Performers and Broadcasters Rights Order (TRIPS Agreement), 5760−1999
Section 2: Application of the Provisions of the Law
Pursuant to my authority under section 13(b) of the Performers and Broadcasters Rights Law, 5744−1984 (Hereinafter – the Law), and with the approval of the Knessets Constitution, Justice and Law committee under section 48(a) of the Basic Law: the Government and section 2(b) of the Penal Law, 5737−1977, I hereby enact:
1. In this order –
World Trade Organization – The Trade Organization established in the agreement signed at Marrakesh on April 15th 1994;
Foreign performance − a performance performed in a member state;
Member State − a state who is a member in the World Trade Organization;
Phonogram – as defined under the Copyright (Convention for Protection of Producers of Phonograms) Order, 5738-1978.
Application of the Provisions of the Law
2. Regarding foreign performances, the following specified provisions shall apply:
(1) Section 2 –
(a) paragraphs (1), (2)(a) and (4), with regards to a fixation of a performance over a phonogram;
(b) the beginning of paragraph (3), with regards to a live broadcast of a live performance only, and except for subsidiary broadcasting;
(c) Sections 1, 3, 4, 5 to 9, 10, 11 and 14 to 17.
3. This order shall take effect on the 23rd of Tevet, 5760 (January 1st, 2000)
