Citation
1. These Regulations may be cited as the Copyright (Import Restrictions) Regulations.
Definitions
2. In these Regulations, unless the context otherwise requires —
“Board” means the Trade Development Board established under section 3 of the Trade Development Board Act [Cap. 330];
“work” means a published literary, dramatic or musical work.
Schedule
3.—(1) A notice to the Board under section 142(1) of the Act by the owner of the copyright in a work, cinematograph film or sound recording shall be in accordance with Form 1 or 1A and Form 2 set out in the Schedule.
(2) A separate notice in accordance with Form 1 or 1A set out in the Schedule shall be given in respect of any one work or any one cinematograph film or sound recording, respectively.
(3) A separate notice in accordance with Form 2 set out in the Schedule shall be given in respect of each importation of one or more copies of —
(a) any one work which is the subject of a notice in accordance with Form 1; or
(b) any one cinematograph film or sound recording which is the subject of a notice in accordance with Form 1A,
which has not been withdrawn.
(4) Each notice in accordance with Form 1, 1A or 2 shall be accompanied by a statutory declaration in accordance with Form 3 set out in the Schedule sworn by the person giving the notice verifying the particulars in the notice.
(5) The owner of the copyright in a work, cinematograph film or sound recording may appoint another person to act as his agent for the purpose of the giving of a notice by the owner under section 142(1) of the Act.

Time and manner of giving notice
4. A notice to the Board under section 142(1) of the Act shall be delivered to the Board personally —
(a) during such time as the office of the Board is open for business; and
(b) at such time as is reasonably possible for the Board to take any action under section 142 of the Act in relation to that notice.
Fee
5. A fee of $200 shall be paid to the Board in respect of each separate notice given to the Board at the time such notice is given.
Further information and evidence
6. A person who has given a notice to the Board under section 142(1) of the Act in relation to a work, cinematograph film or sound recording shall, at the time of giving the notice or at the time when the work, cinematograph film or sound recording is imported, or at both such times, give to the Board such information and evidence within such time and in such form as the Board may require for the exercise of its powers under section 142 of the Act, including such information and evidence for the purpose of enabling the Board to satisfy itself as to the subsistence of copyright in the work, cinematograph film or sound recording, as to the ownership of that copyright and, where the notice was given by a person as agent for the owner of the copyright, as to the authority of the person to give the notice.
Change in particulars
7. A person who has given any notice to the Board under section 142(1) of the Act in relation to a work, cinematograph film or sound recording shall notify the Board in writing of any change in the particulars specified in the notice or affecting the notice within 14 days of the change and further notice shall be given as the Board may require.
Security
8. The Board and its agents may from time to time require a person who has given a notice in accordance with Form 1 in relation to a work or Form 1A in relation to a cinematograph film or sound recording set out in the Schedule, to give the Board and its agents security or further security within such time and in such manner, whether by way of deposit of money or of an instrument of guarantee, or otherwise, as the Board specifies, in respect of any liability or expense that may be incurred by the Board and its agents as a result of the seizure of any copy of the work, cinematograph film or sound recording to which the notice relates.

Indemnity
9.—(1) Where the Board has not required any security referred to in regulation 8 to be given, the person who has given a notice to the Board under section 142(1) of the Act in relation to any work or any cinematograph film or sound recording and if such person is an agent of the owner of the copyright in the work, cinematograph film or sound recording, the owner shall be jointly and severally liable to indemnify the Board and its agents against any liability or expense that may be incurred by the Board and its agents as a result of the seizure of any copy of the work, cinematograph film or sound recording to which the notice relates.
(2) The person who has given a notice to the Board under section 142(1) of the Act in relation to any work or any cinematograph film or sound recording and if such person is an agent of the owner of the copyright in the work, cinematograph film or sound recording, the owner shall be jointly and severally liable to indemnify the Board and its agents against any liability or expense that may be incurred by the Board and its agents as a result of the seizure of any copy of the work, cinematograph film or sound recording to which the notice relates to the extent to which any security or further security referred to in regulation 8 given by the person to the Board and its agents in respect of that liability or expense is insufficient.
Refusal to seize and forfeit
10. The Board and its agents may refuse to seize copies imported into Singapore of a work or a cinematograph film or sound recording to which a notice under section 142(1) of the Act relates if the person who has given the notice has failed —
(a) to comply with any requirement by the Board under these Regulations;
(b) to comply with any of the provisions in these Regulations; or
(c) to indemnify the Board and its agents against any liability or expense as provided by regulation 9(1) or (2).

