Details Details Year of Version 1997 Dates Entry into force: September 25, 1997 Published: September 16, 1997 Promulgated: September 11, 1997 Adopted: August 20, 1997 Type of Text Main IP Laws Subject Matter Copyright and Related Rights (Neighboring Rights) Notes This Law provides for the extension of the term of protection of copyright to 70 years that shall begin from January 1 of the year following authors’ death. It further stipulates that works that have entered the public domain before the expiration of the term of protection of 70 years provided for by this Law, will automatically return to private domain, without prejudice to the rights that third parties have acquired in the reproductions of these works made during the time when they were in the public domain.

Article 2 of the Civil Code stipulates: “Laws shall not be binding until after their publication, and as of the stated day. If no day is stated, they shall be binding eight days following their official publication.”
This Law was published in the Official Gazette on September 16, 1997 (B.O. 16/09/97), with no specific date of entry into force; based on Article 2 of the Civil Code it entered into force eight days after its publication.

El Senado y Cámara de Diputados de la Nación Argentina reunidos en Congreso, etc. sancionan con fuerza de Ley:

Artículo 1° — Sustitúyense los artículos 5° y 84 de la Ley 11.723. modificada por el decreto ley 12.063/67, por los siguientes:

Artículo 5°: La propiedad intelectual sobre sus obras corresponde a los autores durante su vida y a sus herederos o derechohabientes hasta setenta años contados a partir del 1° de enero del año siguiente al de la muerte del autor.

En los casos de obras en colaboración, este término comenzará a contarse desde el 1° de enero del año siguiente al de la muerte del último colaborador. Para las obras póstumas, el término de setenta años empezará a correr a partir del 1° de enero del año siguiente al de la muerte del autor.

En caso de que un autor falleciera sin dejar herederos, y se declárase vacante su herencia, los derechos que a aquel correspondiesen sobre sus obras pasaran al Estado por todo el término de ley, sin perjuicio de los derechos de terceros.

Artículo 84: Las obras que se encontraren bajo el domino público, sin que hubiesen transcurrido los términos de protección previstos en esta ley, volverán automáticamente al dominio privado, sin perjuicio de los derechos que hubieran adquirido terceros sobre las reproducciones de esas obras hechas durante el lapso en que las mismas estuvieron bajo el domino público.

Dada en la Sala de Sesiones del Congreso Argentino, en Buenos Aires, a los veinte días del mes de agosto del año mil novecientos noventa y siete.
