Part Four of the Civil Code of the Russian Federation is the legal foundation governing intellectual property (IP) rights in Russia. It was introduced by Federal Law No. 230-FZ of December 18, 2006 and came into force on January 1, 2008. This part consolidated all IP-related provisions, which had previously been scattered across different laws, into a single, coherent section of the Civil Code.
Key Features of Part Four:
1) Comprehensive IP Coverage: It covers all main categories of intellectual property, including:
Copyright and related rights
Patent law (inventions, utility models, industrial designs)
Trademarks and service marks
Appellations of origin and geographical indications
Trade secrets (know-how)
Rights to plant varieties and topographies of integrated circuits
2) Legal Protection and Enforcement: It sets out the conditions for obtaining, using, and protecting these rights, as well as remedies for infringement.
3) Exclusive Rights: The Code defines the scope and duration of exclusive rights, transfer of rights (including licensing and assignment), and limitations on use.
4) Unified Approach: It introduced a unified system for the registration and enforcement of IP rights, including a specialized court—the Intellectual Property Rights Court—to handle IP disputes (Article 1248).
5) Moral and Economic Rights: In addition to economic rights, the Code also recognizes moral rights, especially in the field of copyright.
Part Four has significantly modernized Russia’s IP legislation and aligned it more closely with international standards, such as those established by the WIPO, TRIPS Agreement, and other multilateral treaties.
This consolidated version of the Civil Code (Parts One to Four) incorporates amendments up to Federal Law No. 48-FZ of March 11, 2024, "On Amendments to Article 123.22 of Part One of the Civil Code of the Russian Federation," which entered into force on March 22, 2024.
The said amending law—Federal Law No. 48-FZ—introduced changes to paragraphs 5 and 6 of Article 123.22 under Subsection 2, Section I of Part One of this consolidated Civil Code. These amendments concern the liability of budgetary and autonomous institutions and do not relate to intellectual property matters.
In this consolidated version, the latest amendment to Part Four concerns paragraph 2 of Article 1248 ("Disputes Relating to the Protection of Intellectual Rights"), introduced by Federal Law No. 4-FZ of January 30, 2024, "On Amendments to Article 1248 under Chapter 69, Section VII of Part Four of the Civil Code of the Russian Federation," which entered into force on February 10, 2024.
Additionally, in 2023, the Decision of the Constitutional Court of the Russian Federation No. 10-P of March 24, 2023 was issued to review the constitutionality of paragraph 4 of Article 1370 (now repealed), under Chapter 72 (Patent Law) of the Civil Code.
