'The new Industrial Property Code transposes into national law the Directive 98/44/EC of July 6, 1998 on the Protection of Biotechnology and the Directive 98/71/EC of October 13, 1998 on the Protection of Designs. It integrates rules arising from the Agreement on Trade Related Aspects of Intellectual Property Rights related to Trade (TRIPS).
The Code also incorporates the Decree-Law No. 106/99 of March 31, 1999, which regulates and disciplines the Regulation No. 1768/92/CE of June 18, 1992 concerning the Creation of a Supplementary Protection Certificates for Medicines and No. 1610/96/CE of July 23, 1996 concerning the Creation of a Supplementary Protection Certificate for Plant Protection Products, while retaining the alignment with the latest proposals from the Commission on Utility Models'.
