意后,均可以查阅或者复制已经公布 或者公告的专利申请的案卷和专利登记簿。任何人均可以请求专利局出具 专利登记簿副本。

已被视为撤回、驳回和主动撤回的专利申请的案卷,自该专利申请失 效之日起满二年后不予保存。

已被撤销、放弃、无效宣告和终止的专利权的案卷自该专利权失效之 日起满三年后不予保存。

第九十二条 向专利局提交申请文件或者办理各种手续,应当使用专 利局制定的统一格式,由申请人、专利权人、其他利害关系人或者其代表 人签字或者盖章;委托专利代理机构的,由专利代理机构盖章。

请求变更发明人姓名、专利申请人和专利权人的姓名或者名称、国籍 和地址、专利代理机构的名称和代理人姓名的,应当向专利局办理著录事 项变更手续,并附具变更理由的证明材料。

第九十三条 向专利局邮寄有关申请或者专利权的文件,应当使用挂 号信函,不得使用包裹。

除首次提交申请文件外,向专利局提交各种文件、办理各种手续时, 应当标明申请号或者专利号、发明创造名称和申请人或者专利权人姓名或 者名称。

一件信函中应当只包含同一申请的文件。

第九十四条 各类申请文件应当打字或者印刷,字迹呈黑色,整齐清 晰,不得涂改。附图应当用制图工具和黑色墨水绘制,线条应当均匀清晰 ,不得涂改。

请求书、说明书、权利要求书、附图和摘要应当分别用阿拉伯数字顺 序编号。

申请文件的文字部分应当横向书写。纸张只限单面使用。

第九十五条 本细则由专利局负责解释。

第九十六条 本细则自199311日起施行。

本细则施行前提出的专利申请和根据该申请授予的专利权,适用根据 199294日第七届全国人民代表大会常务委员会第二十七次会议《关于 修改<中华人民共和国专利法>的决定》修改前的专利法的规定和1985 119日国务院批准、1985119日中国专利局发布的《中华人民共和国 专利法实施细则》的相应规定。但是,专利申请在本细则施行前尚未依照 修改以前的专利法第三十九条、第四十条的规定公告的,该专利申请的批 准和专利权的撤销、宣告无效的程序适用修改后的专利法第三十九条至第 四十四条、第四十八条的规定和本细则的相应规定。
