RECURSO ESPECIAL. RESPONSABILIDADE CIVIL. DIVULGAÇÃO DE OBRA LITERÁRIA NA INTERNET SEM AUTORIZAÇÃO E INDICAÇÃO DE SEU AUTOR. ATO ILÍCITO DO PREPOSTO. RESPONSABILIDADE OBJETIVA DO EMPREGADOR.

1.    O empregador responde objetivamente pelos atos ilícitos de seus empregados e prepostos praticados no exercício do trabalho que lhes competir, ou em razão dele (arts. 932, III, e 933 do Código Civil).

2.   Tendo o Tribunal de origem admitido que o preposto da instituição de ensino entregou obra literária de terceiro para disponibilização no sítio eletrônico daquela, sem autorização e indicação clara de seu verdadeiro autor, o reconhecimento da responsabilidade da instituição empregadora pelos danos causados é de rigor, ainda que não haja culpa de sua parte.

3.   Ausente a comprovação dos danos materiais, afasta-se o pleito indenizatório. 4.Presentes os requisitos para a configuração dos danos morais, assegura-se justa reparação.

4.   Recurso especial conhecido e parcialmente provido.

A Turma, por unanimidade, conheceu e deu parcial provimento ao recurso especial, nos termos do voto da Sra. Ministra Relatora. Os Srs. Ministros Antonio Carlos Ferreira, Marco Buzzi e Raul Araújo votaram com a Sra. Ministra Relatora.
