Details Details Year of Version 2000 Dates Entry into force: February 5, 2000 Published: November 4, 1999 Adopted: October 27, 1999 Type of Text IP-related Laws Subject Matter Enforcement of IP and Related Laws Notes The notification by Turkey to the WTO under article 63.2 of TRIPS states: 'Article 57 of this Law provides a procedure to enable the right holder or his representative to lodge an application for the suspension by the customs authorities of the release into free circulation of counterfeit trademark or pirated copyright goods in accordance with Article 51 of the TRIPS Agreement. The customs authorities are able to carry out this procedure, where solid evidence is available, on their own initiative. In accordance with the legislation on the protection of intellectual property rights, regarding the rights of trademarks, geographical indications and industrial designs, and the rights covered by the Law on Intellectual and Artistic Works, the customs authorities can, upon request or on their own initiative, suspend the customs procedures of the goods infringing the rights of the persons concerned. This Article also provides securing the value of goods in question, liability of the customs authorities, obligation of the right holder to initiate a legal proceeding leading to a decision on the merits of the case or to provide for taking a precautionary measure by a duly empowered authority, destruction or disposal of the goods whose customs procedures have been suspended and the goods excluded from this procedure.' Dünya Ticaret Orgütü aşağıdakileri bildirdi: Isbu Kanunun 57. maddesi hak sahibinin veya temsilcisinin gumruk yetkililerinin askiya aldigi sahte markalı ya da telif hakkına tabi korsan malların serbest dolasimi icin Kanunun 51. maddesine uygun basvuru prosedür saglar. Gümrük idareleri, sağlam kanıtlar mevcutsa kendi inisiyatifleriyle bu proseduru gerçekleştirebilir. Fikri Hakların korunması ile ilgili mevzuata uygun olarak, ticari markalar, coğrafi işaretler ve endüstriyel tasarım hakları ve Fikir ve Sanat Eserleri Kanunu kapsamındaki haklara göre gümrük yetkilileri talep üzerine veya kendi insiyatifleriyle ilgili kişilerin haklarını ihlal eden malların gümrük işlemlerini askıya alabilir. Bu madde aynı zamanda, şüpheli olan malların değerinin takririni, gümrük yetkililerinin sorumluluğu, hak sahibinin dava esası hakkında yetkili makandan bu sürecten muaf tutulan ve gümrük islemleri askıya alınan malların imhasi veya tasfiyesi icin usulünce ihtiyati tedbir kararı almak icin yasal işlem başlatma yükümlülüğü sağlar.

CUSTOMS LAW No. 4458 (Adopted on 27.10.1999, entered into force on 5.2.2000)

Article 57

1. Under the legislation concerning protection on intellectual and industrial property rights, regarding the rights of trademarks, geographical indications and industrial designs and the rights covered by the Law of Intellectual and Artistic Works, at the request of the right holder or his representative or by their own initiative, where solid evidence is available that goods in question complies with the description of the cunterfeit trademark or pirated copyright goods, customs authorities shall suspend the customs procedures of the goods infringing the rights of the persons concerned. Where a suspensive decision is taken, the importer or the right holder or his representative shall be given notice.

2. In order to secure the rights of the importer or public depending on the nature of the case, and to prevent abuses, customs administration by its own initiative may order the applicant to provide a security equivalent to the value of the goods in question.

3. Where the goods in question have been released for free circulation before the acceptance of the application by customs administrations, the acceptance shall not mean that the right holder is entitled to claim indemnities on grounds that the goods in question have been released without proper examinations being performed. In case of the suspension of the customs procedures by customs administrations, within the framework of combat against counterfeit trademark or pirated copyright goods, proves to be useful or harmful to the persons concerned, the authorities of the customs administration shall not be liable against these persons.

4. If, within a period of 10 days following the notification of the suspensive decision taken by the customs administration to the right holder, the authorities of the customs administration have not been informed that legal proceedings leading to a decision on the merits of the case have been initiated or that the duly empowered authority has taken precautionary measures, the customs procedure shall be carried out in accordance with the request of the declarant.

5. The goods whose customs procedures have been suspended may be destroyed in accordance with the judicial decision of the duly empowered court and the provisions of disposal procedure, or they may be disposed of by being sold after their essential characters having been altered.

6. This Article shall not cover the personal goods and gifts brought by passengers and postal consignments of non-commercial nature.

4458 SAYILI GÜMRÜK KANUNU (Kabul tarihi: 27.10.1999, Yürürlüğe giriş: 5.2.2000)

MADDE 57- 1. Fikri ve sınai mülkiyet haklarının korunması mevzuatına göre, marka, coğrafi işaret, endüstriyel tasarım hakları ile Fikir ve Sanat Eserleri Kanunu kapsamına giren haklarla ilgili olarak, hak sahibinin yetkilerine tecavüz eder mahiyetteki eşyanın gümrük işlemleri; hak sahibinin veya temsilcisinin talebi üzerine veya söz konusu eşyanın sahte markalı ya da telif hakkına tabi taklit mal tarifine uyduğuna ilişkin açık deliller olması halinde, re’sen gümrük idareleri tarafından durdurulur. Durdurma kararı ithalatçıya veya hak sahibine veya temsilcisine bildirilir.

2. Gümrük idareleri, olayın özelliğine göre ithalatçının veya kamunun hakkını güvenceye almak ve suistimalleri önlemek amacıyla, başvuru sahibinden eşyanın kıymeti oranında bir teminat isteyebilirler.

3. Başvurunun kabul edildiği tarihte şikayet konusu eşya serbest dolaşıma girmiş ise başvurunun gümrük idaresince kabul edilmesi; söz konusu eşyanın gereğince muayene edilmeden ithaline izin verildiği gerekçesiyle hak sahibine tazminat hakkı doğurmaz. Sahte markalı veya taklit mallarla mücadele kapsamında, gümrük işlemleri gümrük idaresince re’sen durdurulan eşyadan dolayı, ilgili kişilerin yapılan işlemler sonucunda fayda veya zarara uğraması halinde, gümrük idaresi yetkilileri bu kişilere karşı sorumlu tutulmaz.

4. Gümrük idaresince alınan durdurma kararının hak sahibine tebliğinden itibaren on gün içinde esas hakkında yetkili mahkemede dava açılmaz veya mahkemeden tedbir niteliğinde karar alınmazsa, eşya hakkında beyan sahibinin talepte bulunduğu gümrük rejimi hükümlerine göre işlem yapılır.

5. Gümrük işlemleri durdurulan eşya, yetkili mahkemece alınan karar doğrultusunda, tasfiye rejimi hükümlerine göre imha veya asli nitelikleri değiştirilerek satış suretiyle tasfiye edilebilir.

6. Yolcu beraberinde getirilen zati ve hediyelik eşya ile posta kolileri ile gönderilen ticari mahiyette olmayan eşya için bu madde hükümleri uygulanmaz.