En vertu des pouvoirs qui lui sont conférés aux termes des articles 142 et 202 de la loi de 1987 sur le droit d’auteur*, le ministre [Minister for Law] édicte les dispositions suivantes :
Citation et entrée en vigueur
1. Le présent règlement peut être cité sous le nom de règlement de 1987 relatif au droit d’auteur (restrictions à l’importation) et entre en vigueur le 10 avril 1987.
Définitions
2. Dans le présent règlement, à moins que le contexte ne requière une interprétation différente, il faut entendre par
“conseil” le Conseil du développement commercial créé aux termes de l’article 3 de la loi y relative;
“œuvre” une œuvre littéraire, dramatique ou musicale publiée.
Formules
3. — 1) Un avis adressé au conseil en vertu de l’article 142.1) de la loi par le titulaire du droit d’auteur sur une œuvre, un film cinématographique ou un enregistrement sonore doit être établi sur le modèle des formules 1 ou 1A et 2, reproduites en annexe.
2) Toute œuvre, de même que tout film cinématographique ou tout enregistrement sonore, doit faire l’objet d’un avis distinct, établi selon la formule 1 ou la formule lA de l’annexe.

3) Un avis distinct, établi selon la formule 2 de l’annexe, doit être adressé en ce qui concerne chaque importation d’un ou plusieurs exemplaires ou copies
a) de toute œuvre faisant l’objet d’un avis établi selon la formule 1, ou
b) de tout film cinématographique ou de tout enregistrement sonore faisant l’objet d’un avis établi selon la formule 1A
qui n’a pas été retiré.
4) Tout avis établi selon la formule 1, 1A ou 2 doit être accompagné d’une déclaration rédigée selon le modèle de la formule 3 de l’annexe, établie sous serment par l’auteur de l’avis et confirmant les indications portées dans ce dernier.
5) Le titulaire du droit d’auteur sur une œuvre, un film cinématographique ou un enregistrement sonore peut se faire représenter par un mandataire pour adresser un avis en application de l’article 142.1) de la loi.
Conditions à respecter pour adresser un avis
4. Tout avis adressé au conseil en vertu de l’article 142.1) de la loi doit être remis directement au siège du conseil
a) aux heures ouvrables, et
b) en temps voulu pour permettre au conseil de prendre toutes mesures utiles en ce qui concerne cet avis en vertu de l’article 142 de la loi.
Droits
5. Tout avis distinct adressé au conseil doit être accompagné du paiement d’un droit de 200 dollars.
Renseignements complémentaires et preuves
6. Toute personne qui adresse un avis au conseil en vertu de l’article 142.1) de la loi au sujet d’une œuvre, d’un film cinématographique ou d’un enregistrement sonore doit, simultanément ou au moment de l’importation de l’œuvre, du film ou de l’enregistrement en question, ou encore à ces deux occasions, donner au conseil les renseignements et preuves que celui-ci peut exiger, dans les délais et selon les modalités qu’il peut déterminer, pour l’exercice des pouvoirs qui lui sont conférés aux termes de l’article 142 de la loi, y compris tous renseignements et preuves visant à lui permettre de disposer des éléments nécessaires pour s’assurer de l’existence d’un droit d’auteur sur l’œuvre, le film cinématographique ou l’enregistrement, de la titularité de ce droit d’auteur et, lorsque l’avis a été donné par un mandataire pour le compte du titulaire du droit d’auteur, du droit de cette personne d’agir à ce titre.

