The Cabinet makes the following Regulations under Section 66 of the Trademarks Act 2019:

1 Citation

These Regulations may be cited as the Trademarks (Forms and Fees) Regulations 2020.

2 Commencement

These Regulations commence on the day they are notified in the Gazette.

3 Objectives

The objectives of these Regulations are to:

(a) provide the forms required for the necessary applications under the Act;

(b) provide the fees required for the necessary applications under the Act; and

(c) provide the form of the Register of Trademarks.

4 Register of Trademarks

For the purposes of Section 7 of the Act, the Register established and maintained by

the Registrar may be kept as set out in Schedule 1:

(a) in writing; and

(b) in digital or electronic form.

5 Application for registration of trademark

For the purposes of Section 9 of the Act, an application form for the registration of a trademark shall be in Form 1 of Schedule 2.

6 Notification of application in the Gazette

For the purposes of Section 10 of the Act, a notification of an application in the

Gazette shall be in Form 2 of Schedule 2.

7 Opposition to application

For the purposes of Section 11 of the Act, a notice of opposition shall be in Form 3 of Schedule 2.

8 Notice for non-complying application

(1) For the purposes of Section 15 of the Act, a notice for non-complying application

shall be in Form 4 of Schedule 2.

(2) The applicant shall provide a response or amend the application within 30 days

of receipt of such notice.

9 Amendment of pending application for registration

For the purposes of Section 16(1) of the Act, an application form for the amendment

of a pending application for the registration of a mark shall be in Form 5 of Schedule 2.

10 Notice of decision

For the purposes of Section 17 of the Act, a notice of decision by the Registrar shall

be in Form 6 of Schedule 2.

11 Certificate of registration

For the purposes of Section 18(a) of the Act, a certificate of registration of a

trademark shall be in Form 7 of Schedule 2.

12 Publication of trademark in Gazette

For the purposes of Section 18(b) of the Act, a publication in the Gazette shall be in

Form 8 of Schedule 2.

13 Application for renewal

For the purposes of Section 36 of the Act, an application form for the renewal shall be in Form 9 of Schedule 2.

14 Application for correction of Register

For the purposes of Section 37 of the Act, an application form for correction of the

Register shall be in Form 10 of Schedule 2.

15 Surrender of trademark

For the purposes of Section 38 of the Act, an application form for the surrender of a

trademark shall be in Form 11 of Schedule 2.

16 Alteration of trademark

For the purposes of Section 39 of the Act, an application form for the alteration of a

trademark is set out in Form 12 of Schedule 2.

17 Addition of goods or services

For the purposes of Section 40 of the Act, an application form for the addition of

goods or services shall be in Form 13 of Schedule 2.

18 Application for removal for non-use of trademark

For the purposes of Section 41(1) of the Act, an application form for the removal of a

trademark from the Register shall be in Form 14 of Schedule 2.

19 Notice of application for removal

For the purposes of Section 41(3)(a) of the Act, a notice by the Registrar shall be in

Form 15 of Schedule 2.

20 Publication of notice in Gazette

For the purposes of Section 41(3)(b) of the Act, a publication in the Gazette shall be

in Form 16 of Schedule 2.

21 Notice of decision for removal of non-use of trademark

For the purposes of Section 41(4) of the Act, a notice by the Registrar shall be in

Form 17 of Schedule 2.

22 Rectification of Register

For the purposes of Section 42 of the Act, an application for the rectification of the

Register shall be in Form 18 of Schedule 2.

23 Application to register assignment of trademark

For the purposes of Section 44 of the Act, an application form to register the assignment of a trademark shall be in Form 19 of Schedule 2.

24 Recording assignment of trademark in Register

For the purposes of Section 45 of the Act, an application form for a record of

assignment to be entered in the Register shall be in Form 20 of Schedule 2.

25 Inspection

An application for inspection of the Register shall be in Form 21 of Schedule 2.

26 Certified copy or extract of document

An application for a certified copy or extract of any document shall be in Form 22 of

Schedule 2.

27 Fees

The fees to be paid for the purposes of the Act and Regulations are set out in Schedule 3.
