E M E N T A

RECURSO ESPECIAL. OFENSA AOS ARTS. 458 E 535, I E II, DO CPC. INEXISTÊNCIA. LITIGÂNCIA DE MÁ-FÉ. PENALIDADES MAL APLICADAS. DIREITOS AUTORAIS. ESTILOS, MÉTODOS OU TÉCNICAS. INEXISTÊNCIA DE PROTEÇÃO.

1.           Não ofende o Art. 535 do CPC o acórdão que, embora rejeitando os embargos de declaração, examinou todas as questões pertinentes.

2.           Não é nula, por falta de fundamentação, sentença na qual o juiz declina completamente os motivos de seu convencimento.

3.           A aplicação de penalidades por litigância de má-fé exige dolo específico, perfeitamente identificável a olhos desarmados, sem o qual se pune indevidamente a parte que se vale de direitos constitucionalmente protegidos (ação e defesa).

4.           Estilos, métodos ou técnicas não são objetos de proteção intelectual (Art. 8º, I e II, da Lei 9.610/98). O que se tem sob guarida legal são as obras resultantes da utilização de estilos, métodos ou técnicas.

ACÓRDÃO

Vistos, relatados e discutidos os autos em que são partes as acima indicadas, acordam os Ministros da TERCEIRA TURMA do Superior Tribunal de Justiça na conformidade dos votos e das notas taquigráficas a seguir, por unanimidade, conhecer do recurso especial e dar-lhe provimento, nos termos do voto do Sr. Ministro Relator. Os Srs. Ministros Ari Pargendler e Nancy Andrighi votaram com o Sr. Ministro Relator.
