Details Details Year of Version 2019 Dates Entry into force: April 22, 1999 Issued: April 22, 1999 Type of Text Implementing Rules/Regulations Subject Matter Copyright and Related Rights (Neighboring Rights) Notes This consolidated version of the Cinematographic Works (Right to Remuneration) Regulations takes into account amendments introduced by 'An Act to amend certain Acts and instruments and to repeal the Fisheries Prices Support Act (S.C. 2002, c. 17)', which was granted Royal Assent on June 13, 2002.

Section 15(1)(a) of the said amending Act introduced the amendments to paragraph 2(c) of this consolidated version, where the words “Canadian Film Development Corporation” and “the Canadian Film Development Corporation” are replaced by “Telefilm Canada”.

Cinematographic Works (Right to Remuneration) Regulations

His Excellency the Governor General in Council, on the recommendation of the

Minister of Industry, pursuant to subsections 17(3) and 62(1) of the Copyright Act,

hereby makes the annexed Cinematographic Works (Right to Remuneration)

Regulations.

Interpretation 1 The definitions in this section apply in these Regulations.

Canadian government film agency means a federal or provincial agency engaged

in the development and production of cinematographic works. (organisme

Canadian program means a Canadian program as defined in subsection 2(1) of the

Pay Television Regulations, 1990, in section 2 of the Specialty Services Regulations,

1990, and in section 2 of the Television Broadcasting Regulations, 1987. (émission

Prescribed Cinematographic Works

2 The following are prescribed cinematographic works for the purposes of section 17

of the Copyright Act, namely, a cinematographic work in which a performer’s

performance has been embodied as a result of an agreement entered into by the

performer on or after April 22, 1999:

(a) in respect of which the Minister of Canadian Heritage has issued a Canadian

film or video production certificate under the Income Tax Act;

(b) that is recognized as a Canadian program by the Canadian Radio-television

and Telecommunications Commission; or

(c) that has received production funding from Telefilm Canada, or other Canadian

government film agency.

Sur recommandation du ministre de l’Industrie et en vertu des paragraphes 17(3) et 62(1) de la Loi sur le droit d’auteur, Son Excellence le Gouverneur général en conseil prend le Règlement sur les oeuvres cinématographiques visées par un droit à rémunération, ci-après.

Définitions 1 Les définitions qui suivent s’appliquent au présent règlement.

émission canadienne S’entend au sens de l’article 2 du Règlement de 1987 sur la télédiffusion, du paragraphe 2(1) du Règlement de 1990 sur la télévision payante ou de l’article 2 du Règlement de 1990 sur les services spécialisés. (Canadian program)

organisme cinématographique gouvernemental canadien Organisme fédéral ou provincial participant au développement et à la production d’oeuvres cinématographiques. (Canadian government film agency)

Oeuvres cinématographiques 2 Les productions dans lesquelles la prestation d’un artiste-interprète a été incorporée par suite d’un contrat conclu par celui-ci le 22 avril 1999 ou après cette date qui présentent l’une ou l’autre des caractéristiques suivantes sont des oeuvres cinématographiques pour l’application de l’article 17 de la Loi sur le droit d’auteur:

a) la production fait l’objet d’un certificat de production cinématographique ou magnétoscopique canadienne délivré par le ministre du Patrimoine canadien aux termes de la Loi de l’impôt sur le revenu;

b) la production est une émission canadienne accréditée par le Conseil de la radiodiffusion et des télécommunications canadiennes;

c) la production a reçu des fonds d’aide à la production de films de Téléfilm Canada ou d’un autre organisme cinématographique gouvernemental canadien.
