PROPRIEDADE INDUSTRIAL. AÇÃO DE NULIDADE DE REGISTRO DE MARCA COMERCIAL. MARCA FRACA OU EVOCATIVA. POSSIBILIDADE DE CONVIVÊNCIA COM OUTRAS MARCAS. IMPOSSIBILIDADE DE CONFERIR EXCLUSIVIDADE À UTILIZAÇÃO DE EXPRESSÃO DE POUCA ORIGINALIDADE OU FRACO POTENCIAL CRIATIVO.

1.                           Marcas fracas ou evocativas, que constituem expressão de uso comum, de pouca originalidade ou forte atividade criativa, podem coexistir harmonicamente. É descabida, portanto, qualquer alegação de notoriedade ou anterioridade de registro, com o intuito de assegurar o uso exclusivo da expressão de menor vigor inventivo.

2.                           Marcas de convivência possível não podem se tornar oligopolizadas, patrimônios exclusivos de um restrito grupo empresarial, devendo o Judiciário reprimir a utilização indevida da exclusividade conferida ao registro quando esse privilégio implicar na intimidação da concorrência, de modo a impedi-la de exercer suas atividades industriais e explorar o mesmo segmento mercadológico. Aplicação da doutrina do patent misuse.

ACÓRDÃO

Vistos, relatados e discutidos estes autos, acordam os Ministros da Terceira Turma do Superior Tribunal de Justiça, na conformidade dos votos e das notas taquigráficas constantes dos autos, prosseguindo no julgamento, após o voto-vista do Sr. Ministro Massami Uyeda, por unanimidade, negar provimento ao recurso especial, nos termos do voto do(a) Sr(a). Ministro(a) Relator(a). Os Srs. Ministros Massami Uyeda, Sidnei Beneti, Paulo de Tarso Sanseverino e Vasco Della Giustina votaram com a Sra. Ministra Relatora.