Modification des renseignements donnés dans l’avis
7. Quiconque a adressé un avis au conseil en vertu de l’article 142.1) de la loi au sujet d’une œuvre, d’un film cinématographique ou d’un enregistrement sonore doit aviser par écrit le conseil de toute modification touchant aux renseignements donnés dans l’avis ou ayant une incidence sur l’avis dans un délai de 14 jours et, le cas échéant, adresser un nouvel avis au conseil à la demande de ce dernier.
Garantie
8. Le conseil et ses agents peuvent périodiquement exiger de toute personne qui a adressé un avis selon la formule 1 pour ce qui concerne une œuvre ou selon la formule 1A de l’annexe pour ce qui concerne un film cinématographique qu’elle leur donne la garantie ou le complément de garantie — que ce soit sous la forme d’un dépôt de fonds ou d’un instrument de garantie ou d’une autre manière — que le conseil détermine, au titre de toutes obligations ou dépenses pouvant incomber au conseil et à ses agents du fait de la saisie de toute copie ou de tout exemplaire de l’œuvre, du film cinématographique ou de l’enregistrement sonore auquel se rapporte l’avis.
Indemnisation
9. — 1) Lorsque le conseil n’a pas exigé la garantie visée à l’article 8, la personne qui lui a adressé un avis en vertu de l’article 142.1) au sujet d’une œuvre, d’un film cinématographique ou d’un enregistrement sonore et, s’il s’agit du mandataire du titulaire du droit d’auteur sur l’œuvre, le film ou l’enregistrement en question, le titulaire lui-même sont conjointement et solidairement tenus d’indemniser le conseil et ses agents au titre de toutes obligations ou dépenses pouvant incomber à ces derniers du fait de la saisie de toute copie ou de tout exemplaire de l’œuvre, du film cinématographique ou de l’enregistrement sonore auquel se rapporte l’avis.
2) La personne qui a adressé un avis au conseil en vertu de l’article 142.1) de la loi au sujet d’une œuvre, d’un film cinématographique ou d’un enregistrement sonore et, s’il s’agit du mandataire du titulaire du droit d’auteur sur l’œuvre, le film cinématographique ou l’enregistrement sonore en question, le titulaire lui-même sont conjointement et solidairement tenus d’indemniser le conseil et ses agents au titre de toutes obligations ou dépenses pouvant incomber à ces derniers du fait de la saisie de toute copie ou de tout exemplaire de l’œuvre, du film cinématographique ou de l’enregistrement sonore auquel se rapporte l’avis, dans la mesure où la garantie ou le complément de garantie donné par l’intéressé au conseil et à ses agents au titre des obligations ou dépenses en question, conformément aux dispositions de l’article 8, est insuffisant.
Refus de saisie et de confiscation
10. Le conseil et ses agents peuvent refuser de saisir des copies ou exemplaires importés à Singapour d’une œuvre, d’un film cinématographique ou d’un enregistrement

sonore ayant fait l’objet d’un avis en application de l’article 142.1) de la loi si la personne qui a adressé l’avis
a) n’a pas satisfait aux conditions posées par le conseil en vertu du présent règlement,
b) ne s’est pas en tous points conformée aux dispositions du présent règlement, ou
c) n’a pas indemnisé le conseil et ses agents au titre de toutes obligations ou dépenses assumées, conformément aux dispositions de l’article 9.1) ou 2).
Abrogation
11. Les textes réglementaires édictés par le directeur de l’enregistrement des importations et exportations au sujet de la retenue et de la confiscation de copies ou d’exemplaires importés portant atteinte au droit d’auteur, publiés une première fois dans la Gazette sous le numéro 1703/1918 puis de nouveau par la suite sous le numéro 1210/1931, sont abrogés.
