THE LAW OF THE REPUBLIC OF MOLDOVA NO. 65-XV OF APRIL 12, 2001 for completing the Law no. 588-XIII of September 22, 1995 on trademarks and

appellations of origin

The Official Bulletin of the Republic of Moldova no. 55-56/336 of May 24, 2001

The Parliament of the Republic of Moldova shall adopt the present organic law:

Article I: the Law no. 588-XIII of September 22, 1995 on trademarks and appellations of origin (The Official Bulletin of the Republic of Moldova, 1996, no. 8-9, art. 76), with amendments and completions, shall be completed as follows:

1. Article 6: Two new paragraphs (4) and (5) shall be introduced after the paragraph (3) with

the following contents: “ (4) the exclusive right shall not extend to the trademarks, lawfully owned and

used until January 1, 1992 by two or more legal persons. Further use of the mentioned trademarks by these legal persons or their successors in rights shall not be considered as infringement of the owner’s right of the registered trademark.

(5) The trademarks, which lawfully existed and were used until January 1, 1992, by two or more legal persons, are declared by the property of state. The order of their use is determined by the Government in the special regulations.”

paragraph (4) shall be converted into paragraph (6)

2. Article 7: A new paragraph (5) shall be introduced after the paragraph (4) with the

following content: “ (5) Designations, lawfully owned and used until January 1, 1992, by two or

more legal persons, including their successors in rights, shall not be allowed to be registered as trademarks or its elements, for marking goods of the same type (homogenous, similar).”

pentru completarea Legii nr.588­XIII din 22 septembrie 1995 privind mărcile şi denumirile de origine a produselor

Parlamentul adoptă prezenta lege organică.
Articol unic. ­ Legea nr.588­XIII din 22 septembrie 1995 privind mărcile şi denumirile de origine a produselor (Monitorul Oficial al Republicii Moldova,
1996, nr.8­9, art.76), cu modificările şi completările ulterioare, se completează
după cum urmează:
1. Articolul 6:
după alineatul (3) se introduc un nou alineat (4) şi alineatul (5), cu următorul cuprins:

(4) Dreptul exclusiv nu se extinde asupra mărcilor deŃinute şi folosite legal, pînă la 1 ianuarie 1992, de două şi mai multe persoane juridice. Folosirea în continuare de către aceste persoane juridice sau de către succesorii lor de drept a mărcilor menŃionate nu constituie o încălcare a dreptului titularului mărcii înregistrate.

(5) Mărcile existente şi folosite legal pînă la 1 ianuarie 1992 de două şi

mai

multe persoane juridice se declară proprietate a statului.

alineatul (4) devine alineatul (6).
2. Articolul 7:
după alineatul (4) se introduce un nou alineat (5), cu următorul cuprins:

(5) Nu se admite înregistrarea, ca marcă sau elemente ale ei, a semnelor deŃinute şi folosite legal, pînă la 1 ianuarie 1992, de două şi mai multe persoane juridice, inclusiv de succesorii de drept ai acestora, pentru marcarea unor mărfuri de acelaşi tip (omogene, similare).″;

о внесении дополнений в Закон о товарных знаках и наименованиях мест происхождения товаров № 588­XIII от 22 сентября 1995 года

Парламент принимает настоящий органический закон.
В Закон о товарных знаках и наименованиях мест происхождения товаров № 588­XIII от 22 сентября 1995 года (Официальный монитор Республики Молдова, 1996 г., № 8­9, ст.76), с последующими изменениями и дополнениями, внести следующие дополнения:
1. В статье 6:
дополнить статью новой частью (4) и частью (5) следующего содержания:
"(4) Исключительное право не распространяется на товарные знаки, которыми законно владели и пользовались до 1 января 1992 года два и более юридических лица. Использование в дальнейшем указанными лицами или их правопреемниками таких товарных знаков не является нарушением права владельца зарегистрированного товарного знака.
(5) Товарные знаки, которые законно существовали и использовались до 1 января 1992 года двумя и более юридическими лицами, объявляются собственностью государства. Порядок их использования определяется Правительством в специальном положении.";
часть (4) считать частью (6).
2. В статье 7:
дополнить статью новой частью (5) следующего содержания:
"(5) Не допускается регистрация в качестве товарного знака или его эле­
ментов обозначений, которыми законно владели и пользовались до 1 января
1992 года два и более юридических лица, включая их правопреемников, для маркировки однотипных (однородных, подобных) товаров.";
части (5) – (11) считать соответственно частями (6) – (12).
