Details Details Year of Version 2015 Dates Entry into force: January 1, 2009 Adopted: December 25, 2008 Type of Text IP-related Laws Subject Matter Trademarks, Geographical Indications, Trade Names, Competition, Undisclosed Information (Trade Secrets), Copyright and Related Rights (Neighboring Rights), Enforcement of IP and Related Laws, IP Regulatory Body Notes This consolidated version of the Law incorporates amendments up to Law of the Republic of Kazakhstan No. 380-V of October 31, 2015, which came into force on November 23, 2015 (see Section 2, Chapter 2, Article 10 of the consolidated version for the amendments made by the said Law No. 380-V).

The consolidated Law contains provisions, which (i) refer to agreements on granting and (or) on alienation of the exclusive rights on use of results of intellectual activities or the means of individualization of legal entities, goods, works, and services, which are exempted from the prohibition on anti-competitive agreements (Section 2, Chapter 2, Article 10(6)); (ii) enumerates acts of unfair competition relating, among others, to intellectual property rights (Section 2, Chapter 3, Articles 16 to 19, and 28); and (iii) obliges the Anti-monopoly body to keep the confidentially of a commercial secret and to pay the damages caused by its disclosure (Section 3, Chapter 6, Article 43).
