Regulations Establishing the Period Within Which Owners of Copyright not

Represented by Collective Societies Can Claim Retransmission Royalties

The Copyright Board, pursuant to paragraph 70.66(3)(b) of the Copyright Act,

hereby makes the annexed Regulations Establishing the Period for Royalty

Entitlements of Non-members of Collecting Bodies.

S.C. 1988, c. 65, s. 65

1 The owner of copyright who does not authorize a collective society to collect, for

that person's benefit, the royalties referred to in paragraph 31(2)(d) of the Copyright

Act and whose work is so retransmitted has a period of two years following the end

of the calendar year in which the retransmission occurred to claim the royalties

payable under subsection 76(1) of that Act.

Règlement fixant le délai dans lequel les titulaires de droits d’auteur non représentés

par des sociétés de gestion peuvent réclamer des redevances pour la retransmission

En vertu de l'alinéa 70.66(3)b) de la Loi sur le droit d'auteur, la Commission du droit

d'auteur prend le Règlement fixant les délais de déchéance pour les réclamations

des droits des titulaires non membres de sociétés de perception, ci-après.

1 Le titulaire d'un droit d'auteur qui n'a pas habilité une société de gestion à agir à

son profit et dont l'oeuvre a été retransmise dans le cadre de l'alinéa 31(2)d) de la

Loi sur le droit d'auteur dispose d'un délai de deux ans suivant la fin de l'année civile

au cours de laquelle l'oeuvre est retransmise pour réclamer les redevances exigibles

en vertu du paragraphe 76(1) de cette loi.
