Direito autoral. Cinema. Legitimidade  passiva dos  exibidores. Trilhas sonoras. Precedentes da Corte.

 

1.             Está assentada jurisprudência da Corte no sentido de que exibidores são os responsáveis pelo pagamento de direitos autorais das trilhas sonoras dos filmes.

2.             Não é necessário que seja feita a indicação da entidade a que filiado o titular do direito autoral nem a identificação das músicas nem  dos autores, sob pena de ser inviabilizado o sistema de arrecadação e distribuição causando evidentes prejuízos aos titulares.

3.             Recurso especial conhecido e provido.

 

ACÓRDÃO

 

Vistos, relatados e discutidos os autos em que são partes as acima indicadas, acordam os Ministros da Terceira Turma do Superior Tribunal de Justiça, por unanimidade, conhecer do recurso especial e dar-lhe provimento, nos termos do voto do Sr. Ministro Relator. Os Srs. Ministros Nancy Andrighi e Castro Filho votaram com o Sr. Ministro Relator. Ausentes, justificadamente, o Sr. Ministro Antônio de Pádua Ribeiro e, ocasionalmente, o Sr. Ministro Humberto Gomes de Barros.
